CORRECTION ORDER
Dear Adam Anderson:
On September 30 and October 1, 2025, the Department of Human Services (DHS) conducted a licensing review at your facility, John E. Herman Home & Treatment Facility LLC located at 351 14th Ave SW, Rochester, MN 55902. DHS requires you to take the corrective action described below. Details of our findings, next steps, and your options are explained below.
Standards reviewed
The licensing review was conducted to determine compliance with state and federal laws and rules governing the provisions of Residential Programs for Adults Who Are Mentally Ill under Minnesota Rules, parts 9520.0500 to 9520.0660 (Rule 36).
Licensing violations
DHS determined that your program did not follow the standard(s) described below.
Program Practices
1. Violation: The license holder did not have a community representative on their advisory committee for the year 2024.
Citation: Minnesota Rules, section 9520.0560, subpart 1
Corrective Action Required Correct immediately and maintain compliance.
2. Violation: A controlling individual did not sign the transfer of clients and records upon closure plan for calendar year 2024.
Citation: Minnesota Statutes, section 245A.04, subdivision 15a, paragraph (a).
Repeat Violation: The license holder was cited for a similar violation in the following order(s):

Client Records
3. Violation: 3 of 3 client files reviewed did not meet individual abuse prevention plan (IAPP) requirements. The IAPP was not reviewed by the interdisciplinary team as part of the service plan review (C1), (C2), (C3).
Citation: Minnesota Statutes, section 245A.65, subdivision 2
Corrective Action Required Correct immediately and maintain compliance. This violation was corrected during the licensing review, no further corrective action is required.
4. Violation: 1 of 3 client files reviewed, did not meet the individual program plan component requirements. The assessment did not include a strength and needs list of the resident in at least the following areas of life: social, medical, legal, family, leisure and recreation, spiritual or religious, psychological, financial, vocation, and educational (C2).
Citation: Minnesota Rules, section 9520.0640, subdivision 2, paragraph a, d.
Corrective Action Required Correct immediately and maintain compliance. This violation was corrected during the licensing review, no further corrective action is required.
5. Violation: 1 of 1 client files reviewed, did not meet discharge requirements. The discharge summary did not include an aftercare plan (C2)
Citation: Minnesota Rules, section 9520.0640, subdivision 4, paragraph c.
Corrective Action Required Correct immediately and maintain compliance. This violation was corrected during the licensing review, no further corrective action is required.
How to respond
If you fail to correct the violation(s) specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
