Dear Denise Fadina:
On May 21, 2025, the Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding Citation 5 in the Correction Order issued May 15, 2025. You did not request review for Citations 1 through 4 and 6 through 11. Therefore, Citations 1 through 4 and 6 through 11 are not under review.
On June 18, 2025, licensing functions for child care centers, family child care programs, and child foster care programs, and maltreatment investigations involving child care centers, have been transferred from Minnesota Department of Human Services, Office of Inspector General (DHS), to the new Minnesota Department of children, Youth, and Families (DCYF), as directed by state law. While this matter began under DHS, pursuant to Minnesota Statutes, section 15.039, subdivision 2, DCYF is now the responsible agency.
SUMMARY OF CITATION AND RECONSIDERATION DETERMINATION:
Citation 5: Staff did not wash tables used for meals with soap and water as required. It was determined through conversations with a staff person that tables are not always washed right before meals are served. (Facility: Facility)
Request for Reconsideration. You stated that the Minnesota rules, 9503.0145, subpart 3 does not “denote a timeframe” for when the tables used for meals must be washed with soap and water.
You also stated that the program has one set of tables in the classroom used for meals and other activities like art and “all tables are absolutely washed before and after use.”
You also stated, “if the last table use for an activity was an hour before lunch, the tables were washed and sanitized after that last activity with ample time to allow the bleach solution to dry…that there were no table activities between that wash and lunch.”
Finally, you provided the program’s schedule for washing and sanitizing tables.
Applicable Law. The license holder must ensure that tables and highchair trays used for meals must be washed with soap and water before and after each use. Minnesota Rules, part 9503.0145, subpart 3.
Reconsideration Determination. The license holder must ensure that tables and highchair trays used for meals must be washed with soap and water before and after each use. The licensor observed that the program did not wash the table with soap and water before a meal was served. The licensor observed children being moved to the table to do movement videos. The children alternated between being seated at the table, standing around the table, rolling around the floor, touching each other, touching toys, sitting at the table, and touching the table top. Then the licensor observed the program serving children lunch at the table directly after that activity, without washing the table with soap and water. Citation 5 is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 5 is affirmed. You did not request review for Citations 1 through 4 and 6 through 11. Therefore, Citations 1 through 4 and 6 through 11 are not under review. This is a final agency decision.
