CORRECTION ORDER

An investigation of Divine House was completed regarding report number 202504384 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned physical and emotional abuse, neglect, and financial abuse. The disposition of the investigation report is substantiated as to physical and emotional abuse, and inconclusive as to neglect and financial exploitation. Two violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1. Citation: Minnesota Statutes, section 245.07, subdivision 1a, paragraphs (a) and (b).

Violation: The license holder did not ensure that services were provided in response to a consumer’s (C’s) identified needs as specified in the C’s support plan and support plan addendum.

· The C’s Coordinated Services and Supports Plan stated that the C’s designated shopping day was Wednesday and that it was “very important” to the C that s/he was able to go shopping on that day. Information obtained showed that a staff person (P) routinely refused to take the VA shopping on his/her designated day including Wednesday, May 7, 2025.

· The C’s Individual Abuse Prevention Plan stated that staff were to be within visual or auditory range of the VA unless s/he was utilizing his/her one hour of alone time at his/her home and that the C had no unsupervised time in the community. Information showed that on May 7, 2025, the P left the C unsupervised in a locked and running car while the P went into a store.

2. Citation: Minnesota Statutes section 245D.04, subdivision 3, paragraph (a), clauses (6) and (15).

Violation: The license holder did not ensure that the consumer protection related rights included being treated with courtesy and respect and engaging in their chosen activities.

· On multiple occasions, the P refused to take the C shopping on his/her designated day and as requested by the C.

· On multiple occasions, the P called the C names including “fucking bitch,” and talking in front of the C saying s/he was a “snot,” a “brat,” and “snobby.”

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
