Terms of Settlement Agreement:
1. License Holder’s family child care license, License No. 1066344, will be placed on conditional status for a period of two years from the effective date of this Agreement. While under the conditional license, License Holder must comply with the following terms:
a. License Holder will follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445.
b. No variances to age distribution or capacity will be granted during the conditional period.
c. License Holder must ensure that Household Member identified in the Non-Public Provider Agreement does not have any unsupervised direct contact with, or access to, children served by the family child care program, except for his/her own children who are enrolled in the program.
d. License Holder must ensure that Household Member identified in the Non-Public Provider Agreement does not act as a caregiver or a substitute caregiver in the family child care program.
e. License Holder must ensure that Household Member does not transport children served by the family child care program, except for his/her own children who are enrolled in the program.
f. License Holder must ensure that Household Member identified in the Non-Public Provider Agreement is not present in the licensed areas of the family child care program during the hours the program is in operation, except said Household Member may transition through a licensed area to or from an unlicensed area of the program so long as License Holder and Household Member comply with provisions 4.c. and 4.d. above.
g. The parties agree that Washington County Community Services will monitor the family child care program’s compliance with the terms of this Settlement Agreement by conducting unannounced licensing review visits to the program’s residence and property according to the following schedule:
i. At least once a month for a duration of three (3) months from the effective date of this Settlement Agreement; and
ii. After the initial three-month period, if no additional licensing violations have been cited, Washington County may implement a visitation schedule of at least once every quarter until the end of the conditional period.
