Dear Cassie Frey:
On June 25, 2025, the Minnesota Department of Children Youth and Family (DCYF), Division of Licensing, received your request for reconsideration regarding Citations 3 and 4 in the Correction Order (enclosed) issued to you on June 20, 2025. You did not request review for Citations 1 and 2 and therefore, Citations 1 and 2 are not under the scope of review.
Reconsideration Determination
Citation 3 Violation. All crib brand names and model numbers were not checked annually against the U.S. Consumer Product Safety Commission website listing of unsafe cribs.
Crib brand names and model numbers were not checked for cribs one through eight in 2024. (Infant Room 113: Infant classroom)
“Annual" or “annually” means prior to or within the same month of the subsequent calendar year.
Applicable Law. A license holder shall check all their cribs' brand names and model numbers against the United States Consumer Product Safety Commission website listing of unsafe cribs from the date printed on the license, annually. Minnesota Statutes, section 245A.146, subdivision 3(a).
The license holder shall maintain written documentation to be reviewed on site for each crib showing that the review required in paragraph (a) has been completed. Minnesota Statutes, section 245A.146, subdivision 3(b). "Annual" or "annually" means prior to or within the same month of the subsequent calendar year. Minnesota Statutes, section 245A.02, subd. 2c.
Your Response. You stated that all cribs are the same make and model, and staff checked the U.S. Consumer Product Safety Commissions website (CPSC.gov) on December 30, 2024, at
11 :14am. You acknowledged that staff “forgot to sign the bottom portion of each page (8 total) with the date and his/her name after completing the recall search.”
You also provided crib inspection forms with checks, a signature and date.
Reconsideration Determination. The licensor reviewed a screen shot print out of the annual crib inspection form. The licensor noted that the crib inspection form was not checked, signed or dated. You provided crib inspection forms that were executed after the site visit with your request for reconsideration. The crib inspection forms were not executed on the day of the site visit.
At the time of the site visit, the licensor could not confirm that you had checked your cribs' brand names and model numbers against the United States Consumer Product Safety Commission website listing of unsafe cribs inspection for the year. Therefore Citation 3 is affirmed.
Citation 4 Violation. The program did not provide the children access to interest areas on a daily basis. Children were not provided daily access to a creative arts and crafts interest area (Toddler Room 111).
Based on a conversation with a staff person, the DHS licensor determined that the toddlers were offered art experiences on Tuesday, Wednesday and Thursday, not daily. (Toddler Room 111: Toddler classroom)
Applicable Law. A child care program that operates for more than three hours a day must provide daily creative arts and crafts interest area supplies with equipment and materials needed to carry out activities. Minnesota Rules, part 9503.0045, subpart 2(A).
Your Response. You stated that you spoke with SP3, and SP3 was confused and “thought this was only about planned art projects that require preparation.” You clarified that “art projects are completed three days a week and the remaining days are open-ended, and the other two days are more open ended where we utilize play-doh, bingo dabbers, chalk outside, plain paper and markers/crayons.” You also attached a lesson plan for clarification.
Reconsideration Determination. The licensor observed that there were no art and crafts supplies and equipment in the Toddler room. The licensor asked a staff person (SP3), who was in the Toddler room, about the missing art and crafts supplies and equipment. SP3 told the licensor that art is scheduled for Tuesday, Wednesday and Thursday. Then SP3 showed the licensor the arts and crafts supplies and equipment in a locked cupboard.
You stated that children are offered some form of art every day and included a lesson plan. On the day of the site visit, regardless of the day or lesson plan, the licensor did not observe any art and crafts supplies and equipment available in the Toddler room. Therefore, Citation 4 is affirmed.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citations 3 and 4 are affirmed. You did not request review for Citations 1 and 2, therefore, Citations 4, 8 and 9 are not under the scope of review. This is a final agency decision.
Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited, and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
