Yemane Aleku, Authorized Agent Miracle Adult Day Care Center of Minnesota LLC 1069 Humboldt Avenue West St. Paul, Minnesota 55118 License Number: 1121451 (Rule 223) CORRECTION ORDER Dear Yemane Aleku: On September 17, 2025, a licensing review of Miracle Adult Day Care Center of Minnesota LLC, located at 1867 Oakdale Avenue, West St. Paul, Minnesota, was conducted to determine compliance with Minnesota Statutes and Rules governing adult day care services under Minnesota Rules, parts 9555.9600 through 9555.9730 (Rule 223). As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Rules, part 9555.9660, subpart 1. Violation: For two participants whose records were reviewed (P1 and P2), the license holder did not include information in the participant’s written record as required. a. The license holder did not include the following information in P1’s record: · an application form that included: o P1’s source of referral; and o the name and telephone number of a second person to call in case of emergency involving P1 if the first person cannot be reached; · a medical report dated within the three months prior to or 30 days after P1’s admission to the center. P1 was admitted to the center on October 23, 2024 and the license holder maintained a medical report for P1 on February 4, 2025; and · participation reports and progress notes that are recorded at least monthly. b. The license holder did not include the following information in P2’s record: · an application form that included: o P2’s telephone number and source of referral; and o the name and telephone number of a second person to call in case of emergency involving P2 if the first person cannot be reached; · a medical report signed by a physician or signed by a physician assistant or registered nurse and cosigned by a physician; and · participation reports and progress notes that are recorded at least monthly. Corrective Action Ordered: Within 30 days of receiving this order, you must maintain all information detailed above in P1 and P2’s participant records. On an ongoing basis, you must maintain compliance as required in this subpart. 2. Citation: Minnesota Rules, part 9555.9700, subpart 3.
Violation: For one participant whose record was reviewed (P2), the license holder did not develop a written plan of care as required. The license holder did not develop a written plan of care for P2 that included: · an update to the preliminary service plan and additional services required by the participant; · staff members responsible for implementing the individual plan of care; and · provisions for quarterly review and quarterly revisions of the individual plan of care. Corrective Action Ordered: Within 30 days of receiving this order, you must develop a written plan of care for P2 to includes the information detailed above. On an ongoing basis, you must maintain compliance as required in this subpart. 3. Citation: Minnesota Rules, part 9555.9600, subpart 10. Violation: The license holder did not meet the requirements of a center director. "Center director" means the person responsible for managing the daily affairs of the center. The license holder did not ensure the center director managed the daily affairs of the center. During the licensing review on September 17, 2025, the license holder stated the center director comes into the center on a weekly or as needed basis. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 4. Citation: Minnesota Rules, part 9555.9650, items A and B. Violation: For two of two staff persons (SP1 and SP2), and three consultants whose records were reviewed, the license holder did not maintain personnel files are required. a. The license holder did not maintain the following information in SP1’s personnel record: · SP1’s job description; and · documentation of an annual performance evaluation in 2025.
b. The license holder did not maintain the following information in SP2’s personnel record: · SP2’s job description; and · an employment application or resume indicating that the employee meets the requirements in part 9555.9680. c. The license holder did not maintain a personnel file for the registered dietician, physical therapist, and registered nurse that included a copy of a signed contract or letter of appointment specifying conditions and terms of employment. Corrective Action Ordered: Within 30 days of receiving this order, you must: · maintain the above mentioned information is SP1 and SP2’s personnel records; and · maintain a personnel file for your registered dietician, physical therapist, and registered nurse that includes a copy of a signed contract or letter of appointment specifying conditions and terms of employment. On an ongoing basis, you must maintain compliance as required in these items. 5. Citation: Minnesota Rules, part 9555.9690, subpart 3. Violation: For one staff person whose record was reviewed (SP1), the license holder did not provide orientation to the center as required. The license holder did not provide SP1 with 20 hours of orientation to the center within the employee’s first 40 hours of employment at the center, including: · at least four hours of supervised orientation before SP1 worked directly with persons at the center; · training related to the kinds of functional impairments of persons currently at the center; and · safety requirements and procedures in part 9555.9720. Corrective Action Required: Within 30 days of receiving this order, you must provide the required orientation training detailed above to SP1. On an ongoing basis, you must maintain compliance as required in this subpart. 6. Citation: Minnesota Rules, part 9555.9690, subpart 4. Violation: For one staff person whose record was reviewed (SP1), the license holder did not provide in-service training annually as required. The license holder did not provide SP1 a minimum of eight hours of in-service training annually in the following areas: · areas related to care of center participants, including provision of medication assistance and review of parts 9555.9600 to 9555.9730; and · Minnesota Statutes, section 626.557. Corrective Action Ordered: Within 30 days of receiving this order, you must provide the required in-service training detailed above to SP1. On an ongoing basis, you must maintain compliance as required in this subpart. 7. Citation: Minnesota Rules, part 9555.9710, subparts 1 and 4. Violation: The license holder did not offer services as required. a. The license holder did not maintain a contract with the food service provider. b. The license holder did not maintain documentation of a structured exercise program developed in consultation with a registered physical therapist. c. The license holder did not ensure a registered physical therapist provided consultation and review of the exercise program, at least quarterly, in 2025. Corrective Action Ordered: Within 30 days of receiving this order, you must: · maintain a contract with the food service provider; · maintain documentation of a structured exercise program developed in consultation with a registered physical therapist; and · ensure a registered physical therapist provides consultation and review of the exercise program at least quarterly. On an ongoing basis, you must maintain compliance as required in these subparts. 8. Citation: Minnesota Rules, part 9555.9720, subparts 7 and 9.
Violation: The license holder did not meet safety requirements. a. The license holder did not ensure equipment was in good repair, including flooring that was lifted and unsecured in the quiet space. b. The license holder did not ensure plans for emergencies caused by fire, blizzards, and tornadoes were posted in a visible place in the center. Corrective Action Ordered: Within 30 days of receiving this order, you must: · ensure equipment is in good repair including the flooring in the quiet space; and · ensure plans for emergencies caused by fire, blizzards, and tornadoes are posted in a visible place in the center. On an ongoing basis, you must maintain compliance as required in these subparts. 9. Citation: Minnesota Statutes, section 245A.65, subdivision 2. Violation: The license holder did not establish and enforce their program abuse prevention plan (PAPP) as required. The license holder did not ensure the license holder’s governing body or the governing body’s delegated representative reviewed the PAPP at least annually. The license holder most recently documented a review of the PAPP in August 2023. Additionally, the license holder did not ensure a copy of the PAPP was posted in a prominent location in the program. Corrective Action Ordered: Within 30 days of receiving this order, you must: · review your PAPP using the assessment factors in the plan and any substantiated maltreatment findings that occurred since the last review; and · post a copy of the PAPP in a prominent location in the program. On an ongoing basis, you must maintain as required in this subdivision. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
