ORDER RESCINDING REVOCATION

Dear Priscilla Scheffler-Keller:

On January 22, 2025, the Commissioner of Human Services1 issued an Order of Revocation of your family child care program, license number 1099031. Per the requirements of Minnesota Statutes, section 245A.07, subdivision 3(a)(2), and section 245A.04, subdivision 7(h),2 the revocation was based on the disqualification of a household member in your program, which had not been set aside or granted a variance.

You timely appealed the revocation order. While the appeal was pending, you were notified via a letter dated July 3, 2025, that the Background Studies Division of DHS has rescinded the household member’s disqualification, and that his/her background study status is now the same as any person who was not disqualified. You also received a background study clearance letter from DHS regarding this household member.

Based on these intervening events, DCYF hereby rescinds the Order of Revocation dated January 22, 2025. This Order Rescinding Revocation supersedes the Order of Revocation dated January 22, 2025. While your family child care license has been under revoked status, the minimum standards required for your licensure (e.g., trainings, inspections, background studies) may have lapsed and need updating. If this situation applies to your program, your license will be returned to “in good standing” once you have demonstrated that you meet the minimum licensing standards required under applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445.

11 On June 18, 2025, licensing functions for child care centers, family child care programs, and child foster care programs, and maltreatment investigations involving child care centers, have been transferred from Minnesota Department of Human Services, Office of Inspector General (DHS), to the new Minnesota Department of Children, Youth, and Families (DCYF), as directed by state law.  While this matter began under DHS, pursuant to Minnesota Statutes, section 15.039, subdivision 2, DCYF is now the responsible agency.
