CORRECTION ORDER

Dear Cathleen:

On July 23, 24, 25, and 28, 2025, Department of Human Services (DHS) licensors conducted a licensing review and investigation at your facility, Care Crossings LLC, located at 5901 Omaha Ave N, Suite 110, Oak Park Heights, MN, 55082. This review was conducted to determine compliance with state and federal laws and rules governing the provision of Substance Use Disorder under Minnesota statute, chapter 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Policies, Practices and Procedures

1. Violation: The license holder did not meet requirements for receiving public funding reimbursements from the commissioner for services provided, as follows:

a. Peer recovery services were not provided according to Minnesota Statutes, section 254B.052, subdivision 1, paragraph (a) on the following dates:

i. Peer recovery services were not provided on a one on one basis as follows:

1. June 23, 2025, June 24, 2025, June 25, 2025, and July 3, 2025 (client file numbered 7); and

2. May 13, 2025, May 16, 2025, and May 20, 2025 (client file numbered 8); and

ii. Peer recovery services were billed for transportation only on:

1. June 17 and June 16, 2025 (client file numbered 5); and

2. June 23, 2025 (client file numbered 7); and

a. Treatment services were billed for services not provided as follows:

i. The program billed for treatment services from March 31, 2025 through April 21, 2025; however, there was no documentation of treatment services during this time (client file numbered 7);

ii. Three hours of group counseling was documented; however, 4 hours were billed for on:

1. October 1, 2024, October 3, 2024, October 7, 2024 through October 11, 2024, and October 14, 2024 (client file numbered 1);

2. October 1, 2014, October 2, 2024, October 4, 2024, October 8, 2024, October 9, 2024, and October 10, 2024 (client file numbered 2); and

3. November 27, 2024, and December 6, 2024 (client file numbered 3); and

iii. Two hours of group counseling was billed for on June 23, 2025; however, there was no supporting documentation of treatment services being provided (client file numbered 7).

Statute Violated: Minnesota Statutes, section 245A.191.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure and document that services are provided in the amount and type for which they were billed. Additionally, the noncompliance identified above may result in nonpayment of claims submitted by the license holder for public program reimbursement; recovery of payments made for the service; disenrollment in the public payment program; or other administrative, civil, or criminal penalties as provided by law.

2. Violation: The license holder did not protect client records against tampering as follows:

a. The content of the client record, including staff signature and date of a progress note uploaded into the files section of the electronic heath record was able to be edited by any staff, as evidenced by DHS Licensors being able to edit the notes. These documents included comprehensive assessments, individual treatment plans, and treatment plan reviews; and

b. Notes titled ‘Chart Notes’ in the electronic health record were able to be edited by any staff member, as evidenced by DHS Licensors being able to edit the note. The original entries no longer contained within the client record.

Statute Violated: Minnesota Statutes, sections 245A.041, subdivision 4, clause (4) and 245G.09, subdivision 1, paragraph (a).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure client record keeping meets all applicable requirements.

3. Violation: The license holder did not meet requirements governing physical plant postings as follows:

a. The program abuse prevention plan that was posted was not consistent with the program abuse prevention plan in the policy manual; and

b. The maltreatment of vulnerable adults was not posted in a prominent location in the program.

Statute Violated: Minnesota Statutes, section 245A.65, subdivisions 1, paragraph (d) and 2, paragraph (a), clause 6.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that all required policies and procedures are posted. Violation corrected on site.

4. Violation: The license holder did not maintain policies and procedures necessary to maintain compliance with licensing requirements. The assessment and personnel policies referenced repealed statute language.

Statute Violated: Minnesota Statutes, section 245G.12, clauses (1) and (4).

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that provider policy and procedures meets all applicable requirements. Within 60 days of receipt of this order, submit the revised policies and procedures identified above that meet all applicable requirements.

5. Violation: The license holder did not meet requirements governing service initiation. The license holder initiated services for an individual who did not meet the service initiation criteria (client file numbered 8). The comprehensive assessment did not indicate a substance use disorder diagnosis and supporting documentation indicated that client was seeking care for mental health treatment.

Statute Violated: Minnesota Statutes, section 245G.14, subdivision 1.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that service initiation practices meet all applicable requirements.  

