CORRECTION ORDER

An investigation of Minnesota Community Based Services was completed regarding report number 202500903, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned physical abuse. The disposition of the investigation report is inconclusive. Two violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules was observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1.  Citation: Minnesota Statutes 245D.061, subdivision 8

Violation: The license holder did not report within five working days the use of an emergency use of manual restraint to the Department of Human Services and the Office of the Ombudsman for Mental Health and Developmental Disabilities.

Information was provided that on January 30, 2025, staff implemented two emergency uses of manual restraints with a client (C1), which were not reported.

Corrective Action Ordered: On an ongoing basis you must maintain compliance as required in this subdivision.

2.  Citation: Minnesota Statutes 245D.061, subdivision 2

Violation: The license holder did not ensure all emergency uses of manual restraints met the condition that an immediate intervention was needed to protect the person or others from imminent risk of physical harm.

Information was provided that “sometimes” staff used a “restraint” when there was “a lot of property destruction” with no information that an immediate intervention was needed to protect the person or others from imminent risk of physical harm.

The facility’s incident report for January 30, 2025, stated that C1 “ripped [a] door sensor off and threw it at staff” and “ripped off a piece of the wall to hit staff with it.” “Staff administered EUMR that lasted for one minute.” There was no information regarding C1’s conduct posing an imminent risk of physical harm.

Regarding the same incident on January 30, 2025, a staff person told the DHS investigator that C1 was trying to leave through the door outside and so staff implemented an EUMR. The staff person did not provide any information regarding C1’s conduct posing an imminent risk of physical harm.

Corrective Action Ordered: On an ongoing basis you must maintain compliance as required in this subdivision.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
