March 5, 2025 Therese Davis 30 East Plato Blvd St Paul, MN 55107 RE: Report No. 202407831 Wingspan Life Resources/ Wingspan Life Resources License No. 1069360/1069342 Dear Therese Davis: CORRECTION ORDER An investigation of Wingspan Life Resources/ Wingspan Life Resources was completed regarding report number 202407831 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned physical abuse. The disposition of the investigation report is substantiated. Two violations were noted. VIOLATIONS AND CORRECTION ORDERS The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes, section 245D.10, subdivision 4. Violation: The license holder did not review and update, as needed, the following policies and procedures as required: · The Vulnerable Adult Reporting Procedures External Reporting policy had outdated and contact information for the Common Entry Point. · The Definition of Maltreatment policy contained outdated and inaccurate statutory references. · The facility maintained a Rule 40 policy, which was not consistent with current statute. · The facility’s Behavioral Procedures Which Are Permitted but Controlled policy - permitted the use of procedures that are prohibited according to current statute, including partial sensory restriction of a person’s vision or hearing; and - permitted other procedures as a means of behavior modification in a manner that was not permitted according to current statute, including the use of mechanical restraints, manual restraints, and time outs. · The facility’s Emergency Use of Controlled Procedure policy was inconsistent with current statute. Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. 2. Citation: Minnesota Statutes, section 245D.09 subdivision 4, items 5, 7, and 8. Violation: The license holder failed to provide staff persons with accurate training on the following program requirements: · Vulnerable adult reporting · Emergency use of manual restraints · Prohibited procedures Corrective Action Ordered: Correct immediately and maintain compliance with this licensing requirement on a continuing basis throughout the program. If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