6. Violation: The license holder’s treatment services description did not meet requirements. The treatment services description did not contain:

a. The amount of service provided; and

b. The description of treatment services for therapeutic recreation.

Statute Violated: Minnesota Statutes, section 245G.12, clause (10).

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that treatment services and description meet all applicable requirements. Within 60 days of receipt of this order, submit a treatment service description that meets all applicable requirements.

7. Violation: The license holder did not meet requirements governing client rights protection. The license holder’s policy did not meet requirements in the following ways:

a. The client’s right policy did not include client rights as identified in Minnesota Statutes, section 253B.03; and

b. The grievance procedure did not include the current address and phone number for the Board of Behavioral Health and Therapy.

Statute Violated: Minnesota Statutes, section 245G.15, subdivisions 1 and 2, clause (3).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure client rights protection meets all applicable requirements. Within 30 days of receipt of this order, submit the policies identified above that meet all applicable requirements.

8. Violation: The license holder’s transfer of clients and records upon closure procedure did not meet requirements. There was no documentation that a controlling individual reviewed and signed the plan for calendar year 2024.

Statute Violated: Minnesota Statutes, section 245A.04, subdivision 15a, paragraph (a).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that transfer of clients and records meets all applicable requirements.

9. Violation: The license holder did not meet requirements governing program abuse prevention plans. The program abuse prevention plan was not reviewed for calendar year 2025 by a governing body or the governing body’s delegated representative.

Statute Violated: Minnesota Statutes, section 245A.65, subdivision 2, paragraph (a), clause (5).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that the program abuse prevention plan meets all applicable requirements. Violation corrected on site.

10. Violation: The license holder did not ensure group counseling met all applicable requirements. Client attendance records document that group size exceeded 16 clients in group counseling provided on April 9, 2025, April 10, 2025, April 11, 2025, April 17, 2025, and April 18, 2025.

Statute Violated: Minnesota statutes, section 245G.10, subdivision 4.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that group counseling meet all applicable requirements.

11. Violation: The license holder’s personnel policies and procedures did not meet requirements. There was no documentation of the following:

a. Policies ensuring that staff member retention, promotion, job assignment or pay are not affected by a good faith communication between a staff member and the department of health, the department of human services, the ombudsman for mental health and developmental disabilities, law enforcement or local agencies for the investigation of complaints regarding a client’s rights, health, or safety; and

b. Policies prohibiting client abuse described in Minnesota Statutes, sections 245A.65, 626.557, and 626.5572 and chapter 260E.

Statute Violated: Minnesota Statutes, section 245G.13, subdivision 1, clauses (1) and (4).

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that personnel policies and procedures meet all applicable requirements. Within 60 days of receipt of this order, submit the policies identified above that meet all applicable requirements.

12. Violation: The license holder did not meet requirements governing behavioral emergency policy and procedures. The policy did not include the types of procedures that may be used.

Statute Violated: Minnesota Statutes, section 245G.16, paragraph (a), clause (3).

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that behavioral emergency policy and procedures meet all applicable requirements. Within 60 days of receipt of this order, submit a behavioral emergency policy that meets all applicable requirements.

13. Violation: The license holder did not meet requirements governing health services as follows:

a. There was no description of the program’s procedures for administering opiate antagonist medications in the license holder’s description of health care services;

b. There was not a written standing order protocol that permits the license holder to maintain a supply of opiate antagonists on site; and

c. Written policies and procedures were not consistent with the HIV minimum standards.

Statute Violated: Minnesota Statutes, sections 245A.242, subdivision 2, paragraphs (a) and (b), clause (3), and 245G.08, subdivision 3.

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that emergency overdose treatment policy and procedure meet all applicable requirements. Within 60 days of receipt of this order, submit the policies above that meet all applicable requirements.

14. Violation: The license holder did not meet requirements governing location of service provision as follows:

a. The license holder did not meet the requirements for the provision of telehealth in Minnesota Statutes, section 256B.0625, subdivision 3b as follows:

i. There were no policies and procedures that adequately addressed client safety during and after the service is delivered through telehealth; and

ii. There were no established protocols addressing how and when to discontinue telehealth services;

b. The license holder did not ensure that a qualified staff member was physically present with a group of clients meeting together in person that had joined an in-person group by telehealth on May 22, 2025, May 29, 2025, June 4, 2025, June 12, 2025, June 18, 2025, and June 25, 2025; and

c. The license holder provided treatment services to clients at a location that was not one of the license holder’s licensed locations or an approved satellite location. Client attendance documentation from May 29, 2025, indicates that two clients received group counseling at a sober home located in Eveleth, Minnesota.

