Dear Jeffery Feltz:
CORRECTION ORDER
An investigation of Community Living Options Inc Oakdale was completed regarding report number 202408754 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned financial exploitation. The disposition of the investigation report is substantiated. One violation was noted.
VIOLATION AND CORRECTION ORDER
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota Statues, section 245D.07, subdivision 1, paragraph (a).
Violation: For one person served (P) whose record was reviewed, the license holder failed to provide services in response to the person’s identified needs, interests, preferences, and desired outcomes as specified in the coordinated service and support plan and the coordinates service and support plan addendum.
· According to the P’s support plans dated June 13, 2024, the license holder was responsible for managing and safeguarding the P’s finances. This included maintaining a monthly statement that itemized receipts and disbursements of the P’s funds that were then used to reconcile the P’s financial account each month.
· On October 3, 2024, the P’s case manager requested copies of the P’s financial account statements from July through September 2024. It was determined that prior to this request, the facility had not obtained the login information to access the P’s online financial account that would be needed to review the P’s financial statements and reconcile the P’s financial account as required by the P’s support plans.
Corrective Action Ordered: Immediately and on an ongoing basis, you must comply with 245D requirements related to the provision of services in accordance with the person’s coordinated service and support plan and the coordinated service and support plan addendum.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
