CORRECTION ORDER

Dear Hussein-Wali Mohamed:

On December 15, 2025, a licensing review of Minnesota Care Counseling Services Inc, located at 651 Taft Street Northeast Minneapolis, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Minnesota Rule, 9544.0030, subpart 1.

Violation: For two of eight persons whose records were reviewed (P4 and P5), the license holder did not evaluate positive support strategies as required.

The license holder did not evaluate the identified positive support strategies with P4 and P5 at least every 6 months. The license holder reviewed P4’s positive support strategies in March 2025 and again in October 2025. The license holder reviewed P5’s positive support strategies in August 2024 and again in September 2025.

Corrective Action Ordered: This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Rules 9544.0100, subpart 1.

Violation: For one person whose record was reviewed (P4), the license holder did not maintain documentation and record keeping as required.

The license holder was assigned and developed an outcome for P4 on December 24, 2024. The license holder did not maintain appropriate data that:

· revealed the progress or lack of progress towards each outcome or goal for P4;

· ensured that staff are accountable for the services provided to P4; and

· ensured that the service can be evaluated and monitored by the commissioner.

The license holder did not collect data between December 2024 and October 2025.

Corrective Action Ordered: This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

3. Citation: Minnesota Rules, part 9544.0110.

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not report the use of restrictive interventions and incidents as required.

The license holder did not use the behavior intervention reporting form required by the commissioner to report a behavior incident that resulted in a call to 911 that occurred with P1 on May 13, 2025, and with P2 on August 4, 2023, and August 29, 2023.

Corrective Action Ordered: Within 60 days of receiving this order, you must use the behavior intervention report form required by the commissioner to report the above mentioned incidents regarding P1 and P2. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

4. Citation: Minnesota Statutes, section 245A.65, subdivision 1.

Violation: For one person whose record was reviewed (P5), the license holder did not enforce maltreatment of vulnerable adults as required.

The license holder did not provide P5 with orientation to the internal and external reporting of maltreatment of a vulnerable adult policies and procedures and to the program abuse prevention plan within 24 hours of admission to the program. The license holder initiated services with P5 on July 1, 2024, and maintained documentation that P5 received these orientations on August 22, 2024.

Corrective Action Ordered: This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota Statutes, section 245D.04, subdivision 1.

Violation: For two persons whose records were reviewed (P2 and P5), the license holder did not provide service recipient rights as required.

“Annual” or “Annually” means prior to or withing the same month of the subsequent calendar year.

The license holder did not provide P2, P2’s legal representative, and P5 with a written notice that identified the service recipient rights within five working days of service initiation. The license holder initiated a new service to P2 on January 16, 2024. The license holder provided the service recipient rights to P2 and P2’s legal representative in December 2024. The license holder initiated services with P5 on July 1, 2024. The license holder provided the service recipient rights to P5 on August 22, 2024.

Additionally, at the time of this review, the license holder had not provided P5 with their 2025 annual notice that identifies the service recipient rights and an explanation of those rights.

Corrective Action Ordered: Within 60 days of receiving this order you must provide P5 with a written notice that identifies service recipient rights and an explanation of those rights and maintain documentation according to Minnesota Statutes 245D.095. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

6. Citation: Minnesota Statutes, section 245D.04, subdivision 3.

Violation: For one person whose record was reviewed (P1), the license holder did not ensure the exercise and protection of rights as required.

The license holder did not ensure the exercise and protection of P1’s right to engage in chosen activities. The license holder documented a rights restriction that P1’s schedule would be created by the license holder and P1’s team, and all changes to the schedule would need to be approved by P1’s team 72 hours in advance.

Corrective Action Ordered: Immediately upon receiving this order, you must restore P1’s right to engage in chosen activities. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

7. Citation: Minnesota Statutes, section 245D.05, subdivision 1.

Violation: For one person whose record was reviewed (P1), the license holder did not meet health service needs as required.

The license holder was assigned responsibility for administering P1’s prescribed psychotropic PRN medications. The license holder did not maintain documentation on how P1’s health needs would be met, including a description of the procedures the license holder would follow in order to safely administer the psychotropic PRN medications.

Corrective Action Ordered: Within 60 days of receiving this order, you must:

· review and revise P1’s support plan addendum to include documentation on how P1’s health needs will be met as described above;

· review and obtain approval of P1’s revised support plan addendum with P1, P1’s guardian, and case manager;

· provide training to the staff who provide direct support to P1 on the revised plan; and

· maintain documentation in accordance with Minnesota Statutes 245D.095.

