Dear Jessi Anderson: On November 1, 2024, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of citation 3 in the Correction Order issued to you by the Department of Human Services on October 25, 2024. Because you did not request reconsideration of the remaining citations, those citations are final and not within the scope of this review. SUMMARY OF CITATIONS AND RECONSIDERATION DETERMINATION:
Citation 3: Violation: The required in-service training had not been completed for 1 of 1 (SP4) individuals (director, staff persons, substitutes, or unsupervised volunteers) for the previous concluded calendar year. In-service training did not include the required number of in-service training hours for the previous concluded calendar year. Request for Reconsideration. You indicated in your request for reconsideration that the staff person was hired in April of 2023 and completed orientation at that time. You indicated the staff person also completed a yearly in-service training in May 2024, and that documentation is in his/her file. Applicable Law. Under Minnesota Statutes, section 245A.40, subdivision 7, a license holder must ensure that staff persons complete in-service training each calendar year. Reconsideration Determination. No documentation of required in-service training for 2023 was available at the time of the licensing visit, and your reconsideration request indicates in-service training was completed in 2024. Because there was no documentation of in-service training for 2023, there is sufficient evidence to support the citation and it is affirmed. Disposition: The Commissioner has reviewed the request for reconsideration and all the information submitted in response to the correction order. The Commissioner finds there is sufficient evidence to support the citation, and it is affirmed. This is a final agency decision. Previously Ordered Corrective Action: In the Correction Order issued on October 25, 2024, you were ordered to correct the violations cited and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 245A.06, subdivision 2(a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
