CORRECTION ORDER

Dear Kadir Abdulle:

On July 1, 2025, a licensing review of Diamond Home Healthcare, located at 5701 Shingle Creek Parkway, Brooklyn Park, Minnesota was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245A.65, subdivision 1.

Violation: For two of two persons whose records were reviewed (P1 and P2), the license holder did not provide orientation to the license holder’s internal and external reporting procedures of alleged or suspected maltreatment as required.

The license holder did not provide P1 and P2 with orientation to the license holder’s internal and external reporting procedures of alleged or suspected maltreatment of vulnerable adults within 24 hours of admission. P1’s admission date was September 26, 2024, and this orientation occurred on October 8, 2024. P2’s admission date was May 1, 2023, and this orientation occurred on September 28, 2023.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Statutes, section 245A.65, subdivision 2.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not develop and review an individual abuse prevention plan as required.

245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.

a. The license holder did not develop an individual abuse prevention plan for P1 prior to or upon service initiation. The license holder initiated services with P1 on September 26, 2024. The license holder developed the individual abuse prevention plan on October 8, 2024.

b. The license holder did not develop an individual abuse prevention plan for P2 prior to or upon service initiation. The license holder initiated services with P2 on May 1, 2023. The license holder developed the individual abuse prevention plan on September 28, 2023. The license holder also did not review P2’s individual abuse prevention plan with P2’s interdisciplinary team annually. P2’s IAPP was last reviewed with the interdisciplinary team on September 28, 2023.

In addition, P2 received night supervision and individual homes supports with training from the license holder. The license holder did not develop an individual abuse prevention plan for P2 for each licensed service provided by the license holder.

Corrective Action Ordered: Within 30 days of receiving of this order, you must:

· develop an individual abuse prevention plan for each licensed service P2 receives from you;

· you must review the updated individual abuse prevention plan with P2’s interdisciplinary team; and

· review the updated IAPP with all staff that work with P2. The review of the updated plan must be documented in the personnel record, including the date the training was provided, the number of hours per subject area, and the name of the trainer or instructor as required.

On an ongoing basis, you must maintain compliance as required in this subdivision.

3. Citation: Minnesota Statutes, section 245D.04, subdivision 1.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not provide service recipient rights as required.

a. The license holder did not provide P1 with a written notice that identified the service recipient rights and an explanation of those rights within five working days of service initiation. The license holder initiated services with P1 on September 26, 2024 and the rights were provided to P1 on October 8, 2024.

b. The license holder did not provide P2 with a written notice that identified the service recipient rights and an explanation of those rights within five working days of service initiation and annually thereafter. P2’s service initiation date was May 1, 2023, and these rights were provided September 28, 2023. These rights were not provided to P2 annually in 2024. At the time of the review, this had not been completed.

Corrective Action Ordered: Within 30 days of receiving of this order, you must provide P2 with a written notice that identifies the service recipient rights and an explanation of those rights as listed in 245D.04, subdivision 2 and 3. On an ongoing basis, you must maintain compliance as required in this subdivision.

4. Citation: Minnesota Statutes, section 245D.05, subdivision 1.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not document how health needs would be met as required.

a. The license holder did not document how health service needs would be met for P1, including a description of the procedures the license holder would follow in order to provide medication assistance and assist with or coordinate medical, dental, and other health service appointments. P1’s support plan addendum indicated staff would support P1 with medication assistance and maintain a regular schedule for medical checkups. The license holder did not document the procedures staff would follows to provide this assistance.

b. The license holder did not document how health services would be met for P2, including a description of the procedures the license holder would follow in order to provide medication assistance. P2’s support plan addendum documented P2 was inconsistent with taking medications as prescribed and may need reminders. The license holder did not document the procedures staff would follow to provide this assistance.

Corrective Action Ordered: Within 30 days of receiving of this order, you must document the procedures staff will follow to provide P1 and P2 with medication assistance. You must train all staff that provide services to P1 and P2 on these procedures and documentation of this training must be maintained in the personnel record as required. On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota Statutes, section 245D.07, subdivision 1.

Violation: For one person whose record was reviewed (P2), the license holder did not provide services in response to the person’s identified needs, interests, and preferences for each service as required.

The license holder provided multiple services to P2. The license holder did not ensure that P2’s support plan addendum identified how services were provided for each licensed service, including how, when, and by whom.

Corrective Action Ordered: Within 30 days of receiving of this order, you must review and update P2’s support plan to include the information listed above. On an ongoing basis, you must maintain compliance as required in this subdivision.

6. Citation: Minnesota Statutes, section 245D.07, subdivision 1a.

Violation: For one person whose record was reviewed (P2), the license holder did not initiate services for a basic service as required.

a. The license holder did not complete a preliminary support plan addendum for P2 within 15 calendar days of service initiation. The license holder initiated services with P2 on May 1, 2023. The preliminary support plan addendum was completed in September 2023.

b. The license holder did not review and revise as needed P2’s preliminary support plan addendum to document the services that will be provided including how, when, and by whom services will be provided, and the person responsible for overseeing the delivery and coordination of services.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

7. Citation: Minnesota Statutes, section 245D.095, subdivision 3.

Violation: For one person whose record was reviewed (P1), the license holder did not maintain a service recipient record as required.

The license holder did not maintain progress or daily log notes for services provided to P1.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

8. Citation: Minnesota Statutes, section 245D.10, subdivision 4.

Violation: For one person whose record was reviewed (P2), the license holder did not provide policies and procedures as required.

