ORDER OF CONDITIONAL LICENSE
Dear Victor Makori: The Department of Human Services (DHS) is placing your license to provide Home and Community-Based Services at Loving Caring Home Care LLC, on conditional status for two years, beginning August 29, 2025. This means you must meet certain conditions to maintain your license, detailed below. This order applies to all services licensed under Chapter 245D and the service sites detailed in the “Applicability of Conditional License” section below. This is based on your noncompliance with Home and Community-Based Services licensing requirements. Details of our findings are also provided below. Our next steps and your options are also detailed. REASON FOR THE CONDITIONAL LICENSE
Licensing Violations Determined On April 7, 2025
DHS determined that your program did not follow licensing rules and statutes, as described below. Program Coordination, Evaluation, and Oversight Violation
1. Violation: The license holder did not ensure the designated coordinator and the designated manager (SP1) provided program management and oversight of the services provided by the license holder as required.
a. The license holder designated SP1 as the designated coordinator. See citations 2 through 21 regarding the license holder’s failure to ensure SP1 met the following responsibilities: · provide oversight of the license holder’s responsibilities assigned in the person’s support plan and support plan addendum; · take the action necessary to facilitate the accomplishment of the outcomes according to the requirements in section 245D.07; · provide instruction and assistance to direct support staff implementing the support plan and the service outcomes, including direct observation of service delivery sufficient to assess staff competency; and · evaluate the effectiveness of service delivery, methodologies, and progress on the person’s outcomes based on the measurable and observable criteria for identifying when the desired outcomes have been achieved according to the requirements in section 245D.07.
b. The license holder designated SP1 as the designated manager. See citations 2 through 21 regarding the license holder’s failure to ensure SP1 met the following responsibilities: · maintain current understanding of the licensing requirements sufficient to ensure compliance throughout the program as identified in section 245A.04, subdivision 1, paragraph (e), and when applicable, as identified in section 256B.04, subdivision 21, paragraph (b); · ensure the duties of the designated coordinator are fulfilled according to the requirements in subdivision 2; · ensuring staff competency requirements are met according to the requirements in section 245D.09, subdivision 3, including ensuring periodic performance evaluations of the direct support staff’s ability to perform the job functions based on direct observation are completed by the license holder; · ensuring corrective action was taken when ordered by the commissioner; and · evaluate the information identified in clauses (1) to (6) to develop, document, and implement ongoing program improvements.
Statute Violated: Minnesota Statutes, section 245D.081, subdivisions 2 and 3. Service Recipient Violations 2. Violation: For two of three persons whose records were reviewed (P1 and P2), the license holder did not meet the requirements for an individual abuse prevention plan (IAPP).
245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
The license holder did not review P1 and P2’s IAPP with their interdisciplinary team at least annually in 2022, 2023 and 2024.
Statute Violated: Minnesota Statutes, section 245A.65, subdivision 2.
3. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not provide the person with a written notice that identified the service recipient rights as required.
The license holder did not provide P1 and P2 with a written notice that identified the service recipient rights annually in 2022, 2023 and 2024.
Statute Violated: Minnesota Statutes, section 245D.04, subdivision 1.
4. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not provide services in compliance with the federal waiver plans as required.
The license holder did not request lead agency approval and oversight of all monitoring technology usage where program services were provided. The licensor holder told DHS licensors that camera technology was used on the exterior of the facility to monitor persons served by the program when they were outside and a baby monitor was used to monitor P1 for falls.
Statute Violated: Minnesota Statutes, section 245D.07, subdivision 1.
5. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not provide person-centered planning as required.
