Dear Lewis Zeidner:
The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding violations 8, 9, and paragraph a of violation 3 in the Correction Order issued to you on February 17, 2026. After an independent review of the record, the Commissioner has determined it is appropriate to rescind violations 8, 9 and paragraph a of violation 3. The violations for which you did not request reconsideration are final and not within the scope of this review.
Reconsideration Determination
Violation 3: The license holder did not meet requirements governing grievance procedures. The grievance procedure did not meet requirements in the following ways: a. The policy did not contain current addresses for:
1) The Department of Human Services, Licensing Division;
2) The Office of Ombudsman for Mental Health and Developmental Disabilities; and
3) The Department of Health Facilities Complaints; and
b. Six of forty-four grievances did not have documentation that the license holder responded to the client’s grievance within three days of a staff member’s receipt of the grievance on the following dates:
July 26, 2025; August 24, 2025; September 16, 2025, October 18, 2025; and November 14 and 15, 2025.
Applicable Law
Under Minnesota Statutes, section 245G.15, subdivision 2, clause 2, requires the grievance procedure to require that current telephone numbers and addresses of the Department of Human Services, Licensing Division; the Office of the Ombudsman for Mental Health and Developmental Disabilities; the Department of Health Office of Health Facilities Complaints; and the Board of Behavioral Health and Therapy, when applicable, be made available to a client.
Your Response
You submitted a letter in which you indicated you believe paragraph a of the violation was incorrect, and you submitted supporting documentation. You did not challenge paragraph b.
Reconsideration Determination
After further review of the information contained in the file and the information you submitted, the Commissioner has determined it is appropriate to rescind the violation as to paragraph a.
Violation 8: One of eight personnel files reviewed for requirements governing staff orientation (personnel file numbered 2) did not meet requirements. There was no documentation that emergency overdose treatment training was completed before staff had direct contact with a person served by the program.
Applicable Law
Under Minnesota Statutes, section 245A.242, subdivision 2, paragraph (a), a license holder must require staff to undergo training in the specific mode of administration of opiate antagonists used at the program, which may include intranasal administration, intramuscular injection, or both, before the staff has direct contact with a person served by the program. Under Minnesota Statutes, section 245G.08, subdivision 3, a license holder must follow emergency overdose treatment requirements.

Violation 9: One of nine personnel files reviewed for requirements governing personnel file contents (personnel file numbered 9) did not meet requirements. An annual written job performance evaluation was not documented for calendar year 2025.
Applicable Law
Under Minnesota Statutes, section 245G.13, subdivision 1, clause (3), a license holder must have written personnel policies that are available to each staff member. The personnel policies must provide for a job performance evaluation based on standards of job performance conducted on a regular and continuing basis, including a written annual review.

After further review of the information contained in the file and the information you submitted, the Commissioner has determined it is appropriate to rescind the violation.
Disposition
The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Violations 8 and 9 are rescinded. Violation 3 only as to paragraph a is also rescinded. The violations for which you did not request reconsideration are affirmed. DHS will issue an Amended Correction Order. This is a final agency decision.