Statute Violated: Minnesota Statutes, section 245G.07, subdivision 4, paragraphs (a), (c), clauses (2), (4), and (6), and (f).

Corrective Action Required: Immediately and on an ongoing basis, the license holder will ensure that the location of treatment services meet all applicable requirements. Within 60 days of receipt of this order, submit telehealth policies that meet all applicable requirements.

Personnel Files

15. Violation: One of one personnel file reviewed for requirements governing individuals with a temporary permit (personnel file numbered 6) did not meet requirements. There was no documentation of the amount and type of supervision provided by the supervising licensed alcohol and drug counselor on a weekly basis from November 7, 2024, through July 23, 2025.

Statute Violated: Minnesota Statutes, section 245G.11, subdivision 11.

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an on-going basis, the license holder must ensure that staff qualifications meet all applicable requirements.

16. Violation: Five of five personnel files reviewed for requirements governing staff orientation (personnel files numbered 1, 2, 4, and 6) did not meet requirements. There was no documentation of orientation to the following:

a. Within 24 working hours:

i. Specific job responsibilities (personnel file numbered 6); and

ii. Policies and procedures (personnel files numbered 1, 2, 4, and 6);

b. Internal policies and procedures related to the prevention and reporting of maltreatment of individuals receiving services within 72 hours of first providing direct contact services (personnel files numbered 1, 2, 4, and 6); and

c. 12 hours of training in co-occurring disorders within six months of employment (personnel files numbered 3 and 6.

Statute Violated: Minnesota Statutes, sections 245A.65, subdivision 3, and 245G.13, subdivisions 1, clause (7) and 2, paragraph (f).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an on-going basis, the license holder must ensure that staff orientation meets all applicable requirements

17. Violation: Two of four personnel files reviewed for requirements governing annual training did not meet requirements in the following ways:

a. There was no documentation of annual training for calendar year 2025 (personnel files numbered 3 and 5) for the following:

i. Mandatory reporting as specified in Minnesota Statutes, sections 245A.65, 626.557, and 626.5572, and chapter 260E; and

ii. HIV minimum standards; and

a. Mandatory reporting as specified in Minnesota Statutes, sections 245A.65, 626.557, and 626.5572, and chapter 260E for calendar year 2024 (personnel file numbered 5).

Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivision 3, and 245G.13, subdivision 2, paragraphs (c) and (d).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an on-going basis, the license holder must ensure annual and additional training meets all applicable requirements. Within 60 days of receipt of this order, submit documentation that the staff listed above have completed the required trainings.

18. Violation: Five of five personnel files reviewed for requirements governing personnel file contents did not meet requirements. The personnel file did not contain:

a. The first date that a background study subject had direct contact with a person served (personnel files numbered 2, 6, and 7); and

b. A written annual review for calendar year:

i. 2023 (personnel file numbered 3);

ii. 2024 (personnel files numbered 3 and 5); and

iii. 2025 (personnel file numbered 3).

Statute Violated: Minnesota Statutes, sections 245a.041, subdivision 6 and 245G.13, subdivision 1, clause (3).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an on-going basis, the license holder must ensure that personnel file contents meet all applicable requirements.

Client Files

19. Violation: Eight of eight client files reviewed for requirements governing client orientation did not meet requirements. There was no documentation of the following orientation:

a. Client rights and responsibilities on the day of service initiation (client file numbered 8);

b. That staff reviewed the client rights and responsibilities as identified in Minnesota Statutes sections 148F.165 with the client (client files numbered 1 through 8);

c. HIV minimum standards within 72 hours of admission (client files numbered 2, 4, and 6 through 8);

d. Internal and external maltreatment of vulnerable adults reporting policies within 24 hours of admission (client files numbered 1 through 8); and

e. Opioid education material approved by the commissioner on the day of service initiation (client files numbered 1 through 5 and 7).