The license holder did not provide services in response to P1 and P2’s identified needs, interests, preferences, and desired outcomes as specified in the support plan and the support plan addendum, and in compliance with the requirements of this chapter. The license holder failed to provide services to P1 and P2 in a manner that supported P1 and P2’s preferences, daily needs, and activities and accomplishments of P1 and P2’s personal goals and service outcomes, consistent with the principles of: · person-centered service planning and delivery that: o identified and supported what was important to the person as well as what was important for the person, including preferences for when, how and by whom direct support service would be provided; and o respected each person’s history, dignity, and cultural background; · self-determination that supported and provided: o opportunities for the development and exercise of functional and age-appropriate skills, decision making and choice, personal advocacy, and communication; and o the affirmation and protection of each person’s civil and legal rights; and · providing the most integrated setting and inclusive service delivery that supported, promoted, and allowed: o inclusion and participation in the person’s community as desired by the person in a manner that enabled the person to interact with nondisabled persons to the fullest extent possible and supported the person in developing and maintaining a role as a valued community member; o opportunities for self-sufficiency as well as developing and maintaining social relationships and natural supports; and o a balance between risk and opportunity, meaning the least restrictive supports or interventions necessary were provided in the most integrated settings in the most inclusive manner possible to support the person to engage in activities of the person’s own choosing that may otherwise present a risk to the person’s health, safety, or rights.
Statute Violated: Minnesota Statutes, section 245D.07, subdivision 1a.
6. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not complete the assessment for intensive support service as required.
The license holder did not complete the following assessments for P1 and P2 annually in 2022, 2023 and 2024 · P1 and P2’s ability to self-manage health and medical needs to maintain or improve physical, mental and emotional well-being, including, when applicable, allergies, seizures, choking, special dietary needs, chronic medical conditions, self-administration of medication or treatment orders, preventative screening, and medical and dental appointments; · P1 and P2's ability to self-manage personal safety to avoid injury or accident in the service setting, including, when applicable, risk of falling, mobility, regulating water temperature, community survival skills, water safety skills, and sensory disabilities; and · P1 and P2's ability to self-manage symptoms or behavior that may otherwise result in an incident as defined in section 245D.02, subdivision 11, clauses (4) to (7), suspension or termination of services by the license holder, or other symptoms or behaviors that may jeopardize the health and welfare of the person or others.
Statute Violated: Minnesota Statutes, section 245D.071, subdivision 3, paragraph (b).
7. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not document service outcomes and supports as required.
The license holder did not develop a service plan, for P1 and P2, that documents the service outcomes and supports based on the assessments completed under subdivision 3 and the requirements in section 245D.07, subdivision 1a. Additionally, the license holder failed to document, for P1 and P2, the following supports and methods to be implemented to support P1 and P2 and accomplish outcomes related to acquiring retaining, or improving skills and physical, mental, and emotional health and well-being: · the methods or actions that will be used to support P1 and P2 and to accomplish the service outcomes, including information about: o any changes or modifications to the physical and social environments necessary when the service supports are provided; o any equipment and materials required; and o techniques that are consistent with P1 and P2’s communication mode and learning style; · the measurable and observable criteria for identifying when the desired outcome has been achieved; · how data would be collected; · the projected starting date for implementing the supports and methods and the date by which progress towards accomplishing the outcomes will be reviewed and evaluated; and · the names of the staff or position responsible for implementing the supports and methods.
Statute Violated: Minnesota Statutes, section 245D.071, subdivision 4, paragraphs (a) and (b).
Repeat Violation: In a Correction Order that DHS issued on May 17, 2021, you were previously found in violation of this same statute. 8. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not complete service planning and review as required.
The license holder did not meet with P1 and P1’s case manager, P2 and P2’s case manager, and other people as identified by P1 and P2 to participate in service plan review meetings, at least once per year in 2022, 2023 and 2024, to determine whether changes were needed to the service plan based on: · the assessment information; · the license holder's evaluation of progress toward accomplishing outcomes; or · other information provided by the support team or expanded support team.
Additionally, the license holder did not meet with P1 and P1’s case manager, P2 and P2’s case manager and other people as identified by the person to do the following: · discuss how technology might be used to meet the person’s desired outcomes. The support plan addendum must include a summary of this discussion. The summary must include:
o a statement regarding any decision made related to the use of technology; and
o a description of any further research that must be completed before a decision regarding the use of technology can be made.
