PUBLIC Summary of Settlement Agreement License Holder: Amber Lundeen License Number: 1082954 Program Type: Family Child Care Date of Licensing Action: December 20, 2024 Licensing Action Taken: Order to Pay Fine Action appealed and settlement agreement signed by Commissioner on: April 2, 2025 Terms of Settlement Agreement: 1. Upon final execution of the Settlement Agreement, License Holder voluntarily withdraws the appeal of the Order to Pay a Fine. 2. Upon final execution of the Settlement Agreement, DHS agrees not to impose the Order to Pay a Fine on the family child care license of Amber Lundeen, subject to Paragraphs 3 and 4. 3. License Holder agrees to submit an amended supervision plan to Dakota County within 15 days of execution of the Settlement Agreement, to include the term that License Holder will maintain the children receiving services from the family child care program within a fenced-in outdoor play space that is compliant with Minnesota Rules, parts 9502.0300–.0445, and other applicable Minnesota statutes and rules, when they are playing outdoors on the program’s property. The parties agree that the Order of Conditional License dated June 21, 2024, will be amended to require License Holder to comply with the amended supervision plan. 4. License Holder agrees to erect a permanent fence by June 30, 2025, to enclose the family child care program’s outdoor play space that is compliant with applicable Minnesota statutes and rules. 5. DHS agrees to stay the entire fine amount of $1,000.00 until DHS receives confirmation to its satisfaction that License Holder has complied with the terms of Paragraphs 3 and 4. 6. The stayed fine will be immediately reinstated if: a. DHS determines that License Holder has not complied with the terms of Paragraph 3 and 4 by their specified dates, or by another agreed-upon date; or b. DHS determines that License Holder has failed to comply with licensing requirements or issues any additional orders to License Holder resulting in a fine, conditional license, or other licensing sanctions during the period of the stay.
