Reconsideration Determination Citation 1 Violation. All crib brand names, and model numbers were not checked annually against the U.S. Consumer Product Safety Commission website listing of unsafe cribs. Crib brand names and model numbers were checked in February 2024, but documentation was missing to verify that crib brand names and model numbers were checked before the end of February 2025.(Bumblebees: Infant classroom) “Annual" or “annually” means prior to or within the same month of the subsequent calendar year. Applicable Law. (a) Annually, from the date printed on the license, all license holders shall check all their cribs' brand names and model numbers against the United States Consumer Product Safety Commission website listing of unsafe cribs. (b) The license holder shall maintain written documentation to be reviewed on site for each crib showing that the review required in paragraph (a) has been completed, and which of the following conditions applies: (1) the crib was not identified as unsafe on the United States Consumer Product Safety Commission website; Minnesota Statutes, section 142B.45, subdivision 3. Annual or annually, with the exception of subdivision 3, means prior to or within the same month of the subsequent calendar year. Minnesota Statutes, section 142B.01, subdivision 2. Your Response. First, you stated that your current license is effective between January 1, 2025, through December 31, 2025; you are within your compliance window to complete and document the crib recall checks prior to the end of the calendar year and have not reached the deadline for the required annual review. Second, you stated the Bumblebee Room cribs are identical in brand and model to the cribs in the Ant Room. You completed and documented a crib recall check for cribs in the Ant Room; therefore, you have completed a crib recall check for the cribs in the Bumble Bee room. You noted that the statute does not require separate crib recall checks by classroom. Finally, you stated that you have implemented a crib recall tracking process per classroom to ensure clear documentation. Reconsideration Determination. Your licensing inspection was on July 24, 2025. The licensor noted that the crib brand names, and model numbers were last checked in February 2024. You are required to check the crib brand names and model numbers annually, from the date printed on the license. The issue date on your license was January 1, 2025. The record does not support the citation. Citation 1 is rescinded. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. Citation 1 is rescinded. This is a final agency decision.