· discuss options for transitioning out of a community setting controlled by a provider and into a setting not controlled by a provider; and
· discuss options for transition to an employment service described in section 245D.03, subdivision 1, paragraph (c), clauses (5) to (7).
Statute Violated: Minnesota Statutes, section 245D.071, subdivision 5.
9. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not evaluate positive supports strategies as required.
The license holder did not incorporate in writing to P1 and P2’s support plan addendum positive support strategies that emphasized teaching productive and self-determined skills or alternative strategies and behaviors without the use of restrictive interventions, including: · assessing P1 and P2’s strengths, needs, and preferences to identify and create a positive support strategy; and · selecting positive support strategies that: o are evidence-based; o are person-centered; o are ethical; o integrate the person in the community; o are the least restrictive to the person; and o are effective.
Rule Violated: Minnesota Rules, 9544.0030, subpart 1.
10. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not maintain records as required.
The license holder did not maintain progress or daily log notes recorded by the program in P1 and P2’s records
Statute Violated: Minnesota Statutes, section 245D.095, subdivision 3, paragraph (b). Health Service Needs Violations
11. Violation: For two persons whose records where reviewed (P1 and P2), the license holder did not maintain documentation on how health needs would be met as required.
The license holder did not maintain documentation on how P1 and P2’s health needs would be met, including a description of the procedures the license holder would follow in order to: · provide medication set-up and administration according to this chapter; and
· assist with or coordinate medical, dental, and other health service appointments.
Statute Violated: Minnesota Statutes, section 245D.05, subdivision 1, paragraph (b). 12. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not meet the requirements for medication setup as required.
The license holder provided medication setup for P1 and P2. The license older did not document the dates of setup for P1 and P2. Statute Violated: Minnesota Statutes, section 245D.05, subdivision 1a, paragraph (b). 13. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not ensure the person served took medications as prescribed when assigned responsibility of medication administration.
P1’s was prescribed several medication to be taken in the AM. P1’s MAR documented that these medications had been administered for April 7, 2025, however the medication were still in P1’s medication setup device. Additionally, DHS licensors found P1 and P2 had medication bubble packs from previous months with medications still in them. The prescription had not changed over this period and the license holder was unable to explain why these extra medications were present. The license holder did not administer medications as prescribed. Statute Violated: Minnesota Statues, section 245D.05, subdivision 2, paragraph (b). 14. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not implement medication administration procedures as required.
a. P1 was prescribed Metformin tab 500mg ER with direction to take 1 tablet by mouth twice daily (evening with a meal and bedtime); however, the license holder hand wrote that it was to be administered in the AM into P1’s medication administration record (MAR). The license holder stated that they were told to change this order by P1’s doctor over the phone months prior, however this was not reflected on the current prescription label. The license holder did not implement medication administration procedures.
b. The license holder did not document in P1 and P2’s MAR instruction on when and to whom to report the following:
· if a dose of medication is not administered or treatment is not performed as prescribed, whether by error by the staff or the person or by refusal by the person; and
· the occurrence of possible adverse reactions to the medication or treatment.
Statute Violated: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (c). 15. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not ensure MARs were reviewed as required.
The license holder did not review P1 and P2’s MARs at a minimum of every three months. At the time of the license review no review of the P1 and P2’s MARs had been completed. Statute Violated: Minnesota Statutes, section 245D.05, subdivision 4, paragraph (a). 16. Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not develop, implement, and maintain documentation of psychotropic medications as required.
The license holder assigned the responsibility for medication administration for P1 and P2. P1 and P2 were prescribed psychotropic medications. The license holder did not maintain a description of the target symptoms that each psychotropic medication was to alleviate. Statute Violated: Minnesota Statutes, section 245D.051 Staffing Standards Violations
17. Violation: For three of three staff persons whose records were reviewed (SP1-SP3), the license holder did not provide annual training as required.
The license holder did not provide SP1, SP2 and SP3 the following training annually in 2022, 2023, and 2024: · data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices;
· the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04;
· sections 245A.65, 245A.66, and 626.557 and chapter 260E governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment. This orientation must be provided within 72 hours of first providing direct contact services and annually thereafter according to section 245A.65, subdivision 3;
· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support services provided by the staff person;
· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint;
· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe;
· basic first aid; and
· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
Statute Violated: Minnesota Statutes, 245D.09, subdivision 5.
