CORRECTION ORDER

Dear Daniel Pfarr:

A licensing investigation of 180 Degrees Rochester,  was

conducted to determine compliance with state and federal laws and rules governing the provision of children’s residential facilities under Minnesota Rules, parts 2960.0010 through 2960.0120, children's group residential facilities under Minnesota Rules, parts 2960.0130 through 2960.0220, and children's residential shelter program under Minnesota Rules, 2960.0510 through 2960.0530. As a result of this licensing investigation a Correction Order is being issued.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Resident Files

1. Citation: Minnesota Statutes, section 245A.04, subdivision 14, Minnesota Rule, part 2960.0050, subpart 1, item D.

Violation: The license holder failed to provide positive and proactive adult supervision while two residents (R1 and R2) were on a group fieldtrip at the Rochester Athletic Club and while being transported in the company van in August 2021. As a result, a critical incident occurred. In addition, the license holder failed to develop program policies and procedures regarding staff supervision.

Corrective Action Ordered: Immediately and on an ongoing basis, the license holder must ensure to provide supervision that meets all applicable requirements. Within 30 days receipt of this order, submit a policy that provides adequate direction to staff regarding their supervision responsibilities.

2. Citation: Minnesota Rule, part 2960.0520, subpart 2, item A.

Violation: The license holder failed to meet requirements regarding risk reduction plans in the following ways:

a. A risk reduction plan was not created during the residents time in the shelter (R1 and R2); and

b. During an investigative interview with an administrative staff person on May 25, 2022, a DHS Licensor obtained information that the program was not aware of the requirement regarding risk reduction plans. They stated that none of the individuals currently being served have a risk reduction plan.

Corrective Action Ordered: Immediately and on an ongoing basis, the license holder must ensure that risk reduction plans meet all applicable requirements. Within 30 days receipt of this order, submit a policy regarding risk reduction plans.

If you fail to correct the violations specified in the Correction Order within the prescribed timelines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

YOUR RIGHT TO REQUEST RECONSIDERATION

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
