Terms of Settlement Agreement:
1) Upon final execution of the Settlement Agreement, DHS agrees not to impose the Order to Pay a Fine, dated February 11, 2025, on License Holder’s family child care license. DHS agrees to stay the entire fine amount of $400.00 for a period of one (1) year from the date of the administrative law judge’s order accepting this Agreement. The stayed fine will be immediately reinstated if DHS determines that License Holder has failed to comply with licensing requirements or any existing conditions on license, or issues any additional orders to License Holder resulting in a fine, conditional license, or other licensing sanctions during the period of the stay. The parties to this Agreement agree that the scope of any hearing regarding the reinstated fine will be limited solely to the issue of whether the terms of this Agreement were violated.
2) Upon final execution of this Agreement, License Holder agrees that the Order of Conditional License, dated February 11, 2025, and its terms will be imposed upon her family child care license with the following modifications:
a. The duration of License Holder’s conditional license shall be one (1) year from the date of the issuance of the original conditional license order.
b. License Holder will work with Hennepin County to obtain a mentor to work with her on following all family child care rules and laws. The mentor must be obtained within 30 days of the final execution of the Settlement Agreement. Upon completion of working with the mentor License Holder must submit to Hennepin County daycare licensing unit what she learned and changes she will implement into the program to ensure compliance with requirements.
c. License Holder will complete six additional hours of training within 90 days of the final execution of the Settlement Agreement. The training is in addition to the annual training requirements as listed in Minnesota Statutes, section 245A.50. The training must include the topic of professionalism, and/or record keeping. License Holder must obtain approval from Hennepin County that the training is appropriate, and License Holder must submit documentation of attendance to Hennepin County.
d. License Holder must provide a copy of the Order of Conditional License to parents of children in the care or document that all parents have been given an opportunity to review the order. License Holder must obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the order or had an opportunity to review the order and submit the documentation to Hennepin County within 15 days of administrative law judge’s order accepting the Settlement Agreement. For new families, License Holder must submit documentation of compliance with this term to Hennepin County within five (5) days of any child’s admission to the program.
All other terms of the Order of Conditional License not modified herein will remain in effect.
