CORRECTION ORDER

Dear Abdullahi Elmi:

On December 11-12, 2025, a licensing review of Central Minnesota Home Health Care LLC, located at 801 E Franklin Avenue, Minneapolis, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245A.65, subdivision 1.

Violation: For four of five persons whose record was reviewed (P1, P2, P3 and P5) the license holder did not provide an orientation to the internal and external reporting procedures related to suspected or alleged maltreatment within 24 hours as required.

 

The license holder did not provide P1, P2, P3 and P5 with an orientation to the internal and external reporting procedures related to suspected or alleged maltreatment within 24 hours of admission.

· P1’s services were initiated on August 10, 2023 and P1 received this orientation on September 8, 2025.

· P2’s services were initiated on February 22, 2024, and P2 received this orientation on September 8, 2025.

 

Corrective Action Ordered: Within 30 days of receiving this order, you must provide P3 and P5 with an orientation to the internal and external reporting procedures related to suspected or alleged maltreatment and maintain documentation of this orientation in P3 and P5’s service recipient record as required in section 245D.095, subdivision 3, paragraph (b). On an ongoing basis, you must maintain compliance as required in this subdivision.

2. Citation: Minnesota Statutes, section 245A.65, subdivision 2.

 

Violation: For four persons whose records were reviewed (P1, P2, P3 and P5), the license holder did not develop an individual abuse prevention plan (IAPP) as required.

 

The license holder did not develop an IAPP for P1, P2, P3 and P5 prior to or upon service initiation.

· The license holder initiated P1’s services on August 10, 2023, and the license holder developed an IAPP for P1 on September 8, 2025.

· The license holder initiated P2’s services on February 22, 2024, and the license holder developed an IAPP on September 8, 2025.

· The license holder initiated P3’s services on May 1, 2024, and the license holder developed an IAPP for P3 on March 19,2025.

 

Corrective Action Ordered: Within 30 days of receiving this order, you must develop an IAPP for P5 and maintain documentation of the IAPP in P5’s service recipient record as required in section 245D.095, subdivision 3, paragraph (b). On an ongoing basis, you must maintain compliance as required in this subdivision

3. Citation: Minnesota Statutes, section 245D.04, subdivision 1.

 

Violation: For five persons whose records were reviewed (P1-P5), the license holder did not provide a written notice that identified the service recipient rights as required.

 

The license holder did not provide P1, P2, P3 or P3’s legal representative, P4 or P4’s legal representative and P5, with a written notice that identified the service recipient rights, and an explanation of those rights within five working days of service initiation.

· The license holder initiated services for P1 on August 10, 2023. The license holder provided the written notice to P1 on September 8, 2025.

· The license holder initiated services for P2 on February 22, 2024. The license holder provided the written notice to P2 on September 8, 2025.

· The license holder initiated services for P3 on May 1, 2024. The license holder provided this written notice to P3’s legal representative on March 19, 2025.

· The license holder initiated services for P4 on May 16, 2024, and June 10, 2024. The license holder provided this written notice to P4’s legal representative on April 2, 2025.

Corrective Action Ordered: Within 30 days of receiving this order you must provide P5 with an explanation and written notice that identifies the service recipient rights in subdivision 2 and 3 and maintain documentation of P5’s receipt of a copy and an explanation of those rights in P5’s service recipient record as required in section 245D.095, subdivision 3, paragraph (b). On an ongoing basis, you must maintain compliance as required in this subdivision.

4. Citation: Minnesota Statutes, section 245D.07, subdivision 2.

Violation: For three persons whose records were reviewed (P3, P4 and P5), the license holder did not complete initial service planning for basic support services as required.

The license holder did not establish a preliminary support plan addendum for P3, P4 and P5 within 15 calendar days of service initiation and then review and revise the preliminary support plan addendum to document the services that would be provided within 60 days of service initiation.

