Dear Michelle Newman:
An investigation of Pathways to Community was completed regarding report number 202600864, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned neglect. The disposition of the investigation report is substantiated. Two violations were noted.
A. Reason for Correction Order
Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.
The following violations of state or federal laws and rules were determined. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.
1. Citation: Minnesota Statutes section 245D.07, subdivision 1a, paragraph (a)
Violation: The license holder did not provide services in response to a client’s (C1) identified needs as specified in the support plan and the support plan addendum, and in compliance with the requirements of this chapter.
The license holder was to provide C1 with a 24/7 1:1 staff person. On January 27, 2026, the staff person (S1) responsible for C1’s supervision was sleeping.
Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this
subdivision.
2. Citation: Minnesota Statutes section 245D.05, subdivision 1, paragraph (b)
Violation: The license holder was responsible for meeting the health needs for C1 as assigned in their support plan and support plan addendum. The license holder did not monitor health conditions according to written instructions from a licensed health care professional.
On January 14, 2026, CI attended an appointment with a health professional who instructed the license holder to set an alarm and wake C1 each night at 12 or 1 AM to urinate to attempt to resolve their health condition. The license holder did not monitor or assist with this assigned health need per written instructions by a health professional.
Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this
subdivision.
If you do not correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.
