CORRECTION ORDER
An investigation of Accord was completed regarding report number 202511455, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is inconclusive. Two violations were noted.
VIOLATIONS AND CORRECTION ORDERS
The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.
1. Citation: Minnesota Statutes section 245D.07, subdivision 1a, paragraph (a)
Violation: The license holder did not provide services in response to a person’s identified needs.
For one person (P1), the license holder was to provide a live-in staff caregiver (S1) for 24/7 supervision and 1:1 staffing. If S1 needed time off, the facility provided a second staff person for respite care services. On December 5, 2025, S1 left P1 unsupervised for at least three hours with a community person, who was not a trained staff person.
Corrective Action Ordered: On an ongoing basis you must maintain compliance as required in this subdivision.
2. Citation: Minnesota Statues, Section 245D.081, subdivision 2
Violation: The license holder did not ensure that the service delivery for each person was coordinated by a designated staff person as required.
The license holder’s designated coordinator did not provide the oversight to ensure that the license holder’s responsibilities regarding the supervision as assigned in P1’s support plan and support plan addendum were being provided.
Corrective Action Ordered: Within 30 days of receiving this order, the license holder must ensure that the designated staff person review the duties for this staff person as defined in 245D.081, subdivision 2.
If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
