Dear Steve Kerzman:

On June 25, 2025, the Minnesota Department of Children Youth and Families (DCYF), Division of Licensing, received your request for reconsideration regarding Citation 3 in the Correction Order (enclosed) issued to you on June 20, 2025. You did not request review for Citations 1, 2 and 4 and therefore, Citations 1, 2 and 4 are not under the scope of review.

Reconsideration Determination

Citation 3

Violation. The program did not comply with requirements for an allergy-related Individual Child Care Program Plan (ICCPP). Documentation was not available to show that staff persons reviewed an allergy-related ICCPP. There was no documentation available to show that 1 of 1 (SP14) staff persons had reviewed an allergy-related ICCPP for a child.

· Although one signature page was available to document staff persons review of all children's allergy ICCPPs, the signature page did not indicate which children's ICCPPs were reviewed. (SP14)

Applicable Law. The license holder must ensure that each staff person who is responsible for carrying out the individual child care program plan review and follow the plan. Documentation of a staff person’s review must be kept on sight. Minnesota Statutes, section 142B.66, subdivision 1, paragraph (b).

Your Response. You stated that you have a packet of children’s allergies that each staff person must review. The packet includes an individual child care program plan for each child, a signature page, a pack for allergies with each child’s name, date of birth, triggers, avoidance, procedures and response (TAP/R), and picture. You also submitted a picture of a binder containing nondescript ICCPP plans, a signature page with dates and a chart of child names, date of birth, allergy, TAP/R and picture.

Reconsideration Determination. The licensor reviewed your ICCPP documentation binder that contained one signature page (two pages in length) for all staff persons who may have reviewed the ICCPPs contained in the binder. The licensor noted that the signature page was not attached to a specific ICCPP. The licensor could not determine if the staff persons who signed the signature page had reviewed each ICCPP in the binder.

Your ICCPP binder system with one signature page did not ensure that each staff person who is responsible for carrying out the ICCPP for each child listed in the binder had reviewed and knows how to follow each child’s individual ICCPP. Your documentation did not demonstrate that each staff person responsible for carrying out an ICCPP had reviewed the respective ICCPP for each child in the binder. Therefore Citation 3 is affirmed.

Disposition

The Commissioner has reviewed the relevant laws and all the information you submitted in

response to the Correction Order. Citations 3 is affirmed. You did not request review for Citations 1, 2 and 4, therefore Citations 1,2 and 4 are not under the scope of review. This is a final agency decision.

Previously Ordered Corrective Action. In the original Correction Order, you were ordered to correct the violation(s) cited and submit documentation of such action to your licensor. A request for reconsideration does not stay any provisions or requirements of the correction order. Minnesota Statutes, 142B.16, subdivision 2, paragraph (a). If you have not done so already, please immediately comply with the previously ordered corrective actions for all uncontested and affirmed violations.
