Dear Jody Miller:
CORRECTION ORDER
An investigation of Lutheran Social Services Gateway/ Lutheran Social Services of Minnesota was completed regarding report number 202507973 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Three violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07. 1. Citation: Minnesota Statutes, section 245D.05, subdivision 1, paragraph (a).
Violation: The license holder was responsible for promptly notifying a client’s (C) legal representative and case manager of changes in his/her physical and mental health needs.
The license holder did not notify the C’s guardian or case manager as required when staff persons observed an ulcer on the C. Information obtained showed that the C developed an ulcer approximately one week prior to August 30, 2025. The C’s guardian stated s/he was not notified until the C was brought to the emergency room on August 30, 2025, and the C’s case manager stated s/he was not notified until October 6, 2025. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statutes, section 245D.05, subdivision 2, paragraph (c), clause (6).
Violation: The license holder must ensure notation in the C’s medication administration record of when a medication or treatment is started, administered, changed, and/or discontinued.
Information obtained showed that approximately one week prior to August 30, 2025, when the C’s ulcer was first noticed, staff persons applied cream and bandages over it and repositioned the VA “more often” when in bed and continued this for approximately one week. The license holder did not have documentation regarding the treatment for the C’s ulcer. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.
3. Citation: Minnesota Statutes, section 245D.095, subdivision 3, paragraph (b), clause (3).
Violation: The license holder must maintain health information when assigned responsibility for meeting the C’s health service needs.
The C’s Intensive Support Self-Management Assessment showed that the facility was responsible for the C’s health service needs yet the facility did not have documentation of the C’s ulcer or the care provided to the C’s ulcer in the C’s file. Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
