Terms of Settlement Agreement:
1. Upon final execution of the Settlement Agreement, the parties agree that the Applicants are not prohibited from continuing with their application for a family child care license under license number 1125502, provided that the Applicants, collectively or individually, do not attempt to provide family child care, if granted a license, at a property where the Disqualified Person (identified in the Non-Public Provider Agreement) resides or is otherwise able to have access to a child receiving services from the Applicants’ family child care program.
2. Nothing in this Agreement shall limit DHS’ authority to deny any pending or future license application if all licensing requirements are not met. Should DHS deny the application, the Applicants maintains the right to appeal that order pursuant to Minnesota Statutes, section 245A.05, subdivision (b).
3. If the Applicants are licensed to provide family child care services, they will follow the terms of the Non-Public Provider Agreement, which includes in part:
a. The Applicants will not allow the Disqualified Person to have access to their licensed family child care program, or to any child receiving services from the program, except that the Disqualified Person may pick up and drop off his/her children from the program so long as s/he is under continuous, direct supervision for the entire duration of the pick-ups and drop-offs.
b. The Applicants will not use the Disqualified Person as a caregiver, substitute caregiver, or emergency replacement in the family child care program.
4. The Applicants will immediately notify Houston County of any changes in membership in their respective households.
5. Pursuant to Minnesota Statutes, Section 245A.03, subdivisions 2(a)(2) and 2(b), Applicants are prohibited from providing legally unlicensed child care under Minnesota Statutes, Section 245A.03, subdivisions 2(a)(2) and 2(b).
6. In accordance with Minnesota Statutes, section 245A.07, if licensed, Applicants agree to post the Settlement Agreement in a location in the family child care program that is conspicuous to the parents of the children receiving services and all visitors to the center for a period of two years from the effective date of this Agreement.
