CORRECTION ORDER
Dear Mohamed Abdi:
On September 24, 2025, a licensing review of Bayside Homecare Inc, located at 3300 County Road 10, Suite 101, Brooklyn Center, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes, section 245A.65, subdivision 2.
Violation: For two of three persons whose record was reviewed (P2 and P3), the license holder did not establish and enforce ongoing written program abuse prevention plans (PAPP) and individual abuse prevention plans (IAPP) as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
a. The license holder provided intensive services to P3 at a location that was within the control of the license holder. The license holder did not establish a written PAPP that assessed the population, the physical plant, and the environment within the control of the license holder and the location where licensed services were provided.
b. The license holder did not develop P2’s IAPP prior to or upon service initiation. The license holder initiated services with P2 on June 14, 2023, and developed P2’s IAPP on June 20, 2023. Additionally, the license holder did not review P2’s IAPP at least annually as required. The license holder most recently reviewed P2’s IAPP in August 2024.
The license holder identified in P2’s assessment the risk of sexual, physical and self-abuse, but did not include in P2’s IAPP a statement of the specific actions the program will take to minimize the risk of abuse within the scope of the licensed service.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· update P2’s IAPP to include the specific actions the program will take to minimize the risk of abuse within the scope of the licensed service;
· review P2’s updated IAPP with P2, P2’s legal representative, and P2’s interdisciplinary team and revise the plan to reflect the results of this review;
· provide P2’s staff with orientation to P2’s updated IAPP and maintain documentation of this orientation according to Minnesota Statutes, section 245D.095;
· establish written PAPPs for locations where licensed services are provided and are within your control;
· post the PAPP in a prominent location in the program;
· provide an orientation to the PAPP for P3, and for all persons who are receiving services at these locations and maintain documentation of the orientation in each person’s record; and
· provide staff persons providing direct support to persons at these locations with an orientation to the PAPPs. You must document this orientation in each staff person’s personnel record according to the requirements in 245D.095.
On an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statutes, section 245D.04, subdivision 1.
Violation: For three persons whose records were reviewed (P1-P3), the license holder did not provide service recipient rights as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
a. The license holder did not provide P3 with a written notice that identified the service recipients’ rights and an explanation of those rights annually in 2025. The license holder most recently provided P3 with a written notice on August 14, 2024.
b. The license holder did not provide P1 or P1’s legal representative with a written notice that identified the service recipient rights in subdivision 2 and 3 and an explanation of those rights annually in 2024.
c. The license holder did not provide P2 or P2’s legal representative with written notice that identified all the service recipient rights in the written the notice provided on June 12, 2023. The written notice did not include P2’s right to access personal possessions at any time, including financial resources. Additionally, the license holder did not provide P2 or P2’s legal representative with a written notice of their services recipient rights annually. The license holder only provided the written notice on June 12, 2023.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· provide P1 or P1’s legal representative, P2 or P2’s legal representative, and P3 with a copy of the service recipient rights and an explanation of those rights; and
· maintain documentation of P1 or P1’s legal representative’s, P2’s or P2’s legal representative’s, and P3’s receipt of the copy and an explanation of the rights in P1’s, P2’s and P3’s support plan addendums.
On an ongoing basis, you must maintain compliance as required in this subdivision.
3. Citation: Minnesota Statutes, section 245D.05, subdivision 1.
Violation: For one person whose record was reviewed (P2), the license holder did not meet health service needs as required.
The license holder was assigned responsibility for P2’s health services needs in P2’s support plan and support plan addendum. The license holder did not maintain documentation of the procedures the license holder would follow in order to provide P2 with medication assistance.
Corrective Action Ordered: Within 30 days of receiving this order you must:
· update P2’s support plan addendum to include the information identified above;
· provide P2’s staff with review of the updated plan; and
· maintain documentation according to Minnesota Statutes 245D.095.
On an ongoing basis, you must maintain compliance as required in this subdivision.
4. Citation: Minnesota Statutes, section 245D.05, subdivision 1a.
Violation: For one person whose record was reviewed (P3), the license holder did not provide medication setup as required.
The license holder maintained documentation in P3’s support plan addendum that documented staff persons were to setup medications in P3’s medication machine. The license holder did not document the following in P3’s medication administration record:
· dates of setup;
· name of medication;
· quantity of dose;
· times to be administered; and
· route of administration.
Corrective Action Ordered: Within 30 days of receiving this order, you must ensure that medication setup is documented in P3’s record at the time of setup and you must include the bulleted information above. On an ongoing basis, you must maintain compliance as required in this subdivision.
5. Citation: Minnesota Statutes, section 245D.071, subdivision 3.
Violation: For two persons whose records were reviewed (P1 and P3), the license holder did not meet initial service planning requirements as required.
a. The license holder did not meet with P3, P3’s case manager, and members of P3’s support team within 45 days of service initiation to determine how technology might be used to meet the person’s desired outcomes. The support plan addendum must include a summary of the discussion. The summary must include:
· a statement regarding any decision that is made regarding the use of technology; and
· a description of any further research that needs to be completed before a decision regarding the use of technology can be made.
b. The license holder did not review the results of P1’s assessment with the support team or expanded support team as part of a service plan review in 2024.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· meet with P3,P3’s case manager, and members of P3’s support team to determine the information listed above;
· maintain documentation of this discussion in P3’s support plan addendum;
On an ongoing basis, you must maintain compliance as required in this subdivision.
6. Citation: Minnesota Statutes, section 245D.071, subdivision 4.
Violation: For one person whose record was reviewed (P3), the license holder did not implement service outcomes and supports as required.
The license holder did not implement the supports and methods documented in P3’s service plan when the license holder did not collect data on P3’s outcome.