· The license holder initiated services for P3 on May 1, 2024. The license holder established a support plan addendum for P3 that documented the services that would be provided including how, when, and by whom services would be provided, and the person responsible for the delivery and coordination of services on March 19, 2025.

· The license holder initiated services for P4 on May 16, 2024, and June 10, 2024. The license holder established a support plan addendum that documented the services that would be provided including how, when, and by whom services would be provided, and the person responsible for the delivery and coordination of services on April 2, 2025.

· The license holder initiated services for P5 on February 1, 2025. The license holder did not establish a support plan addendum that documented the services that would be provided including how, when, and by whom services would be provided, and the person responsible for the delivery and coordination of services.

Corrective Action Ordered: Within 30 days of receiving this order, you must develop the above mentioned information for P5 and maintain documentation of the IAPP in P5’s service recipient record as required in section 245D.095, subdivision 3, paragraph (b). On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota Statutes, section 245D.071, subdivision 3, paragraphs (a)-(c).

Violation: For two persons whose records were reviewed (P1 and P2), the license holder did not meet service planning requirements for intensive support services.

a. The license holder did not complete a preliminary support plan addendum based on the support plan within 15 days of service initiation for P1 and P2. P2’s services were initiated on February 22, 2024. The license holder completed the preliminary support plan addendum on September 8, 2025. P1’s services were initiated on August 10, 2023. The license holder completed the preliminary support plan addendum on September 8, 2025.

b. The license holder did not, at a minimum, complete assessments For P1 and P2 in the following areas before providing 45 days of service or within 60 calendar days of service initiation, whichever is shorter:

· the person's ability to self-manage health and medical needs to maintain or improve physical, mental, and emotional well-being, including, when applicable, allergies, seizures, choking, special dietary needs, chronic medical conditions, self-administration of medication or treatment orders, preventative screening, and medical and dental appointments;

· the person's ability to self-manage personal safety to avoid injury or accident in the service setting, including, when applicable, risk of falling, mobility, regulating water temperature, community survival skills, water safety skills, and sensory disabilities; and

· the person's ability to self-manage symptoms or behavior that may otherwise result in an incident as defined in section 245D.02, subdivision 11, clauses (4) to (7), suspension or termination of services by the license holder, or other symptoms or behaviors that may jeopardize the health and welfare of the person or others.

These assessments for P1 and P2 were completed on September 8, 2025.

c. The license holder did not meet, within 45 days of service initiation, with P1 and P1’s case manager and P2 and P2’s case manager, and other members of the support team or expanded support team to determine the following based on information obtained from the assessments identified in paragraph (b), P11's identified needs in the support plan, and the requirements in subdivision 4 and section 245D.07, subdivision 1a:

· the scope of the services to be provided to support the person's daily needs and activities;

· the person's desired outcomes and the supports necessary to accomplish the person's desired outcomes;

· the person's preferences for how services and supports are provided, including how the provider will support the person to have control of the person's schedule;

· whether the current service setting is the most integrated setting available and appropriate for the person;

· opportunities to develop and maintain essential and life-enriching skills, abilities, strengths, interests, and preferences;

· opportunities for community access, participation, and inclusion in preferred community activities;

· opportunities to develop and strengthen personal relationships with other persons of the person’s choice in the community;

· opportunities to seek competitive employment and work at competitively paying jobs in the community;

· how services must be coordinated across other providers licensed under this chapter serving the person and members of the support team or expanded support team to ensure continuity of care; and

· a discussion of how technology might be used to meet the person's desired outcomes. The coordinated service and support plan or support plan addendum must include a summary of this discussion. The summary must include:

o a statement regarding any decision that is made regarding the use of technology; and

o a description of any further research that needs to be completed before a decision regarding the use of technology can be made.

