Terms of Settlement Agreement:

1) License Holder agrees to pay $500.00 of the ordered fine to DCYF and will submit payment to DCYF along with the executed Agreement, payable to the Minnesota Department of Children, Youth, and Families.

2) Upon final execution of the Settlement Agreement, DCYF agrees to stay the remaining $500.00 of the ordered fine for a period of two (2) years from the date of the final execution of the Agreement. The stayed fine will be immediately reinstated if DCYF determines that License Holder has failed to comply with licensing requirements, or issues any additional orders to License Holder resulting in a fine, conditional license, or other licensing sanctions during the period of the stay.

3) License Holder’s family child care license, License No. 1113948, will be placed on conditional status for a period of two (2) years from the effective date of this Agreement. While under the conditional license, License Holder shall comply with the following terms:

a. License Holder will follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445.

b. License Holder’s family child care license will be limited to a maximum capacity of 12 children (class C2 license), and no variances to age distribution or capacity will be granted during the conditional period.

c. License Holder must submit a written supervision plan to Morrison County within fifteen (15) calendar days from the effective date of the Agreement. This plan must be approved by the County.

d. License Holder must complete at least six hours of additional training within sixty calendar (60) days from the effective date of the Agreement. This training is in addition to the annual training requirements as listed in Minnesota Statutes, section 142B.70. The training(s) must include the topic of active supervision. License Holder must obtain approval from Morrison County prior to attending the training(s), and must submit documentation of attendance and completion to the County.

e. License Holder must post the Agreement in her family child care program in a conspicuous place and provide a copy of this Agreement to parents or guardians of all children in care under License No. 1113948.  She must obtain signatures from parents or guardians of each child attending her family child care programs indicating they have received a copy of this Agreement.  Documentation that the parents received a copy of this Agreement must be provided to Morrison County within thirty (30) calendar days from the effective date of the Agreement. For new families enrolling a child in the family child care program, License Holder must submit documentation signed by the parent or guardian to Morrison County within five (5) calendar days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of this Agreement.