18. Violation: For three staff persons whose records were reviewed (SP1-SP3), the license holder did not maintain a personnel record as required.
The license holder did not maintain personnel records for SP1, SP2 and SP3 to document and verify staff qualifications, orientation, and training. Statute Violated: Minnesota statutes, section 245D.095, subdivision 5, paragraph (a). Protection Standard Violation
19. Violation: For one person whose record was reviewed (P3), the license holder did not ensure exercise and protection of the service recipient rights as required.
P3 utilized a wheelchair for mobility and their room was in the lower level of the residence. There was no method within the residence for P3 to access the main level of the residence. The license holder did not exercise P3’s right to have free access to common areas in the residence. Statute Violated: Minnesota Statutes, section 245D.04, subdivision 3, paragraph (b), clause (3). Policy and Procedures Violation
20. Violation: The license holder did not maintain policies and procedures related to grievances as required.
The license holder did not maintain policies and procedures related to grievances. The license holder established a policy titled “Grievance policy and Complaint Policy,” which identifies P2 as the highest level of authority, however this was inconsistent with information provided to DHS licensors. Statute Violated: Minnesota Statutes, section 245D.04, subdivision 3, paragraph (b), clause (3). 21. Violation: The license holder did not maintain policies and procedures related to service termination as required.
The license holder did not maintain policies and procedures for service termination that included the requirements specified in paragraphs (b) to (f). The license holder maintained a document titled “SERVICE PLAN & Termination Policy,” however it identified requirements for Minnesota Statute 144A.4791, subdivision 9. Statute Violated: Minnesota Statutes, section 245D.04, subdivision 3, paragraph (b), clause (3). Immediate corrective action required
You must immediately correct the violations cited above. Compliance with this order will be reviewed onsite ongoing. If you fail to demonstrate substantial compliance with home and community-based services requirements or with the terms of your conditional license that are provided below, DHS may take an additional licensing action, including revocation, against your license. Applicability of Conditional License This Order of Conditional License applies to all of your service sites operated under this 245D license because the 21 violations (1 repeat violations) show you lack competent knowledge of the laws required to operate an HCBS program. Since the violations involved your lack of competence to hire and train competent Designated Coordinators and Designated Managers; they involved staff who could provide services at any service site; persons served at multiple service sites; and they were serious in nature, this conditional order applies to all your 245D service sites. Service site is defined in 245D.02, subdivision 32. Legal Authority: Minnesota Statutes, section 245A.06, subdivision 1a, paragraph (a).
Nature, chronicity, or severity of violations and effective of violations(s) on health, safety, or rights of persons served by the program The Commissioner considered the nature, chronicity, or severity of the violations of law or rule and the effect of the violations on the health, safety or rights of persons served by the program. Based on this analysis, your license will be placed on a conditional status.
· Nature: The license holder was issued a correction order on May 17, 2021 that cited 6 violations. Despite the corrective action that was order in correction order, the license holder continued to demonstrate noncompliance and a failure to provide program coordination, evaluation, and oversight of services at the time of the licensing review on April 7, 2025.
· Chronicity: Your program received its license on August 31, 2018. During the application process you affirmed that you understood licensing rules and laws. DHS provided you direction and resources regarding these rules and laws, including the importance of compliance. Since August 31, 2018, your program has demonstrated a history of noncompliance with licensing rules and statutes. The information below summarizes this history:
o August 29, 2025 Conditional License (this order): 21 violations (1 repeat)
o May 17, 2021 Correction Order: 6 citations
· Severity: May of the violations involve your inability to properly document, implement, and review medication administration responsibilities, which could affect the health and safety of the service recipients. You did not document an individualized description of the procedures to provide medication administration; did not document reporting procedures; did not obtain physicians orders for medication changes; or conduct medication reviews to identify and correct medication errors. The inability to ensure service recipients receive the necessary health services and medications could have resulted in significant health implications from those who are dependent on the competent assistance of the license holder.
