December 16, 2025 Julius Cochran, Authorized Agent New Generations 1500 69th Avenue North Brooklyn Center, Minnesota 55430 License Number: 1098578 (245D – HCBS) CORRECTION ORDER Dear Julius Cochran: On December 3 and December 4, 2025, a licensing review of New Generations, located at 1500 69th Avenue North Brooklyn Center, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245A.65, subdivision 2. Violation: For one of five persons whose record was reviewed (P3), the license holder did not develop individual abuse prevention plan (IAPP) as required. The license holder did not develop an IAPP for P3 as part of the initial program plan. The license holder initiated P3’s services on September 18, 2025, and developed the IAPP on October 31, 2025. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.04, subdivision 1. Violation: For one person whose record was reviewed (P4), the license holder did not provide service recipient rights as required. The license holder did not provide P4 with a written notice that identified the service recipient rights and an explanation of those rights within five working days of service initiation. The license holder initiated P4’s services on August 5, 2025, and provided P4 with a written notice on November 6, 2025. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.07, subdivision 1. Violation: For one person whose record was reviewed (P4), the license holder did not provide services in compliance with the requirements of this chapter and the federal waiver plans. The license holder provided employment support services to P4. The license holder maintained log notes that documented staff completed errands for P4 without P4 present and provided cleaning services to P4. These are not covered services for the provision of services for employment support services as defined by the Community-Based Service Manual (CBSM). The license holder did not provide services in compliance with the requirements of this chapter and the federal waiver plans. Corrective Action Ordered: Immediately upon receiving this order, you must provide services according to the federal waiver plans and CBSM. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraph b. Violation: For one person whose record was reviewed (P4), the license holder did not complete assessments as required. The license holder did not complete assessments for P4 before providing 45 days of service or within 60 calendar days of service initiation. The license holder initiated P4’s services on August 5, 2025, and completed P4’s assessments on May 19, 2025. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. 5. Citation: Minnesota Statutes, section 245D.071, subdivisions 3 and 5. Violation: For two persons whose records were reviewed (P2 and P3), the license holder did not complete initial service planning and review for intensive services as required. Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year. a. The license holder did not have a discussion of how technology might be used to meet P2’s outcomes at least once per year in 2024. b. The license holder did not have a discussion at the initial planning meeting of how technology might be used to meet P3’s desired outcomes. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must meet with P2 and their support team and P3 and their support team to discuss how technology might be used to meet P2’s and P3’s desired outcomes and document the summary of this discussion. The summary must include a statement regarding any decision that is made regarding the use of technology and a description of any further research that needs to be completed before a decision regarding the use of technology can be made. On an ongoing basis, you must maintain compliance as required in this subdivision. 6. Citation: Minnesota Statutes, section 245D.071, subdivision 4. Violation: For four persons whose records were reviewed (P1-P4), the license holder did not document service outcomes and supports as required. a. The license holder did not document for P1’s outcome the date by which progress towards accomplishing the outcomes would be reviewed and evaluated. b. The license holder did not document the following supports and methods for P2 and P3 to accomplish their outcomes: · the measurable and observable criteria for identifying when the desired outcome has been achieved; and · the date by which progress towards accomplishing the outcomes will be reviewed and evaluated. c. The license holder did not document the following supports and methods for P4 to accomplish their outcomes: · the methods or actions that will be used to support the person and to accomplish the service outcomes, including information about: o any changes or modifications to the physical and social environments necessary when the service supports are provided; o any equipment and materials required; and o techniques that are consistent with the person's communication mode and learning style. · how data will be collected; and · the date by which progress towards accomplishing the outcomes will be reviewed and evaluated. Additionally, the license holder did not develop service outcomes and supports for P4 within ten working days of P4’s initial planning meeting. The license holder held P4’s initial planning meeting on November 6, 2025, and developed P4’s outcomes on May 19, 2025, prior to the initiation of P4’s services on August 5, 2025. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must: · develop supports and methods for P1’s-P4’s desired outcomes including the information detailed above; · submit to and obtained dated signatures from P1-P4 and P1’s-P4’s case managers for approval; · provide training on P1’s-P4’s documented supports and methods to all staff who provide direct support services to P1-P4; and · implement the supports and methods for P1’s-P4’s desired outcomes and track data related to their outcomes. On an ongoing basis, you must maintain compliance as required in this subdivision. 7. Citation: Minnesota Statutes, section 245D.09, subdivision 4. Violation: For one of four staff persons whose record was reviewed (SP4), the license holder did not provide orientation training as required. The license holder did not provide SP4 with orientation to the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint within 60 days of hire. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP4 with orientation on the information detailed above. On an ongoing basis, you must maintain compliance as required in this subdivision. 8. Citation: Minnesota Statutes, section 245D.081, subdivisions 2 and 3. Violation: The license holder did not fulfill the responsibility for program management and oversight as required. The license holder did not ensure the designated manager took corrective action when ordered by the commissioner. The commissioner issued a correction order to the license holder on August 5, 2025, and was ordered to take corrective action for 12 citations. The license holder did not complete the corrective action ordered for citation numbers 10 and 11. The license holder did not complete the corrective action ordered within the ordered timelines for citation numbers 2 and 14. Repeat Violation: In a Correction Order that DHS issued on August 5, 2025, you were previously found in violation of this same statute. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision. If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