Statute Violated: Minnesota Statutes, sections 245A.19, paragraph (b), 245A.65, subdivision 1, paragraph (c), 245G.04, subdivision 3, 245G.09, subdivision 3, clause (1), and 245G.15, subdivision 1.

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure client rights protection meets all applicable requirements.

20. Violation: Six of eight client files reviewed for requirements governing initial services plan (ISP) did not meet requirements. There was no documentation of the following:

a. The ISP being completed within 24 hours of the day of service initiation (client files numbered 2, 3, 4, 5, 7, 8, and 10); and

b. Immediate health and safety concerns (client filed numbered 8).

Statute Violated: Minnesota Statutes, section 245G.04, subdivision 1.

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure initial services plans meet all applicable requirements.

21. Violation: Six of eight client files reviewed for requirements governing vulnerable adult (VA) assessment and determination (client files numbered 2, 3, 4, 5, 7, and 8) did not meet requirements. The VA assessment was not completed within 24 hours of the day of service initiation.

Statute Violated: Minnesota Statutes, section 245G.04, subdivision 2, paragraph (a).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure VA assessments and determinations meet all applicable requirements.

22. Violation: Eight of eight client files reviewed for requirements governing comprehensive assessments (CA) did not meet requirements in the following ways:

a. The CA did not include the qualified staff member’s dated signatures (client file numbered 1);

b. The CA was not completed by the end of the fifth day on which a treatment service was provided and did not include the person-centered reason for the delay (client files numbered 2, 4, 5, 6, and 8); and

c. The assessment did not document the following:

i. Client’s age (client files numbered 2 and 8);

ii. Status of basic needs (client file numbered 7);

iii. Education level (client files numbered 2 through 5 and 8);

iv. Client’s history of mental health and substance use disorder treatment (client files numbered 4, 5, and 8);

v. Cultural influences (client files numbered 2 through 8);

vi. Substance use history, including:

1. Amount (client files numbered 2 through 7);

2. Frequency (client files numbered 2 and 6);

3. Duration (client file numbered 5); and

4. Route of administration (client files numbered 2 through 5);

5. Periods of abstinence (client file numbered 5); and

6. Circumstance of relapse (client file numbered 4, 5, 6, and 8);

vii. The client’s relationship with the client’s family and other significant personal relationships (client file numbered 4);

viii. The client’s evaluation of the quality of each relationship (client files numbered 3 and 4);

ix. Client’s strengths and resources (client files numbered 2 and 4);

x. Important developmental incidents in the client’s life (client files numbered 2 through 8);

xi. Trauma and abuse that the client suffered (client file numbered 3);

xii. The client’s family health history (client file numbered 2, 3, 4, 5, 6, 7, and 8);

xiii. A diagnosis of a substance use disorder or a finding that the client does not meet the criteria for a substance use disorder (client file numbered 4);

xiv. A determination of whether the individual screens positive for co-occurring mental health disorders using a screen tool approved by the commissioner (client files numbered 2 through 8); and

xv. A recommendation for the ASAM level of care identified in Minnesota statutes, section 254B.19, subdivision 1 (client file numbered 8).

Statute Violated: Minnesota Statutes, section 245G.05.

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure comprehensive assessments meet all applicable requirements. Within 60 days of receipt of this order, submit a comprehensive assessment that meets all applicable requirements.

23. Violation: Eight of eight client files reviewed for requirements governing individual treatment plans (ITP) did not meet requirements in the following ways:

a. ITP was not completed by the end of the tenth day on which a treatment session had been provided from the day of service initiation (client files numbered 2, 4, 5, 6, and 8);

b. ITP was not based on the client’s comprehensive assessment (client files numbered 5, 6, and 8);

c. ITP was not person-centered (client files numbered 1 through 4); and

d. The ITP did not include the following:

i. The client’s signature (client files numbered 1 through 8);

ii. The alcohol and drug counselor signature (client file numbered 1);

iii. The client’s involvement in the development of the plan (client files numbered 1, 2, 3, 5, 6, 7, and 8);

iv. How the family or others will be involved in the client’s treatment planning or the reasons why natural supports were not involved (client files numbered 1, 3, 4, 5, and 7);

v. A treatment strategy (client files numbered 1 through 8);

vi. A schedule for accomplishing the client’s treatment goals and objectives (client file numbered 2);

vii. ASAM level of care identified in Minnesota Statutes, section 254B.19, subdivision 1, under which the client is receiving services (client files numbered 1 through 8); and

viii. Resources to refer the client to when the client’s needs will be addressed concurrently by another provider (client files numbered 2, 6, and 8).

