Dear Rose Mingo Holtz:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 1 and 2 in the Correction Order dated February 10, 2025. You did not request reconsideration of Citation 3. Citation 3 is final and not subject to review.
SUMMARY OF CITATIONS AND RECONSIDERATION DETERMINATION:
Citation 1:
Violation. The program did not comply with cardiopulmonary resuscitation (CPR) training requirements. Documentation was not available on site to show that 3 of 3 (SP1, SP2 and SP5) individuals (director, staff persons, substitutes, or unsupervised volunteers) had satisfactorily completed the required pediatric CPR training including the treatment of obstructed airways and a hands-on skill assessment within the previous two years (SP1, SP2 and SP5).
Request for Reconsideration. You contend, “My two aides are summer staff, working only 3-4 weeks in the summer. I had planned for them to complete their CPR training before June, but the school has limited funds and cannot afford the $ 90-$120 per employee. We need funding to cover the costs.”
Applicable Law. The director, staff persons, substitutes, and unsupervised volunteers must satisfactorily complete pediatric cardiopulmonary resuscitation (CPR) training every two years. Pediatric CPR training must be completed prior to having unsupervised direct contact with a child. Minnesota Statutes, section 245A.40, subdivision 4 and Minnesota Rules, part 9503.0120, subpart D.
Reconsideration Determination. You did not dispute that SP1, SP2, and SP5 had not completed the required pediatric CPR training citing budgetary constraints as a reason for noncompliance with the requirement. Through your own admission, SP1, SP2 and SP5 did not complete the required CPR training. In addition, there was no documentation to show that SP1, SP2 and SP5 had satisfactorily completed the required pediatric CPR training. Therefore, Mes Amis did not comply with the required CPR training requirements. The record supports Citation 1, and it is affirmed.
Citation 2
Violation. The program did not comply with first aid training requirements. Documentation was not available on site to show that 3 of 3 (SP1, SP2 and SP5) individuals (director, staff persons, substitutes, or unsupervised volunteers) completed pediatric first aid training within the previous two years (SP1, SP2 and SP5).
Request for Reconsideration.

Applicable Law.
The director, staff persons, substitutes, and unsupervised volunteers must satisfactorily complete pediatric first aid training every two years, prior to having unsupervised direct contact with a child, but not to exceed the first 90 days of employment. Pediatric first aid training must be repeated at least every second calendar year. Minnesota Statutes, section 245A.40, subdivision 3 and Minnesota Rules, 9503.20, subpart D.
Reconsideration Determination.
On reconsideration, you state, “My two aides (SP1, SP2 and SPS5) are summer staff, working only 3-4 weeks in the summer.” You also cite budgetary constraints and an inability to pay for CPR training, “the school has limited funds and cannot afford the $ 90-120 per employee. We need funding to cover the costs.” Through your own admission, SP1, SP2 and SP5 did not complete the required CPR training. You did not address whether SP1, SP2 and SP5 completed the required first aid training. Furthermore, there was no documentation that SP1, SP2 and SP5 individuals had satisfactorily completed the required first aid pediatric training. Therefore, Mes Amis did not comply with the required first aid training. The record supports Citation 2, and it is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 and 2 are affirmed. Citation 3 is final and not subject to review. This is a final agency decision.
