Dear Jody Miller:
CORRECTION ORDER
An investigation of McGrath, Renee Lynn Adult Foster Care was completed regarding report number 202409806 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned financial exploitation. The disposition of the investigation report is maltreatment determined. One violation was noted.
VIOLATIONS AND CORRECTION ORDERS
The following violation of state and (or) federal laws and rules was observed. Corrective action for the violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violation within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
Citation: Minnesota Statutes, section 245D.07, subdivision 1a, paragraph (a).
Violation: For one person served (P) whose records were reviewed, the license holder did not provide services in response to the person’s identified needs, interests, and preferences as required.
The license holder maintained a document in P’s record titled, “Support Plan Authorization,” developed on April 9, 2024. The authorization documented that the license holder did not have permission to access the account information regarding the P’s checking account. The license holder did not have permission to be an authorized signer (not owner) on the P’s checking account. A review of the P’s bank statements from March 2021 through October 2024 showed SP1 listed on the P’s bank statement in addition to the P’s name.
The license holder maintained an Individual Abuse Prevention Plan in P’s record, dated April 9, 2024. The P was assessed as being unable to handle financial matters. The license holder documented that SP1 was trained to support the P in managing the P’s funds.
The license holder failed to provide services in a manner that supported the P’s identified preferences, needs, and interests.
Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this item.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