The license holder did not provide orientation and annual training to direct support staff persons, including training on maltreatment reporting requirements. When direct support staff are not provided with orientation and annual training, staff may not be competent to provide services to persons and there is an increased risk of neglect or abuse to persons served by the program. Training staff is a critical part of ensuring persons served are kept safe and to ensure their rights are protected. The inability to provide staff training directly relates to health, safety, and well-being of persons served by the program.
The license holder did not meet the responsibilities related to individual abuse prevention plans by not reviewing the existing plans as required annually with persons served and their support teams. This could negatively impact the health and safety of persons served, as their identified vulnerabilities change, the review of the individual abuse prevention plan provides staff with knowledge of potential risks and the proactive strategies the staff will utilize to reduce these risks.
You did not prepare service outcomes and supports based on assessments of the person’s needs. Because the person’s level of need required intensive support services, you were required to do more than supervise him/her but to access his/her needs and to document supports and methods to support the person in acquiring, retaining, or improving skills. You did not have any documentation showing how you would address the person’s needs which included measurable and observable criteria for identifying when the desired outcome has been achieved. You did not show you provided any services beyond basic support services when you were legally required and paid to provide intensive support services.
The designated coordinator and designated manager did not provide the coordination of service delivery and evaluation of program management and oversight which is required to ensure your program remains in compliance with licensing requirements. License holders are required to hire qualified and competent individuals for these roles to ensure licensing compliance is maintained. As a result of your inability to hire a qualified and competent designated coordinator and designated manager, you were found in violation of the 21 citations described in this order. Commissioner’s evaluation of program In determining whether a licensing action is warranted, DHS evaluated the facts, conditions, and circumstances concerning your program’s operation. This includes consideration of: · the program’s operation;
· well-being of persons served by your program;
· available evaluations of the program by persons receiving services;
· information about the qualifications of the direct support staff employed by you;
· the ability to demonstrate competent knowledge of applicable laws and rules; and
· the results of background studies.
DHS is concerned about your program’s operation, well-being of persons served by your program, qualifications of staff, your ability to demonstrate competent knowledge of applicable laws, and the results of background studies. DHS is concerned about your program’s operation because since you were licensed in 2018, DHS has issued one correction order and 21 licensing violations determined during the most recent licensing review. The number of violations demonstrates that you failed to adequately oversee your responsibilities as a license holder, to ensure compliance, and take corrective action when ordered by the Commissioner. DHS’ concerns about your program’s operation and ability to demonstrate competent knowledge were also demonstrated in your inability to train staff. This poses a risk to the well-being of persons served by your program and present a concern that staff providing services are not qualified to provide services to vulnerable adults in ways that meet each vulnerable adult’s unique needs.
You did not comply with service planning and record keeping requirements. These requirements protect the health and safety of persons served and are minimum standards for license holders. The inability to comply with these requirements impedes the Commissioner’s ability to ensure the level of care that is required by persons served is being provided as mandated by law. Record keeping and service planning requirements are essential to keeping vulnerable adults safe and ensuring persons served are receiving necessary services. Your lack of service planning and documentation posed a risk that staff would not know about the unique needs of the vulnerable people served.
DHS has determined that placing your license on conditional status is appropriate based on the violations identified and the program evaluation.
Legal Authority: Minnesota Statutes, section 245A.04, subdivision 6.
Due to the serious and chronic nature of these violations, and the conditions in the program, which impact the health and safety of persons served in your care, your license to provide home and community-based services is placed on a conditional status. CONDITIONAL LICENSE TERMS
In addition to the Home and Community Based-Services licensing rules and statutes, you are required to comply with the following terms: In addition to the Home and Community-Based Services licensing rules and statutes, you are required to comply with the following terms: 1. Within 15 days of receiving this order, you must notify current persons receiving services, all parties who refer persons to the program, and all payer sources of the conditional status of your license. The notification must be approved by DHS Licensing prior to being sent to persons receiving services and all other parties. Therefore, the draft notice must be submitted to DHS for approval within 10 days of receiving this order. The notification must specify the length of time of the conditional status of your license, the reasons your license was made conditional, and it must include either a copy of the Order of Conditional License or an offer to provide a copy of the order upon request.
