Terms of Settlement Agreement:

1. Upon final execution of the Settlement Agreement, License Holder hereby voluntarily withdraws her appeal of the TIS Order.

2. DHS agrees that upon final execution of the Settlement Agreement, DHS agrees not to impose the TIS Order.

3. License Holder agrees that until she receives further directions otherwise from Dakota County and DHS, License Holder must ensure that Household Member identified in the Non-Public Provider Agreement is not allowed on the licensed child care residence and property during the hours the program has children receiving services. License Holder must also ensure that Household Member does not have any direct contact with, or access to, children receiving services. These conditions supersede any permission provided for Household Member by DHS’s Background Studies Division in relation to the study submitted for Household Member on or around March 13, 2025.

4. License Holder will post the Settlement Agreement in her family child care program in a conspicuous place and provide a copy of the Settlement Agreement to parents or guardians of all children in care under License No. 1054989. License Holder shall obtain signatures from parents or guardians of each child attending her family child care program indicating they have received a copy of this Settlement Agreement. Documentation that the parents received a copy of this Settlement Agreement shall be provided to the County within thirty (30) calendar days of the effective date of the Settlement Agreement. For new families enrolling a child in the License Holder’s family child care program, License Holder shall submit documentation signed by the parent or guardian to the County within five (5) days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of the Settlement Agreement.
