CORRECTION ORDER
Dear Hodan Esse:
On November 13, 2025, a licensing review and licensing complaint investigation of Wicare Home Care LLC, located at 2104 Park Avenue Suite 104 Minneapolis, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review and licensing complaint investigation a Correction Order is being issued.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes, section 245A.65, subdivision 2.
Violation: For one of one person whose record was reviewed (P1), the license holder did not develop an individual abuse prevention plan (IAPP) as required.
The license holder did not accurately assess P1’s susceptibility to sexual abuse by other individuals. The IAPP the license holder developed for P1 identified that P1 was not susceptible to sexual abuse by other individuals. This assessment was inconsistent with other information provided by the license holder. Additionally, the license holder did not document the review of P1’s IAPP at least annually in 2025.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· review and revise, if needed, P1’s IAPP with P1 and P1’s case manager;
· revise P1’s IAPP to reflect the results of this review;
· document the review of P1’s IAPP with P1’s interdisciplinary team; and
· maintain documentation of this review in P1’s service recipient record.
On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.04, subdivision 1.
Violation: For one person whose records were reviewed (P1), the license holder did not provide a written notice of service recipient rights as required. Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year. The license holder did not provide P1 with a written notice that identified the service recipient rights and an explanation of those rights annually. The license holder most recently provided P1 with a written notice on October 6, 2024. Corrective Action Ordered: Within 30 days of receiving this order, you must provide P1 with a written notice identifying the service recipient rights and an explanation of those rights. You must maintain documentation of P1 receipt of a copy and an explanation of the rights in P1’s service recipient record. On an ongoing basis, you must maintain compliance as required in this subdivision. 3. Citation: Minnesota Statutes, section 245D.04, subdivision 2, and subdivision 3, paragraph (a).
Violation: For one person whose record was reviewed (P1), the license holder did not ensure the exercise and protection of rights as required. The license holder did not ensure the exercise and protection of the following rights for P1: · have services and supports identified in the support plan and the support plan addendum provided in a manner that respects and takes into consideration the person's preferences according to the requirements in sections 245D.07 and 245D.071; and
· receive services in a clean and safe environment when the license holder is the owner, lessor, or tenant of the service site.
Corrective Action Ordered: Within 30 days of receiving this order you must submit a plan to your licensor on how you will ensure the protection of these rights for all persons you serve under this license. On an ongoing basis, you must maintain compliance as required in this subdivision. 4. Citation: Minnesota Statutes, section 245D.071, subdivision 3.
Violation: For one person whose record was reviewed (P1), the license holder did not complete assessments for intensive support services as required.
The license holder did not complete assessments for P1 in the following areas at least annually in 2025. The license holder most recently completed these assessments for P1 on October 6, 2024: · the person's ability to self-manage health and medical needs to maintain or improve physical, mental, and emotional well-being, including, when applicable, allergies, seizures, choking, special dietary needs, chronic medical conditions, self-administration of medication or treatment orders, preventative screening, and medical and dental appointments;
· the person's ability to self-manage personal safety to avoid injury or accident in the service setting, including, when applicable, risk of falling, mobility, regulating water temperature, community survival skills, water safety skills, and sensory disabilities; and
· the person's ability to self-manage symptoms or behavior that may otherwise result in an incident as defined in section 245D.02, subdivision 11, clauses (4) to (7), suspension or termination of services by the license holder, or other symptoms or behaviors that may jeopardize the health and welfare of the person or others.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· complete assessments for P1 in the above-mentioned areas;
· provide the results of the assessments to P1’s support team or expanded support team for review; and
· maintain documentation of the assessments, and the support team or expanded support team review in P1’s service recipient record.
On an ongoing basis, you must maintain compliance as required in this subdivision.
5. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraph (c), and subdivision 5, paragraph (a).
Violation: For one person whose record was reviewed (P1), the license holder did not meet service planning and delivery requirements for intensive support services.
The license holder did not involve P1’s case manager in P1’s initial service planning meeting the license holder held on October 6, 2024. Additionally, the license holder did not participate in a service plan review and evaluation meetings for P1 on an annual basis. P1’s support plan addendum required annual meetings and the license holder most recently participated in a meeting for P1 on October 6, 2024.
Corrective Action Ordered: Within 30 days of receiving this order, you must hold a service plan review and evaluation meeting with P1, P1’s case manager, and members of P1’s support team. You must document what was determined at the meeting, the date the meeting was held, and who attended the meeting in P1’s service recipient record. On an ongoing basis, you must maintain compliance as required in this subdivision.
6. Citation: Minnesota Statutes, section 245D.10, subdivision 4.
Violation: For one person whose record was reviewed (P1), the license holder did not provide written or electronic copies of policies and procedures as required.
The license holder did not inform and provide copies of the following policies and procedures affecting a person’s rights to P1’s case manager within five working days of P1’s service initiation: · grievance policy and procedure;
· service suspension and termination policy and procedure;
· emergency use of manual restraints policy and procedure; and
· data privacy requirements.
Corrective Action Ordered: Within 30 days of receiving this order, you must:
· inform and provide copies of the above-mentioned policies and procedures to P1’s case manager; and
· maintain documentation that the above-mentioned policies and procedures were provided to P1’s case manager in P1’s service recipient record.
On an ongoing basis, you must maintain compliance as required in this subdivision.
7. Citation: Minnesota Rules, part 9544.0030, subpart 1.
Violation: For one person whose record was reviewed (P1), the license holder did not develop and evaluate positive support strategies as required.
The license holder did not incorporate positive support strategies in writing to an existing service plan for P1.
Corrective Action Ordered: Within 30 days of receiving this order, you must: · assess P1’s strengths, needs, and preferences to identify and create positive support strategies; and · incorporate the positive support strategies into P1’s existing treatment, service, or other individual plans. Additionally, at least every six months, you must evaluate with the person whether the identified positive support strategies currently meet the standards in subpart 2. Based upon the results of the evaluation, you must determine whether changes are needed in the positive support strategies used, and, if so, make appropriate changes. On an ongoing basis, you must maintain compliance as required in this subdivision. 8. Citation: Minnesota Statutes, section 245D.09, subdivision 4.
Violation: For one of one staff person whose record was reviewed (SP1), the license holder did not provide orientation training as required.
The license holder did not provide orientation training to SP1 on strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities within 60 calendar days of hire.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 with the above-mentioned training and maintain documentation of this training in SP1’s personnel record. On an ongoing basis, you must maintain compliance as required in this subdivision.
9. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.
Violation: For one staff person whose record was reviewed (SP1), the license holder did not provide training to individual service recipient needs as required.
The license holder did not provide SP1 with a review of and instruction on the person's support plan or support plan addendum as it relates to the responsibilities assigned to the license holder, and the person's individual abuse prevention plan, to achieve and demonstrate an understanding of the person as a unique individual, and how to implement those plans prior to SP1 having unsupervised direct contact with a person served by the program on November 8, 2024.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 with the above-mentioned training and maintain documentation of this training in SP1’s personnel record. On an ongoing basis, you must maintain compliance as required in this subdivision.
10. Citation: Minnesota Statutes, section 245D.09, subdivision 5.
Violation: For one staff person whose record was reviewed (SP1), the license holder did not provide annual training as required.
The license holder did not provide annual training to SP1 on the following topics in 2025: · basic first aid; and
· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.
Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP1 with the above-mentioned training and maintain documentation of this training in SP1’s personnel record. On an ongoing basis, you must maintain compliance as required in this subdivision.
If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
