Dear Mulki Noor:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding citations 1 and 2 in the Correction Order issued to you on June 10, 2025. After an independent review of the record, the Commissioner has determined there is sufficient evidence to support the citations. You did not challenge the remaining citations, and those citations are final and not within the scope of this review.
Reconsideration Determination
Citation 1
The citation was issued because, for two of three participants whose records were reviewed (P2 and P3), the the license holder did not meet the requirements for an individual abuse prevention plan (IAPP). Specifically, the license holder did not review the IAPPs for P2 and P3 with their interdisciplinary teams and document the review at least annually.
Applicable Law
Under Minnesota Statutes, section 245A.65, subdivision 2, paragraph (b), an individual abuse plan shall meet specified requirements, including that the interdisciplinary review shall document the review of all abuse prevention plans at least annually, using the individual assessment and any reports of abuse relating to the person. Your Response
You submitted a letter in which you indicated the licensor did not mention the violation during the licensing visit as with a past licensing visit. You indicated the program reviews the IAPP documents four times per year for P2 and P3. You also indicated the citation was not a repeat violation.
Reconsideration Determination
You did not provide documentation that identified the annual review of IAPPs for P2 and P3 with the interdisciplinary team as required. Reviews were marked as quarterly, and no documentation was provided to show participation by members of the interdisciplinary team (primary caregivers, family members, care coordinators, or county case managers) on at least an annual basis. Also, although you indicated you do not believe the citation was a repeat citation, you acknowledged in your reconsideration request that you had been previously cited for the violation, and records show you were found in violation of the same statute in the correction order dated October 6, 2022. There is sufficient evidence to support citation 1, and it is affirmed.
Citation 2
The citation was issued because, for two participants whose records were reviewed (P2 and P3), the license holder did not maintain a written record as required. Specifically, the license holder failed to include an application form in P2 and P3’s participant records that included the name and phone number of the person to call in case of an emergency involving P2 and P3 and the name and phone number of another person to call if that person cannot be reached.
Applicable Law
Under Minnesota Rules, part 9555.9660, subpart 1, a center shall develop and maintain a written record for each participant, and each participant’s written record shall include the name and telephone number of the person to call in care of an emergency involving the participant and the name and number of another person to call if that person cannot be reached. Your Response
You submitted a letter in which you acknowledged that second emergency contact persons for P2 and P3 were not listed, and you indicated P2 and P2 did not have secondary contact persons. You indicated the program has now the information.
Reconsideration Determination
You acknowledged in your reconsideration request that, for P2 and P3, you did not have the name and phone number of another person to call if the emergency person cannot be reached as required by the rule. Also, although you indicated you do not believe the citation was a repeat citation, records show you were previously cited for a violation of the same rule and subpart in the correction order dated October 6, 2022. There is sufficient evidence to support citation 2, and it is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. The record supports the citations, and they are affirmed. This is a final agency decision. The Commissioner appreciates your response and encourages you to continue to work cooperatively with your DHS licensor regarding questions about corrective action ordered in the correction order.
