Dear Ms. Magee: Based on the recommendation of Ramsey County Community Human Services (Ramsey County), the Department of Children, Youth, and Families (DCYF) is placing your license to provide family child care at 5570 Wood Duck Court, Shoreview, MN on conditional status for one year beginning October 3, 2025. This means you must meet certain conditions to maintain your license, detailed below. This order is based on your level of noncompliance with family child care licensing requirements when you were previously licensed in Ramsey and Anoka Counties. Our next steps and your options are also provided below. REASON FOR THE CONDITIONAL LICENSE
1. Commissioner’s evaluation of program
In determining whether a licensing action is warranted, DCYF evaluated the facts, conditions, and circumstances concerning your program’s operation. This includes consideration of the well-being of children served in your program, available evaluations from consumers of your program, and information about the qualifications of caregivers working in your program. Specifically, because you failed to provide required supervision to a child in care that sustained several bites from another child without your knowledge. DCYF has determined that it is appropriate to place your license on conditional status based on the violations identified below and the program evaluation. Legal Authority: Minnesota Statutes, section 142B.10, subdivision 13 2. Failure to comply with licensing laws and rules
Previously, you were licensed for family child care in Ramsey County. On January 19, 2024, DHS issued you an Order of Conditional license and Order to Pay a Fine for a serious supervision violation when a child who had just turned one was bitten several times by another child without your knowledge. The conditional was issued for one year from January 19, 2024, through January 18, 2025. Subsequently, you moved from Ramsey County to Goodhue County. As a result, your family child care license in Ramsey County was closed on January 23, 2024. You submitted an application to Goodhue County to be licensed for family child care. You then notified Goodhue County that you were moving to Anoka County and on August 13, 2024, your application for Goodhue County was withdrawn. You then submitted an application to Anoka County to become licensed for family child care. You were licensed in Anoka County from November 1, 2024, until January 3, 2025, when your license was revoked. The revocation was because you provided false or misleading information and because you did not have a valid location to provide care. You appealed the revocation and entered into a settlement where your license was suspended and then closed on May 31, 2025. You have now submitted an application to Ramsey County for a family child care application. DCYF has considered the nature, chronicity, and severity of these violations, which are provided below. Previous licensing actions The following violations summarize the nature of your previous licensing violations. Because these violations are now conclusive, the individual violations are not within the scope of your appeal rights. Please refer to the previously issued correction orders for further details on these violations. If you do not have copies of these orders, contact your Ramsey County licensor for assistance. DCYF also considered this history as a factor when it determined that a Conditional License is appropriate. · January 3, 2025, Revocation of your license when you provided false or misleading information related to your application when you stated that you were the owner of the property that you were renting. You also submitted a property owner permission for fire marshal inspection and signed it as the owner. You are leasing the property and are not the owner of the property. Additionally, you do not have a valid location to provide family child care as the property you are leasing only allows for use as a private residence.
· January 19, 2024, Conditional License, which cited you for failure to provide required supervision when you were indoors cooking while children in your care were outdoors on the deck. During that time, a child who had just turned one was bitten seven times by another child without your knowledge.
· January 19, 2024, Order to Pay a Fine of $200 for failure to provide required supervision.
· October 11, 2023, Correction Order, which cited you for failure to provide required supervision when a young child in your care was bitten several times without your knowledge.
Severity of violations Due to the serious nature of these violations, and the conditions in the program, which impact the health and safety of children served in your care, your license to provide family child care is placed on a conditional status. Conditional License Terms
In addition to the licensing rules and statutes for family child care, you are required to comply with the following terms: 1. You must follow and comply with all applicable Minnesota Rules and Laws.
2. No variances to age distribution or capacity will be granted during the conditional period.
3. You must follow the detailed written supervision plan you submitted to Ramsey County. The plan must include how you will provide required supervision at all times both indoors and outdoors. The plan must also include steps you have taken or changes you have made in the program to ensure children are supervised as required and to prevent further supervision violations. You have submitted your plan to Ramsey County.
4. You must work with Ramsey County to obtain a mentor to work on ensuring you are following all family child care rules and laws with an emphasis on supervision. The mentor must be obtained within 30 days of the issuance of this order. Upon completion of working with the mentor you must submit a summary to Ramsey County of what you learned and changes you will implement into your program to ensure you are following supervision requirements.
5. You were to complete a minimum of six hours of additional training within 90 days of the order. The training is in addition to the annual training requirements as listed in Minnesota Statutes, section 142B.70. The training must be in the area of supervision. You have met this requirement.
6. You must either provide a copy of this Order of Conditional License to parents of children in care or document that all parents have been given an opportunity to review the order. You must obtain parent signatures of each currently enrolled child, indicating they have either received a copy of the order or had an opportunity to review the order and submit documentation to Ramsey County within 15 days of the issuance of this order. You must also submit documentation of each enrolled child’s name, date of birth, and the date they were enrolled in your program. For new families, you must submit documentation of compliance with this term to Ramsey County within 5 days of any child’s admission to your child care program. Your Ramsey County licensor will monitor your compliance with these terms and with all of the family child care rules and laws. This will include unannounced visits. If you fail to demonstrate substantial compliance with family child care requirements or with the terms of your conditional license that are provided above, DCYF may take an additional licensing sanction, including a revocation of your license. YOUR RIGHT TO REQUEST RECONSIDERATION
On January 19, 2024, you were issued an Order to Pay a Fine and an Order of Conditional license. After the Order was issued you moved from Ramsey County to Anoka County. Your license was closed in Ramsey County, and you applied for a family child care license in Anoka County. Because your license was on Conditional status in Ramsey County, and you closed right after the Conditional was issued and you were licensed in Anoka County however your license was revoked, then suspended and closed. As a result, your Ramsey County license is being opened on a Conditional. You did pay your fine as required and have met some of the items of the conditional that was originally issued on January 19, 2024. You must continue to comply with and fulfill the terms of the conditional under your new license. In the January 19, 2024, order, you were informed of your right to request reconsideration. You did not request reconsideration. Therefore, this Conditional Order is final, and you have no appeal rights. Prohibition against providing legally unlicensed child care
On January 19, 2024, DHS issued an Order of Conditional License and an Order to Pay a Fine to your family child care program, which disqualified you from providing legally unlicensed child care. You remain prohibited from providing legally unlicensed child care. Posting of this licensing action
You are required to place this Order of Conditional License in a place that is clearly noticeable to the people receiving services and all visitors to the facility for two years. Legal authority for this licensing action
· The requirement to post this order in a clearly visible location is required under Minnesota Statutes, section 142B.18, subdivision 6.
· Minnesota Statutes, section 142B.05, subdivision 4, provides that a child care provider who has received a Fine or Conditional Order that has not been reversed on appeal may not operate as a legally unlicensed child care provider to non-relatives.
· Operating a prohibited unlicensed family child care is a misdemeanor under Minnesota, Statutes, section 142B.05, subdivision 5.