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

8. Citation: Minnesota Statutes, sections 245D.05, subdivision 4.

Violation: For three persons whose records were reviewed (P1, P2, and P6), the license holder did not review and report medication administration errors as required.

a. The license holder was responsible for medication administration for P1. The license holder did not complete an accurate medication administration record (MAR) review for the months of June 2025 through August 2025. During the licensing review, the DHS licensor identified on P1’s MAR’s that P1 consistently refused two medications during this timeframe; however, the license holder did not identify the errors on the corresponding MAR review.

b. The license holder was responsible for medication administration for P2. The license holder did not conduct MAR reviews at a minimum of every three months. The license holder administered medication to P2 from June 16, 2023, through November 3, 2025. The license holder completed MAR reviews for P2 on September 15, 2025, and December 5, 2025.

c. The license holder was responsible for medication administration for P6. The license holder conducted a MAR review for P6 on September 15, 2025. The license holder identified a pattern of medication administration errors; however, the license holder did not implement a plan to correct patterns of medication administration errors. A subsequent MAR review conducted by the license holder on December 15, 2025, reflected the same pattern of errors. The license holder did not develop and implement a plan to correct the errors in this MAR review dated December 15, 2025.

Additionally, the license holder did not report multiple medication refusals or failures to take or receive medication and treatments as prescribed to P1’s, P2’s, and P6’s legal representative and case manager as they occurred.

Corrective Action Ordered: Within 60 days of receiving this order, you must develop and implement a plan to correct the pattern of medication administration errors for P6 and maintain documentation according to Minnesota Statutes 245D.095. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

9. Citation: Minnesota Statutes, section 245D.051, subdivision 1.

Violation: For four persons whose record were reviewed (P1, P2, P3, and P6), the license holder did not develop documentation regarding psychotropic medications as required.

"Target symptom" refers to any perceptible diagnostic criteria for a person's diagnosed mental disorder, as defined by the Diagnostic and Statistical Manual of Mental Disorders Fourth Edition Text Revision (DSM-IV-TR) or successive editions, that has been identified for alleviation.

The license holder was assigned responsibility for medication administration for P1, P2, P3, and P6, including psychotropic medications. The license holder did not document a description of the target symptoms that each psychotropic medication was to alleviate for P1, P2, P3 and P6.

Corrective Action Ordered: Within 60 days of receiving this order, you must:

· maintain documentation in P1’s, P3’s and P6’s support plan addendum that includes a description of the target symptoms that each psychotropic medication is to alleviate;

· provide staff with training on the person’s updated support plan addendum; and

· maintain documentation according to Minnesota Statutes 245D.095.

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

10. Citation: Minnesota Statutes, sections 245D.06, subdivision 1.

Violation: For one person whose record was reviewed (P4), the license holder did not report a serious injury as required.

The license holder did not report a serious injury that occurred with P4 on May 8, 2025, to the Department of Human Services Licensing Division, and the Office of Ombudsman for Mental Health and Developmental Disabilities as required under section 245.94, subdivision 2a, as required.

Corrective Action Ordered: Within 60 days of receiving this order, you must report the serious injury to the Department of Human Services Licensing Division, and the Office of Ombudsman for Mental Health and Developmental Disabilities. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

11. Citation: Minnesota Statutes, section 245D.07, subdivision 1.

Violation: For three persons whose records were reviewed (P1, P2, and P6), the license holder did not comply with the requirements of the federal waiver plan as required.

The license holder maintained video cameras in the community residential settings (CRS) where P1, P2, and P6 resided and received services. The license holder stated these were used to monitor persons served and staff for incidents. The license holder did not receive approval for the use of the monitoring technology from the lead agency.

Corrective Action Ordered: Immediately upon receiving this order, you must receive approval for the use of monitoring technology from the lead agency and maintain documentation according to Minnesota Statutes 245D.095. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

12. Citation: Minnesota Statutes, section 245D.07, subdivision 2, paragraph (c).

Violation: For one person whose record was reviewed (P2), the license holder did not complete initial service planning for a basic service as required.

The license holder did not, within 60 calendar days of service initiation, review and revise P2’s preliminary support plan addendum to document the services that will be provided including how, when, and by whom services would be provided and the person responsible for overseeing the delivery and coordination of services.

Corrective Action Ordered: P2 is no longer receiving services therefore there is no corrective action. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

13. Citation: Minnesota Statutes, sections 245D.071, subdivision 3 and Minnesota Statues 245D.071, subdivision 5.

Violation: For two persons whose records were reviewed (P4 and P5), the license holder did not meet initial and ongoing service planning requirements for intensive support services as required.

a. The license holder did not have a discussion of how technology might be used to meet P4's desired outcomes, including a summary of this discussion, a statement regarding any decision that is made regarding the use of technology and a description of any further research that needed to be completed before a decision regarding the use of technology could be made at P4’s initial service planning meeting in 2024 and P4’s annual service plan and review meeting in 2025.

b. The license holder did not conduct assessments with P5 annually. The license holder completed P5’s assessment in August 2024 and September 2025.

