CORRECTION ORDER

Dear Asha,

On January 7, 2026, a Department of Human Services (DHS) licensor conducted a licensing review at your facility, Addiction Counseling Center, located at 1433 E Franklin Ave STE 7A 7B, Minneapolis, MN 55404. This review was conducted to determine compliance with state and federal laws and rules governing the provision of substance use disorder treatment under Minnesota Statute, chapter 245G. As a result, DHS is issuing this order which requires you to take the correction action as described under each violation. Details of our findings are provided below. Our next steps and your options are also detailed.

LICENSING VIOLATIONS

DHS determined that your program failed to follow licensing rules and statutes, as described below.

Policies, Procedures, and Practices

1. Violation: The license holder did not meet requirements for receiving public funding reimbursements from the commissioner for services provided. Services were billed; however, not provided as follows:

a. The program billed for group treatment services on the following dates; however, there was no supporting documentation in the client file:

i. September 23, 25 and 30, 2025, and October 14, 16, 17, 21, 23, and 24, 2025 (client file numbered 2); and

ii. October 14, 15, 16, 17, 21, 22, 23, 28, 29, and 30, 2025, and November 4, 5, and 6, 2025 (client file numbered 3).

Statute Violated: Minnesota statutes, section 245A.167

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure and document that services are provided in the amount and type for which they were billed. Additionally, the noncompliance identified above may result in nonpayment of claims submitted by the license holder for public program reimbursement; recovery of payments made for the service; disenrollment in the public payment program; or other administrative, civil, or criminal penalties as provided by law.

Client Files

2. Violation: Three of three client files reviewed for requirements governing initial service plans (ISP) did not meet requirements in the following ways:

a. The ISP was not person-centered and client specific (client files numbered 1 and 3); and

b. The ISP did not identify treatment needs to be addressed during the time between the day of service initiation and development of the individual treatment plan (client files numbered 1, 2, and 3).

Statute Violated: Minnesota statutes, section 245G.04, subdivision 1.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that initial service plans meet all applicable requirements. Within 30 days of receipt of this order, submit an initial service plan that demonstrates compliance.

3. Violation: Three of three client files reviewed for requirements governing comprehensive assessments (CA) did not meet requirements in the following ways:

c. A review and update of the CA as clinically necessary to ensure compliance with Minnesota Statutes, section 245G.05 subdivision 1 by the end of the fifth day on which a treatment service was provided was not documented (client files numbered 2 and 3); and

d. The CA did not include the following information (client file numbered 1):

i. Client’s housing status and household members;

ii. Status of the client’s basic needs;

iii. Client’s history of mental health treatment;

iv. Substance use history including amount;

v. Client’s relationship with the client’s family and other significant personal relationships, including client’s evaluation of each relationship;

vi. Maltreatment, trauma, potential brain injuries, and abuse the client has suffered; and

vii. Client’s exposure to alcohol and drug usage and treatment.

Statute Violated: Minnesota statutes, section 245G.05, subdivisions 1, paragraph (c) and 3.

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that comprehensive assessments meet all applicable requirements. Within 30 days of receipt of this order, submit a comprehensive assessment that demonstrates compliance.

4. Violation: Three of three client files reviewed for requirements governing individual treatment plans (ITP) did not meet requirements. There was no documentation of the following:

e. How the family or others will be involved in the client’s treatment or the reasons why the license holder did not involve the client’s family or other natural supports (client files numbered 1 and 3);

f. A treatment strategy (client files numbered 2 and 3); and

g. The ASAM level of care under which the client is receiving services (client files numbered 1, 2, and 3).

Statute Violated: Minnesota statutes, section 245G.06, subdivision 1a, paragraph (a), clauses (2) through (5).

Corrective Action Required: Immediately and on an ongoing basis, the license holder must ensure that individual treatment plans meet all applicable requirements. Within 30 days of receipt of this order, submit an individual treatment plan that demonstrates compliance.

5. Violation: Three of three client files reviewed for requirements governing documentation of treatment services did not meet requirements in the following ways:

a. Entry did not include the amount of treatment service provided to the client on December 9, 2025 (client file numbered 1);

b. Entries were not accurate as follows:

i. Treatment coordination was documented as individual counseling on November 4 and 5, 2025 (client file numbered 3); and

ii. Discharge summaries identified the client was provided treatment coordination; however, there was no documentation of treatment coordination in the client chart (client file numbered 2); and

c. Entries were not signed by the staff member making the entry:

i. September 17, 2025 (client file numbered 2); and

ii. November 6, 2025 (client file numbered 3).

Statute Violated: Minnesota statutes, section 245G.06, subdivisions 2a and 2b, paragraph (c).

Corrective Action: Immediately and on an ongoing basis, the license holder must ensure that documentation of treatment services meet all applicable requirements.

Written Response Required

If you fail to correct the violation(s) specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

You have the right to request reconsideration of this order and the cited violations. Your request must:

· Be in writing

· List each violation you are challenging and identify what is inaccurate or incomplete about the information in the order

· Supply information that is accurate or more complete

· Be made before the deadlines provided below

If you are mailing your request, it must be received by DHS within 20 calendar days from when you received this order. If you do not meet this deadline, you lose your right to request reconsideration. The timeline to appeal began when you received this order. Please send it to:
