Dear Angela Carlson:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 2 in the Correction Order dated January 28, 2025. You did not request reconsideration of Citation 1. Citation 1 is not subject to review. Therefore, Citation 1 is final.
SUMMARY OF CITATIONS AND RECONSIDERATION DETERMINATION:
Citation 2
Violation. The required in-service training had not been completed for 1 of 5 (SP5) individuals (director, staff persons, substitutes, or unsupervised volunteers) for the previous concluded calendar year. In-service training did not include the required number of in-service training hours for the previous concluded calendar year (SP5).
Request for Reconsideration.
You contend, “The in-service records for all staff were given to the DHS licensor upon request at the time of the annual visit (combination of paper records and records on the Provider Hub). But when the DHS licensor requested the specific in-service records for SP5 for review that the program was “not unable to find any additional recorded training hours” for SP5. You also contend that you found SP5’s in-service records after the licensing review ended. “The program then immediately emailed the DHS licensor, attached the in-service record and questioned why the documentation provided at the time of the visit was not (sic)”[.]
Applicable Law.
A license holder must ensure that the center director, staff persons, substitutes, and unsupervised volunteers complete in-service training each calendar year. All training must be documented and maintained on site in each personnel record. Minnesota Statute, section 245A.40, subdivisions 7 and 10.
Reconsideration Determination.
Your request for reconsideration indicates that SP5’s in-service training records were provided to the DHS licensor during the licensing review. However, the program was not able to locate and provide SP5’s in-service records upon request DHS licensor’s request. If SP5’s in-service training records were in their respective personnel file, then the requested documents would have been available to the DHS licensor. Although, the Commissioner appreciates the Program confirming SP5’s in-service records after the licensing review, SP5’s in-service training records were not available during the review. The record supports Citation 2, and it is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is final and not subject to review. Citation 2 is affirmed. This is a final agency decision.
