CORRECTION ORDER
Dear Kinsi Mirreh: A Department of Human Services (DHS) licensor conducted a licensing investigation of your facility, Addiction Health Center, located at 2266 2nd Street N Suite 200, North St Paul, MN 55109. This investigation was conducted to determine compliance with state and federal laws and rules governing the provision of substance use disorder treatment services under Minnesota Statutes 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed. LICENSING VIOLATIONS
DHS determined that your program did not follow licensing rules and statutes, as described below. Personnel File
1. Violation: One personnel file was reviewed for requirements governing orientation training (SP1) and did not meet requirements. The file did not contain documentation of orientation to the following:
a. Within 24 hours of working:
1. Specific job responsibilities;
2. Policies and procedures;
3. Client confidentiality; and
4. Client needs.
b. HIV minimum standards within 72 hours of employment;
c. Within 72 hours of first providing direct contact services:
1. Maltreatment of vulnerable adults;
2. The license holder’s program abuse prevention plan; and
3. Internal policies and procedures related to the prevention and reporting of maltreatment of individuals.
d. Prior to direct contact:
1. Maltreatment of minors reporting requirements;
2. Emergency overdose treatment; and
3. The license holder’s drug and alcohol policy.
Statute Violated: Minnesota Statutes, sections 245A.04, subdivision 1, paragraph (c); 245A.19, paragraph (b); 245A.65, subdivision 3; 245G.08, subdivision 3; 245G.13, subdivisions 1, (7); 2, paragraphs (d) and (e).
Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure orientation training meets all applicable requirements. Within 30 days of receipt of this order, submit documentation that demonstrates compliance for SP1. 2. Violation: One personnel file was reviewed for requirements governing staff development (SP1) and did not meet requirements. The file did not contain documentation of the following:
a. Annual training to the following:
1. Maltreatment of vulnerable adults in calendar year 2024;
2. Program abuse prevention plan in calendar years 2024 and 2025;
3. Internal policies and procedures related to the prevention and reporting of maltreatment of individuals receiving services in calendar years 2024 and 2025;
4. Maltreatment of minors reporting in calendar years 2024 and 2025;
5. License holder’s policies for obtaining a release of client information in calendar years 2024 and 2025; and
6. HIV minimum standards in calendar year 2024;
b. Every two year training in calendar year 2025 on:
1. Client confidentiality rules and regulations and client ethical boundaries; and
2. Emergency procedures and client rights.
Statute Violated: Minnesota Statutes, sections 245A.65, subdivision 3; 245G.13, subdivision 2, paragraphs (b) through (e).
Repeat Violation: In a Correction Order that DHS issued on April 11, 2025, you were previously found in violation of this same statute.
Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure staff development meets all applicable requirements. Within 30 days of receipt of this order, submit documentation that demonstrates compliance for SP1.
Written Response Required
If you fail to correct the violation(s) specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
