April 25, 2025 Jay Freshour, Authorized Agent Genesis Group Homes Inc. 8245 93rd Avenue North Brooklyn Park, Minnesota 55445 License Number: 1072844 (245D – HCBS) Report Number: 202500729 CORRECTION ORDER Dear Jay Freshour: A licensing investigation of Genesis Group Homes Inc., located at 8245 93rd Avenue North, Brooklyn Park, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing investigation a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245D.07, subdivision 1a, paragraph (a). Violation: For one of one person whose record was reviewed (P1), the license holder did not provide services in response to the person’s identified needs as specified in the support plan addendum. The license holder failed to provide services in response to P1’s identified needs a specified in P1’s support plan addendum. · DHS received a report that on August 24, 2024, P1 and a staff person attended the Minnesota State Fair and P1 was unsupervised for a period of time. · P1’s “Support Plan Addendum - Intensive Services” developed by the license holder stated that P1 “will be always supervised while at home and in the community”. · P1’s “Self-Management Assessment” (SMA) developed by the license holder contained inconsistent information regarding the license holder’s responsibilities related to the supervision of P1. P1’s SMA stated that staff would stay within “visual range” of P1 “while in the community”; however, P1’s SMA also stated that staff will remain within “arm’s reach”. · Information provided to DHS showed that P1 was unsupervised for a period of time between 30 minutes and 3 hours. The license holder is no longer providing services to P1. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.11, subdivision 1. Violation: The license holder did not enforce policies and procedures for responding to and maintaining information about incidents as required. For an incident involving P1 on August 24, 2024, the license holder failed to enforce their “Policy and Procedure on Responding To and Reporting Incidents”. · The license holder’s policy required the license holder to “immediately” call 911 if a person is determined to be “missing” based off of the person’s supervision level. Information provided to DHS shows that law enforcement was notified of P1 being missing; however, the notification to law enforcement did not occur “immediately” after determining that P1 was missing. · The license holder’s policy required incidents to be documented on a “General Event Report”. DHS requested a copy of the “General Event Report” related to this incident; however, the license holder reported that a “General Event Report” for this incident was not completed. The license holder is no longer providing services to P1. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
