The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration of the citation issued in the Correction Order (Attachment A) issued to you by the Department of Human Services on February 15, 2024

The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding 1 of 18 citations in the Correction Order (Attachment A) issued to you on February 15, 2024. After an independent review of the record, the Commissioner has determined that there is sufficient evidence to support the citation.

Reconsideration Determination

Citation 17. This citation was issued because you failed to maintain service recipient records as required for five individuals. Specifically, you did not maintain progress or daily log notes in P3, P4, P5, P7 and P10’s service recipient record. Additionally, P3’s records lacked authorization for the license holder to act in a medical emergency when P3’s legal representative, if any, cannot be reached or is delayed in arriving.

Applicable Law. The license holder must maintain progress or daily log notes that are recorded by the program and a signed statement authorizing the license holder to act in a medical emergency when the perrons legal representative, if any, cannot be reached or is delayed in arriving. Minnesota Statutes, section 245D.095, subdivision 3.

Your Response. In your reconsideration request, you state P3, P5, and P7, receive basic support services rather than intensive support services. You assert that progress or daily log notes are therefore not required for these individuals because they receive basic support services.

Reconsideration Determination. The record keeping requirements of Minnesota Statutes, section 245D.095 applies to both basic and intensive services. Since you were providing basic support services, you were required to maintain progress or daily log notes. The record supports this citation, and it is affirmed.

Disposition: The Commissioner has reviewed the relevant law and all the information you submitted in response to the correction order. The evidence presented supports the citation, and it is affirmed. This is a final agency decision.