Corrective Action Ordered: Within 30 days of receiving this order, you must implement service outcomes and supports for P3 as documented in their support plan addendum. On an ongoing basis, you must maintain compliance as required in this subdivision.
7. Citation: Minnesota Statutes, section 245D.071, subdivision 5.
Violation: For two persons whose records were reviewed (P1 and P3), the license holder did not review and evaluate the service plan as required.
a. The license holder did not provide a report to P3’s case manager at the service plan review meeting that:
· summarized P3’s status and progress toward achieving the identified outcome;
· made recommendations; and
· identified the rationale for changing, continuing, or discontinuing the implementation of the supports and methods.
b. The license holder did not provide P1, P1’s legal representative, and P1’s case manager with a report in 2024 that summarized P1’s status and progress toward achieving the identified outcomes, made recommendations, and identified the rationale for changing, continuing, or discontinuing implementation of the supports and methods.
c. The license holder did not send the support plan addendum to P1’s case manager within 10 working days of the progress review meeting to obtain a dated signature and document approval of any changes to the support plan addendum. The license holder held a progress review meeting with P1, P1’s legal representative, and P1’s case manager in December 2024. The license holder sent the support plan addendum to P1’s case manager in March 2025.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide P3 and P3’s case manager with a progress report that includes the information above and maintain documentation of providing the progress report to P3 and P3’s case manager in P3’s support plan addendum. On an ongoing basis, you must maintain compliance as required in this subdivision.
8. Citation: Minnesota Statutes, section 245D.09, subdivision 4.
Violation: For three of three staff persons whose record was reviewed (SP1-SP3), the license holder did not provide orientation training as required.
a. The license holder did not provide the following orientation training to SP3 within 60 days of hire:
· principles of person-centered service planning and delivery as identified in Minnesota Statutes, section 245D.07, subdivision 1a, and how they are applied to direct support service provided by the staff person;
· staff responsibilities related to prohibited procedures under 245D.06, subdivision 5, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are unsafe;
· basic first aid; and
· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
b. The license holder did not provide the following orientation training to SP1within 60 days of hire:
· principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a and how they apply to direct support service provided by the staff person;
· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such behaviors are not safe; and
· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
The license holder hired SP1 on February 7, 2024. The license holder provided these trainings to SP1 in February 2025.
c. The license holder did not provide the following orientation training to SP2 within 60 days of hire:
· basic first aid; and
· strategies to minimize risk of sexual violence, including concepts of health relationships, consent, and bodily autonomy of people with disabilities.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP2 and SP3 with the above mentioned training topics. You must document these trainings in SP2’s and SP3’s personnel records. On an ongoing basis, you must maintain compliance as required in this subdivision.
9. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.
Violation: For one staff person whose record was reviewed (SP3), the license holder did not review and provide instruction on medication set up as required.
The license holder did not review and provide instruction on medication setup for SP3 before SP3 had unsupervised direct contact. Additionally, the license holder did not complete a medication setup training for SP3 that included a training curriculum developed by a registered nurse or appropriate licensed health professional.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP3 with medication setup training that includes:
· a training curriculum was developed by a registered nurse or appropriate licensed health professional.
· incorporate an observed skill assessment conducted by the trainer to ensure SP3 demonstrates the ability to safely and correctly follow medication procedures; and
· maintain documentation of this training in SP3’s personnel record.
On an ongoing basis, you must maintain compliance as required in this subdivision.
10. Citation: Minnesota Statutes, section 245D.09, subdivision 5.
Violation: For two staff persons whose records were reviewed (SP1 and SP2), the license holder did not provide annual training as required.
Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.
a. The license holder did not provide SP1 with annual training to 245A.66 governing maltreatment reporting and service planning for children in 2025.
b. The license holder did not provide SP2 with annual training on the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint. The license holder most recently provided this training to SP2 in June 2024.
Corrective Action Ordered: Within 30 days you must:
· provide SP1 with training to 245A.66 governing maltreatment reporting and service planning for children;
· maintain documentation of this training in SP1’s personnel record according to Minnesota Statutes, section 245D.095and
· provide SP2 with the training identified above and maintain documentation according to Minnesota Statutes, section 245D.095.
On an ongoing basis, you must maintain compliance as required in this subdivision.
11. Citation: Minnesota Statutes, section 245D.095, subdivision 3.
Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not maintain a service recipient record as required.
a. The license holder did not maintain a signed statement for P1 that authorized the license holder to act in a medical emergency when P1’s legal representative cannot be reached or is delayed in arriving. Additionally, the license holder did not maintain progress or daily log notes that are recorded by the program for P1.
b. The license holder did not maintain a signed statement for P2 that authorized the license holder to act in a medical emergency when P2’s legal representative cannot be reached or is delayed in arriving.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· obtain a signed authorization from P1’s legal representative and P2’s legal representative authorizing the license holder to act in a medical emergency when P1’s legal representative and P2’s legal representative cannot be reached or is delayed in arriving;
· maintain the signed authorization in the person’s service recipient record; and
· begin maintaining progress or daily log notes for P1
On an ongoing basis, you must maintain compliance as required in this subdivision.
12. Citation: Minnesota Statutes, section 245D.10, subdivision 4.
Violation: For one person whose record was reviewed (P1), the license holder did not provide copies of policies and procedures as required.
The license holder did not inform P1, and P1’s case manager of the license holder’s data privacy policy and provide a copy within five working days of service initiation.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide P1, and P1’s case manager with a copy of the data privacy policy. You must maintain documentation that this policy was provided in P1’s support plan addendum. On an ongoing basis, you must maintain compliance as required in this subdivision.
If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
B. Right to Request Reconsideration
If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
