Terms of Settlement Agreement:

1. License Holder’s family child care license, License No. 1094527, will be placed on conditional status for a period of two (2) years from the effective date of the Settlement Agreement. While under the conditional license, License Holder will comply with the following terms:

a. License Holder will follow and comply with all applicable Minnesota Statutes and Rules, including Minnesota Rules, parts 9502.0300 through 9502.0445, and background study requirements under Minnesota Statutes, chapter 245C.

b. License Holder’s family child care license will be limited to a maximum capacity of 12 children (class C2 license), and no variance to age distribution of capacity will be granted during the conditional period.

c. License Holder must notify Wright County prior to the enrollment of any new children in her family child care, including drop-in children. Wright County must approve all new enrollments prior to License Holder providing care.

d. License Holder must submit daily attendance records to Wright County on a monthly basis. The records must be submitted by the 7th of each month for the previous month (for example, the daily attendance records for March 2026 must be submitted by April 7, 2026). The records must show the name and the date of birth of each child, the days, and hours they were in your care, and must include parent sign in and sign out signatures. License Holder must require every parent/guardian who brings a child into your program to sign in and out their child each day.

e. License Holder must remit any outstanding fine amount to DCYF within 30 calendar days of the effective date of the Agreement.

f. License Holder must submit to her licensor any licensing documents deemed outstanding by Wright County within 30 calendar days of the effective date of the Agreement. 

g. License Holder must obtain a minimum of four (4) hours of additional training within 60 calendar days of effective date of the Agreement. The training is in addition to the annual training requirements listed in Minnesota Statutes, section 142B.70. The training must be in the area of KCF area VI: Professionalism. LH must obtain approval from Wright County that the training is appropriate, and you must submit documentation of your attendance to Wright County.  

h. License Holder must post the Settlement Agreement in her family child care program in a conspicuous place and provide a copy of the Agreement to parents or guardians of all children in care under License No. 1094527.  She must obtain signatures from parents or guardians of each child attending her family child care programs indicating they have received a copy of the Agreement.  Documentation that the parents received a copy of the Agreement must be provided to Wright County within 30 calendar days of the effective date of the Agreement.  For new families enrolling a child in the family child care program, License Holder must submit documentation signed by the parent or guardian to Wright County within five (5) calendar days of the child beginning to receive family child care services from her family child care program that verifies that the parent received a copy of the Agreement. 

i. If License Holder closes or temporarily stops services at license no. 1094527 during the conditional license period, License Holder must complete any remaining duration and/or terms of this conditional license in the event she applies for and is approved for a new family child care license or resumes services at license no. 1094527. 

2. License Holder agrees that failure to comply with the terms of this Settlement Agreement, including any licensing rule violations, may result in reinstatement of the Order of License Revocation, or any additional licensing action determined appropriate by DCYF. In that event, the parties agree that the scope of the hearing regarding the reinstated Order would be limited to whether the License Holder failed to comply with the terms of the Agreement.
