CORRECTION ORDER

An investigation of CSS Dakota Crisis was completed regarding report number 202509062 which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned physical abuse. The disposition of the investigation report is inconclusive. Two violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1. Citation: Minnesota Statutes, section 245D.061, subdivision 4.

Violation: The license holder did not complete a monitoring form, approved by the commissioner, for an incident with one client (C) involving an emergency use of manual restraint that occurred on September 27, 2025, as required.

The license holder did not complete a monitoring form, until November 17, 2025, for an incident involving the emergency use of manual restraint the C that occurred on September 27, 2025.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Statutes, section 245D.061, subdivision 5.

Violation: The license holder did not report the emergency use of manual restraint (EUMR) incidents as required.

The license holder did not ensure the staff persons (P1 and P2) who implemented the emergency use restraint reported the following information about the emergency use, in writing, to the designated coordinator within three calendar days after the implementation of an EUMR with the C on September 27, 2025:

· the staff and persons receiving services who were involved in the incident leading up to the emergency use of manual restraint;

· a description of the physical and social environment, including who was present before and during the incident leading up to the emergency use of manual restraint;

· a description of the mental, physical, and emotional condition of the person who was restrained, and other persons involved in the incident leading up to, during, and following the manual restraint;

· whether there was any injury to the person who was restrained or other persons involved in the incident, including staff, before or as a result of the use of manual restraint;

· a description of what less restrictive alternative measures were attempted to de-escalate the incident and maintain safety before the manual restraint was implemented that identifies when, how, and how long the alternative measures were attempted before manual restraint was implemented; and

· whether there was a debriefing with the staff, and, if not contraindicated, with the person who was restrained and other persons who were involved in or who witnessed the restraint, following the incident and the outcome of the debriefing, or, if the debriefing had not been conducted at the time the incident report was made, the report should have identified whether a debriefing was planned; and

· a copy of the report must be maintained in the person's service recipient record.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
