November 7, 2025 David Baker, Authorized Agent Renaissance Adult Day Care Inc 14226 Opal Street Northeast Ham Lake, Minnesota 55304 License Number: 1119153 (Rule 223) CORRECTION ORDER Dear David Baker: On October 2, 2025, a licensing review of Renaissance Adult Day Care located at 5656 Lincoln Drive, Edina, Minnesota was conducted to determine compliance with Minnesota Statutes and Rules governing adult day care services under Minnesota Rules, parts 9555.9600 through 9555.9730 (Rule 223). As a result of this licensing review, a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Rules, part 9555.9660, subpart 1. Violation: For two of two participants whose records were reviewed (P1 and P2), the license holder did not include information in the participant’s written record as required. a. The license holder did not include the following information in P1’s record: · an application form that included: o P1’s source of referral; and o the name and telephone number of a second person to call in case of an emergency involving P1 if the first person cannot be reached; · a medical report, dated within the three months prior to or 30 days after P1’s admission to the center. b. The license holder did not include the following information in P2’s record: · an application form that included P2’s living arrangement; and · a medical report, dated within the three months prior to or 30 days after P2’s admission to the center. Corrective Action Ordered: Within 30 days of receiving this order, you must maintain all information detailed above in P1 and P2’s participant records. On an ongoing basis, you must maintain compliance as required in this subpart. 2. Citation: Minnesota Rules, part 9555.9700, subpart 2.
Violation: For one participant whose record was reviewed (P1), the license holder did not complete initial service planning as required. The license holder did not develop a preliminary service plan for P1 that included services and activities in which P1 would take part immediately upon admission. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 3. Citation: Minnesota Rules, part 9555.9700, subpart 3. Violation: For one participant whose record was reviewed (P1), the license holder did not develop a written plan of care as required. The license holder did not develop a written plan of care for P1 that included an update of the preliminary service plan. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 4. Citation: Minnesota Rules, part 9555.9650, item A. Violation: For one of two staff persons whose records were reviewed (SP2), the license holder did not maintain a personnel record as required. The license holder did not maintain an employment application or resume for SP2 indicating that the employee meets the requirements in part 9555.9680. Corrective Action Ordered: Within 30 days of receiving this order, you must maintain an employment application or resume in SP2’s personnel record. On an ongoing basis, you must maintain compliance as required in this subpart. 5. Citation: Minnesota Rules, part 9555.9690, subpart 3. Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide orientation to the center as required. The license holder did not provide SP2 with at least 4 hours of supervised orientation before the employee worked directly with persons at the center. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 6. Citation: Minnesota Rules, part 9555.9690, subpart 4. Violation: For two staff persons whose records were reviewed (SP1 and SP2), the license holder did not provide in-service training annually as required. 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year. The license holder did not provide SP1 and SP2 with eight hours of annual in-service training as required. SP1 and SP2 received in-service training in January 2024 and SP1 and SP2 received in-service training in June 2025. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subpart. 7. Citation: Minnesota Rules, part 9555.9710, subparts 1, 4 and 7. Violation: The license holder did not offer services as required. a. The license holder did not have menus for all meals and snacks approved by a registered dietician. b. The license holder did not offer a daily structured exercise program developed in consultation with a registered physical therapist. c. The license holder did not maintain family and social histories for P1 and P2 that were updated annually. Corrective Action Ordered: Within 30 days of receiving this order, you must: · ensure menus for all meals and snacks are approved by a registered dietician; · maintain and offer a structured exercise program developed in consultation with a registered physical therapist; and · maintain and update P1 and P2’s family and social histories. On an ongoing basis, you must maintain compliance as required in these subparts. 8. Citation: Minnesota Rules, part 9555.9720, subparts 2, 7 and 8. Violation: The license holder did not maintain safety as required. a. The license holder did not maintain a list of emergency phone numbers posted next to the telephone. b. The license holder did not ensure furniture was in good repair. c. The license holder did not ensure areas used by participants were free from peeling paint and loose plaster. Corrective Action Ordered: Within 30 days of receiving this order, you must: · maintain a list of emergency phone numbers posted next to the telephone; · ensure furniture is in good repair; and · ensure areas used by participants are free from peeling paint and loose plaster. On an ongoing basis, you must maintain compliance as required in this subpart. 9. Citation: Minnesota Statutes, section 245A.65, subdivision 2. Violation: The license holder did not establish and enforce their program abuse prevention plan (PAPP) as required. The license holder did not establish and enforce an ongoing written PAPP that contained an assessment of the physical plant, its environment, and its population identifying factors which may encourage or permit abuse, and a statement of specific measures to be taken to minimize the risk of abuse. Corrective Action Ordered: Within 30 days of receiving this order, you must establish and enforce a PAPP that contains an assessment of the physical plant, its environment, and its population identifying factors which may encourage or permit abuse, and a statement of specific measures to be taken to minimize the risk of abuse. On an ongoing basis, you must maintain compliance as required in this subdivision.
B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