Statute Violated: Minnesota Statutes, section 245G.06, subdivisions 1 and 1a, paragraph (a), clauses (1) through (6).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure individual treatment plans meet all applicable requirements. Within 60 days of receipt of this order, submit two individual treatment plan that meets all applicable requirements.

24. Violation: Two of eight client files reviewed for requirements governing treatment services did not meet requirements. Therapeutic recreation was provided to the client; however, there was no documentation of an assessed need for therapeutic recreation (client files numbered 2 and 7).

Statute Violated: Minnesota Statutes, section 245G.07, subdivision 1, paragraph (a).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that the provision of treatment services meets all applicable requirements.

25. Violation: Eight of eight client files reviewed for requirements governing client records did not meet requirements as follows:

a. Documentation of treatment services did not include the following:

i. The amount of treatment services provided (client files numbered 6, 7, and 8);

ii. Client response to the treatment service (client files numbered 1 through 8); and

iii. The signatures of the staff person making the entry (client files numbered 3, 6, 7, and 8);

b. Documentation was not completed within seven days of providing the treatment service (client file numbered 1);

c. Documentation was not completed by the staff member who provided the treatment service (client file numbered 8); and

d. Documentation of telehealth services did not include the following, per Minnesota Statutes, 256B.0625, subdivision 3b:

i. A determination that telehealth was an effective means for delivering the treatment service (client file numbered 8); and

ii. The location of the originating site and the distance site (client files numbered 1 through 8).

Statute Violated: Minnesota Statutes, sections 245G.06, subdivision 2a and 2b, paragraph (c), and 245G.07, subdivision 4, paragraph (c), clause (2).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure treatment service documentation meets all applicable requirements.

26. Violation: Eight of eight client files reviewed for requirements governing treatment plan reviews (TPR) did not meet requirements in the following ways:

a. TPR prepared by a student intern was not reviewed and signed by a qualified staff member (client files numbered 3 and 8);

b. TPR was not completed once every 30 days for a client receiving ASAM level 1.0 outpatient or 2.1 intensive outpatient services (client file numbered 1, 2, 3, 4, 6, and 8); and

c. The TPR did not document the following:

i. The span of time covered by the review (client files numbered 1);

ii. Client goals addressed since the last treatment plan review (client files numbered 1, 3, 4, 5, 7, and 8);

iii. Whether the identified methods continue to be effective (client files numbered 7 and 8);

iv. Monitoring of any physical and mental health problems (client files numbered 1and 3);

v. The participation of others involved in the individual’s treatment planning (client files numbered 1and 8);

vi. Whether the client agrees with the changes in the methods identified (client file numbered 5); and

vii. Referrals made since the previous treatment plan review (client file numbered 8).

Statute Violated: Minnesota Statutes, sections 245G.06, subdivisions 3, clauses (1) through (4) and (6), and 3a, paragraphs (a) and (e), and 245G.11, subdivision 10, paragraph (a).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure treatment plan reviews meet all applicable requirements. Within 60 days of the receipt of this order, submit two treatment plan review that meets all applicable requirements.

27. Violation: Four of five client files reviewed for requirements governing discharge summaries did not meet requirements as follows:

a. The discharge summary was not completed within five days of the client’s service termination (client files numbered 3, 5, and 9); and

b. There was no documentation of the following:

i. The client’s progress toward achieving each of the goals identified in the individual treatment plan (client files numbered 3 and 4);

ii. The reasons for and circumstances of service termination (client file numbered 3); and

iii. Service termination diagnosis (client file numbered 3).

Statute Violated: Minnesota Statutes, section 245G.06, subdivision 4, paragraphs (a) and (b), clauses (2), (4), and (5).

Repeat Violation: In a Correction Order that DHS issued on June 6, 2023, you were previously found in violation of this same statute.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure client discharge summaries meets all applicable requirements.

Written Response Required

If you fail to correct the violation(s) specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

You have the right to request reconsideration of this order and the cited violations. Your request must:

· Be in writing

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order
