CORRECTION ORDER
An investigation of Diversified Lifestyles, Inc. was completed regarding report number 202506736, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive and false. Four violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules was observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes 245D.09, subdivision 4a, paragraph (c)
Violation: For one of five staff persons whose record was reviewed (S1), the license holder did not provide orientation to individual needs as required.
The license holder did not provide S1’s orientation training on C2’s and C3’s support plan or support plan addendum, individual abuse prevention plan, to achieve and demonstrate an understanding of the person as a unique individual, and how to implement those plans.
Corrective Action Ordered: Within 30 days of receipt of this order, you must provide S1 with the training listed above. On an ongoing basis, you must maintain compliance as required with this subdivision.
2. Citation: Minnesota Statutes, section 245D.07, subdivision 1a
Violation: For three clients whose record was reviewed (C1, C2, and C3), the license holder did not provide services in response to the person’s identified needs, interests, preferences, and desired outcomes as specified in the support plan and the support plan addendum as required.
There were multiple places with missing information in charting and documentation regarding C1-C3’s respective goals, behaviors, skills, and “toileting.”
Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.
3. Citation: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (c), clause (6).
Violation: For three clients whose records were reviewed (C1, C2 and C3), the license holder did not document medication administration as required.
The license holder was responsible for administering C1’s, C2’s and C3’s medications. C1’s, C2’s and C3’s medication administration records between June and August 2025, were reviewed during a site visit on August 7, 2025. There were several dates between June and August 2025, the license holder did not document a notation of when a medication or treatment was administered to C1 and C2.
Corrective Action Ordered: On an ongoing basis you must maintain compliance as required in this subdivision.
4. Citation: Minnesota Statutes 245D.06, paragraph (e).
Violation: For one client whose records were reviewed (C3), the license holder did not report C3’s death to the Department within 24 hours as required.
On July 8, 2025, at 6:37 p.m., C3 died at the facility. On July 10, 2025, at 6 p.m., the license holder reported C3’s death to the Department.
Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter. You must include any and all information, documentation, or other evidence you have to support your request for reconsideration. Please note that a request for reconsideration does not stay any provisions of the correction order.