Corrective Action Ordered: Within 60 days of receiving this order, you must:

· meet with P4, P4’s case manager, and other members of the support teams to have a discussion of how technology might be used to meet P4's desired outcomes, including a summary of this discussion, a statement regarding any decision that is made regarding the use of technology and a description of any further research that needs to be completed before a decision regarding the use of technology can be made;

· provide P4’s staff with training on P4’s updated support plan addendum; and

· maintain documentation in accordance with Minnesota Statutes 245D.095.

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

14. Citation: Minnesota Statutes, section 245D.10, subdivision 4.

Violation: For two persons whose records were reviewed (P2 and P5), the license holder did not provide policies and procedures as required.

The license holder did not inform and provide P2, P2’s legal representative, and P5 a copy of the policies and procedures affecting a person’s rights under section 245D.04 within five working days of service initiation.

Corrective Action Ordered: P2 is no longer receiving services. Within 60 days of receiving this order you P5 with the following policies and procedures affecting the person’s rights and maintain documentation of receipt in their service recipient record:

· grievance policy and procedure required under subdivision 2;

· service suspension and termination policy and procedure required under subdivision 3;

· emergency use of manual restraints policy and procedure required under section 245D.061, subdivision9, or successor provisions; and

· data privacy requirements under section 245D.11, subdivision 3.

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

15. Citation: Minnesota Statutes, section 245D.09, subdivision 4.

Violation: For two of four staff persons whose records were reviewed (SP1 and SP2), the license holder did not provide orientation training as required.

a. SP1 was hired on December 27, 2023. The license holder did not provide the following orientation to SP1 within 60 calendar days of hire:

· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices. The license holder provided SP1 with this training on January 13, 2025;

· the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04. The license holder provided SP1 with this training on Octboer 24, 2024;

· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person. The license holder provided SP1 with this training on January 6, 2025;

· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint. The license holder provided SP1 with this training on January 6, 2025;

· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe. The license holder provided SP1 with this training on January 6, 2025;

· basic first aid. The license holder provided SP1 with this training on December 10, 2025; and

· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities. The license holder provided SP1 with this training on January 13, 2025.

b. The license holder did not provide SP2 and SP3 with orientation training to basic first aid within 60 calendar days of hire.

Corrective Action Ordered: SP2 is no longer employed. Within 60 days of receiving this order you must provide SP3 with basic first aid training and maintain documentation according to Minnesota Statutes 245D.095. This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

16. Citation: Minnesota Statutes, section 245D.095, subdivision 5.

Violation: For three staff persons whose records were reviewed (SP1 – SP3), the license holder did not maintain personnel records as required.

a. The license holder did not maintain documentation in SP1’s and SP2’s personnel record that included the following information for multiple training topics:

· the number of hours per subject area; and

· the name of the trainer or instructor.

b. The license holder did not maintain documentation in SP3’s personnel record that included the following information for multiple training topics:

· the date the training was completed;

· the number of hours per subject area; and

· the name of the trainer or instructor.

Corrective Action Ordered: This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

17. Citation: Minnesota Statutes, section 245D.081, subdivision 2.

Violation: For one staff person whose record was reviewed (SP4), the license holder did not provide coordination and evaluation of individual service delivery as required.

The license holder designated SP4 to coordinate the delivery and evaluation of services provided by the license holder but did not verify and maintain documentation that SP4 was competent to perform the required duties of the designated coordinator identified in paragraph (a) through education, training, and work experience relevant to the primary disability of persons served by the license holder and the individual persons for whom the designated coordinator is responsible.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· designate a person other than SP4 be appointed as the designated coordinator, who is responsible for delivery and evaluation of services provided by the license holder.

· submit the name, contact information and qualifications of the person(s) you have designated and have ensured is competent to perform the duties of the designated coordinator as required in this section; and

· submit a signed acknowledgement that the newly designated person has reviewed and understands the responsibilities of a designated coordinator according to 245D.081, subdivision 2, paragraph (a).

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

18. Citation: Minnesota Statutes, section 245D.081, subdivision 3.

Violation: For one staff person whose record was reviewed (SP4), the license holder did not provide program management and oversight as required.

The license holder designated SP4 to provide program management and oversight of services provided by the license holder but did not ensure SP4 met the minimum education and training requirements identified in subdivision 2, paragraph (b), and had a minimum of three years of supervisory level experience in a program that provided care or education to vulnerable adults or children.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· designate a person, other than SP4 to be appointed as the designated manager, who is responsible for delivery and evaluation of services provided by the license holder.

· submit the name, contact information and qualifications of the persons(s) you have designated and ensured is competent to perform the duties of the designated manager as required in this section; and

· submit a signed acknowledgement that the newly designated person has reviewed and understands the responsibilities of designated manager according to 245D.081, subdivision 3, paragraph (a).

This compliance will be monitored on-site at an upcoming compliance monitoring visit. On an ongoing basis, you must maintain compliance as required in this subdivision.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:
