Your Response

Violation 13: 6 of 6 personnel files reviewed for requirements governing the contents of a personnel file did not meet requirements. The file did not contain the following: a. Verification of the staff person’s qualifications (SP1 and SP4);

Your Response
You submitted a letter in which you indicated you believe the violation was incorrect because all required documentation was present during the licensing review. Specifically, you indicated that printed qualification documents for SP4 were available in the file and provided to the licensor during the licensing review. You also indicated that SP1’s file included a resume, job description for the Mental Health Rehabilitation Worker (MHRW) position, and documentation of completion of 30 hours of initial training, which meet the statutory requirements for the MHRW. You did not provide supporting documentation.
Reconsideration Determination

With regard to paragraph (a), you did not provide any documentation with the reconsideration request to verify qualifications for SP1 and SP4. With regard to paragraph (b), you did not provide any documentation to demonstrate verification that the job description was present in staff personnel files. There is sufficient information to support the violation, and it is affirmed.

Violation 13 is affirmed, and the violations for which you did not request reconsideration are affirmed. DHS will issue an Amended Correction Order. This is a final agency decision.