While the license is on conditional status, you must notify new persons receiving services, referral sources, and payer sources that the license is on conditional status before they begin receiving services. The notification to new persons receiving services must specify the length of time of the conditional status of the license, the reasons the license was made conditional, and it must include either a copy of the Order of Conditional License or an offer to provide a copy of the order upon request.
Within 30 days of receiving this order, you must submit to the DHS Licensing Division a list of the individuals and parties that received the notice.
2. Within 30 days of receiving this order, you must:
· designate a staff person, in addition to or other than SP1 who is responsible for delivery and evaluation of services provided by the license holder;
· designate a managerial staff person, in addition to or other than SP1, to provide program management and oversight of the services provided by the license holder; and
· submit the names and qualifications for the persons who will fulfill the duties and responsibilities of your designated coordinator and designated manager for DHS review and approval. It is your responsibility to ensure that these persons meet the necessary qualifications. You must maintain documentation of your designated coordinator and designated manager’s qualifications in their personnel records and a signed job description. Changes to these positions may not be made without prior notification and approval by DHS.
The same person may perform both functions if the work and education requirements outlined in section 245D.081, subdivisions 2 and 3 are met.
3. Within 30 days of receiving this order, you must:
· Submit a written plan to DHS detailing how you will ensure the corrective action ordered in this order is completed; and
· Audit all persons served and staff records for compliance with all applicable rules and statutes.
The written plan must detail the roles and responsibilities that your designated coordinator and designated manager will have in completing corrective action and auditing all persons served records.
4. Within 60 days of receiving this order, you must:
· Complete an audit of all participant and personnel records according to your written plan. The audit must be completed by your designated coordinator and/or designated manager;
· Submit the results of the audit to your DHS licensor. The results must include the name of the staff person that audited each person served and personnel record; and
· Submit the date to your DHS licensor that all person served and personnel records will be brought into compliance based on the results of your audit. This date must be within 90 days of receiving this order.
5. During the first three months of your conditional license, no new admissions will be allowed. After this time, you must notify your licensor and receive approval prior to admitting new persons served to your program. The notification to your licensor must include the name of the person served, the name and contact information for the person’s case manager, the service(s) you will provide to the person, the person’s anticipated service initiation date for each service, and documentation of compliance with term 1 of your conditional license.
6. You may not add additional services to this license for the duration of the conditional license.
7. You may not apply for other DHS-issued licenses without prior approval from DHS for the duration of this conditional license.

· List each citation you are challenging and identify what is inaccurate or incomplete about the information in the order
· Supply information that is accurate or more complete
· State why you believe your license should not be on a conditional status
· Be made before the deadlines provided below
If you are mailing your request, it must be sent by certified mail and postmarked within 10 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Conditional license stayed pending reconsideration
If you request reconsideration within the timeframes described above, the terms of the conditional license will not take effect until a decision is issued by DHS. If the conditional license is affirmed on reconsideration, the terms would take effect on the date of the reconsideration decision, and run for two years from that date. You continue to be required to comply with all Home and Community-Based Services laws and rules. Legal authority for this licensing action
· This action is taken under Minnesota Statutes, section 245A.06, subdivision 1.
· Home and Community-Based Services are required to follow Minnesota sections 245A, 245D, and Minnesota Rules, chapter 9544.
· The timeline to request reconsideration of the order is provided in Minnesota Statutes, section 245A.06, subdivision 4.
· If a license holder files a timely reconsideration request, the terms of the conditional license are stayed pending a decision by DHS under Minnesota Statutes, section 245A.06, subdivision 4.
· Minnesota Statutes, section 245A.06, subdivision 3 states that DHS may impose additional licensing actions against a license holder that does not correct the violations cited in a conditional license order.