The license holder did not inform and provide copies of the policies and procedures affecting P1’s and P2’s rights to P1, P2, P1’s case manager, and P2’s case manager, within five working days of service initiation. The license holder initiated services with P1 on September 26, 2024. P1 and P1’s case manager received these policies and procedures on October 8, 2024. The license holder initiated services with P2 on May 1, 2023. P2 and P2’s case manager received these policies and procedures on September 28, 2023.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

9. Citation: Minnesota Rules, Part 9544.0030, subpart 1.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not review positive support strategies as required.

The license holder did not evaluate P1’s and P2’s positive support strategies every six months with P1 and P2.

Corrective Action Ordered: Within 30 days of receiving of this order, you must:

· evaluate P1’s and P2’s positive support strategies with P1 and P2;

· based upon the results of the evaluation, you must determine whether changes are needed in the positive support strategies used, and if so, make the appropriate changes; and

· review the changes with all staff working with P1 and P2.

On an ongoing basis, you must maintain compliance as required in this subdivision.

10. Citation: Minnesota Rules, Part 9544.0080, subpart 1.

Violation: For one person whose record was reviewed (P1), the license holder did not provide notice of the policy about the emergency use of manual restraint as required.

The license holder did not provide notice to P1 at the time of service initiation on the emergency use of manual restraint policy. The license holder initiated services with P1 on September 26, 2024 and provided the policy on October 8, 2024. Additionally, the license holder did not obtain a written acknowledgement from P1 that P1 received the emergency use of manual restraint policy.

Corrective Action Ordered: Within 30 days of receiving of this order, you must provide P1 with the emergency use of manual restraints policy and obtain written acknowledgement from P1 that the policy was received. On an ongoing basis, you must maintain compliance as required in this subdivision.

11. Citation: Minnesota Statutes, section 245D.09, subdivision 4.

Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide orientation training as required.

The license holder hired SP2 on June 12, 2022. The license holder did not provide SP2 with orientation training in the following areas within 60 days of hire:

· the job description and how to complete specific job functions including:

o responding to and reporting incidents as required under Minnesota Statutes, section 245D.06, subdivision 1; and

o following safety practices established by the license holder and as required in section 245D.06, subdivision 2;

· the license holder’s current policies and procedures required under Minnesota Statutes, chapter 245D, including their location, access, and staff responsibilities related to implementation of those policies and procedures;

· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices. This training was provided in June 2024;

· the service recipient rights, and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04. This training was provided in June 2024;

· sections 245A.65 and 626.557 governing maltreatment reporting and service planning for vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment. This training was provided in June 2024;

· principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;

· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint;

· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe; and

· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities. This training was provided in June 2024.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP2 with the following trainings:

· the job description and how to complete specific job functions including:

o responding to and reporting incidents as required under Minnesota Statutes, section 245D.06, subdivision 1; and

o following safety practices established by the license holder and as required in section 245D.06, subdivision 2;

· the license holder’s current policies and procedures required under Minnesota Statutes, chapter 245D, including their location, access, and staff responsibilities related to implementation of those policies and procedures;

· principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;

· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint; and

· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe.

Documentation of these trainings being provided to SP2 must be maintained in the personnel record, including the date the training is completed, the number of hours per subject area, and the name of the trainer or instructor as required. On an ongoing basis, you must maintain compliance as required in this subdivision.

12. Citation: Minnesota Statutes, section 245D.09, subdivision 5.

Violation: For two staff persons whose records were reviewed (SP2 and SP3), the license holder did not provide annual training as required.

a. The license holder did not provide the following trainings annually to SP2 in 2025:

· service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in Minnesota Statutes, section 245D.04. This training was last provided in June 2024;

· sections 245A.65 and 626.557 governing maltreatment reporting and service planning for vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment. This training was last provided in June 2024; and

· strategies to minimize the risk of sexual violence. This training was last provided in June 2024.

b. The license holder did not provide SP2 and SP3 with the following trainings annually:

· data privacy requirements according to Minnesota Statutes, sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPPA), and staff responsibilities related to complying with data privacy practices; the last date this training was provided to SP2 was in June 2024 and the late date this training was provided to SP3 was in April 2023; and

· basic first aid. The last date this training was provided to SP2 was in June 2024. SP3 received this training in April 2023, and SP3 did not receive this training again until June 2025.

Corrective Action Ordered: Within 30 days of receiving of this order, you must:

· provide SP2 with the trainings outlined above;

· provide SP3 with training on data privacy requirements as listed above;

· conduct an audit of all staff training records to ensure that all staff have received orientation or annual training as required;

· for any staff identified in the audit, you must provide the missing orientation or annual training;

· maintain documentation of all training completed in the personnel record including the date the training is completed, the number of hours per subject area, and the name of the trainer of instructor as required; and

· maintain a copy of the results of the audit and corrective action in the program files for DHS licensors to review.

On an ongoing basis, you must maintain compliance as required in this subdivision.

13. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.

Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide orientation to individual service recipient needs as required.

The license holder did not ensure SP2 received and reviewed instruction on an individual service recipients support plan or support plan addendum as it related to the responsibilities assigned to the license holder and the individual abuse prevention plan to achieve and demonstrate an understanding of the person as a unique individual and how to implement those plans.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP2 with the above instruction on individual service recipient needs. Documentation of this instruction including the date it is provided, the number of hours per subject area, and the name of the instructor or trainer must be maintained in the personnel record as required. On an ongoing basis, you must maintain compliance as required in this subdivision.

14. Citation: Minnesota Statutes, section 245D.095, subdivision 5.

Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide maintain a personnel record as required.

The license holder did not maintain a personnel record for SP2 that included the date of SP2’s first supervised direct contact with a person served by the program and SP2’s first unsupervised direct contact with a person served by the program.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
