Dear Gene Leistico:
CORRECTION ORDER
An investigation of ACR Homes, Inc. was completed regarding report number 202501802, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned emotional abuse. The disposition of the investigation report is substantiated. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules was observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes section 245D.04, subdivision 3, paragraph (a), clause (6); paragraph (b), clause (1)
Violation: The license holder did not ensure the person's protection-related rights.
Information was provided that on more than one occasion, a staff person (S1) told a client (C1), “You’re acting like a bitch” and “You’re the reason staff quit.”
Information was provided that on more than one occasion, S1 told C1 to clean up his/her own incontinence and vomit and declined to help C1 stand up from the floor or stop using his/her walker despite C1’s screams to stop.
Information was provided that on more than one occasion, S1 told C1 that if s/he did not complete a specific task, C1 would not be allowed to call his/her family member that day or go on a community outing.
Corrective Action Ordered: Correct immediately and on an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statutes section 245D.07, subdivision 1a, paragraph (a)
Violation: The license holder did not provide services in response to the person’s identified needs, interests, preferences, and desired outcomes as specified in the support plan and the support plan addendum as required.
Information was provided that on more than one occasion, S1 declined to intervene or help with C1’s personal cares which left C1 attempting to independently complete his/her cares for hours. C1’s support plans had specific procedures in place regarding the amount of time s/he should spend on a task before staff assisted/intervened.
Corrective Action Ordered: Correct immediately and on an ongoing basis, you must maintain compliance as required in this subdivision.
3. Citation: Minnesota Rules, part 9544.0060, subpart 2, item N.
Violation: The license holder did not prevent the use of sensory stimuli for a behavioral or therapeutic program to reduce or eliminate behavior, as punishment, or for staff convenience.
Information was provided that on more than one occasion, S1 continuously playing a loud alarm, “blow horn,” or “foghorn” until C1 completed a specific task.
Corrective Action Ordered: Correct immediately and on an ongoing basis you must maintain compliance as required in this subdivision.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