This meeting for P1 and P2 were completed on September 8, 2025.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

6. Citation: Minnesota Statutes, section 245D.071, subdivision 4.

Violation: For two persons whose record was reviewed (P1 and P2), the license holder did not develop a service plan that documents the service outcomes and supports based on the assessments completed under subdivision 3 and the requirements in section 245D.07, subdivision 1a.

a. The license holder did not document the following for P1 and P2’s outcomes:

· the measurable and observable criteria for identifying when the desired outcome had been achieved and how data would be collected; and

· the projected starting date for implementing the supports and methods and the date by which progress towards accomplishing the outcomes would be reviewed and evaluated.

Corrective Action Ordered: Within 30 days of receiving this order, you must revise P1 and P2’s service plan to include the above mentioned information. On an ongoing basis, you must maintain compliance as required in this subdivision.

7. Citation: Minnesota Statutes, section 245D.095, subdivision 3.

Violation: For three persons whose records were reviewed (P3, P4 and P5), the license holder did not maintain service recipient records as required.

The license holder did not maintain progress or daily log notes recorded by the program in P3’s, P4’s and P5’s service recipient record.

Corrective Action Ordered: Within 30 days of receiving this order, you must begin maintaining daily log notes recorded by the program for each person to whom you are providing direct support services under this license. On an ongoing basis, you must maintain compliance as required in this subdivision.

8. Citation: Minnesota Statutes, section 245D.10, subdivision 4, paragraph (b).

Violation: For five persons whose records were reviewed (P1-P5), the license holder did not provide the policies and procedures affecting a person’s rights as required.

 

a. The license holder did not inform and provide copies of the following policies and procedures to P1’s case manager within five working days of service initiation:

· grievance policy and procedure;

· service suspension and termination policy and procedure;

· emergency use of manual restraints policy and procedure; and

· data privacy requirements under section 245D.11, subdivision 3.

b. The license holder did not inform and provide copies of the following policies and procedures to P2 and P2’s case manager within five working days of service initiation:

· grievance policy and procedure;

· service suspension and termination policy and procedure;

· emergency use of manual restraints policy and procedure; and

· data privacy requirements under section 245D.11, subdivision 3.

The license holder initiated services for P2 on February 22, 2024, and provided the policies and procedures to P2 on September 8, 2025.

c. The license holder did not inform and provide copies of the following policies and procedures to P3, P3’s legal representative, and P3’s case managers within five working days of service initiation:

· grievance policy and procedure;

· service suspension and termination policy and procedure;

· emergency use of manual restraints policy and procedure; and

· data privacy requirements under section 245D.11, subdivision 3.

The license holder initiated services for P3 on May 1, 2024, and provided the policies and procedures to P3’s legal representative on March 19, 2025.

d. The license holder did not inform and provide copies of the following policies and procedures to P4 or P4’s legal representative, and P4’s case manager within five working days of service initiation:

· grievance policy and procedure required under subdivision 2; and

· service suspension and termination policy and procedure.

The license holder initiated services for P4 on May 16, 2024, and June 10, 2024. The license holder provided these policies and procedures to P4’s legal representative on April 2, 2025, and to P4’s case manager on December 10, 2025.

e. The license holder did not inform and provide copies of the following policies and procedures to P5 and P5’s case manager within five working days of service initiation:

· grievance policy and procedure; and

· service suspension and termination policy and procedure;

Corrective Action Ordered: Within 30 days of receiving this order, you must inform and provide copies of the policies and procedures identified above to P3 and P5 and P1’s, P2’s P3’s and P5’s case manager. On an ongoing basis, you must maintain compliance as required in this subdivision.

9. Citation: Minnesota Rules, part 9544.0030, subpart 1.

 

Violation: For five persons whose records were reviewed (P1-P5), the license holder did not evaluate positive support strategies as required.

The license holder did not evaluate the identified positive support strategies with P1, P3, P4 and P5 every 6 months.

Corrective Action Ordered: Within 30 days of receiving this order, you must evaluate the identified positive support strategies with P1- P5. Based upon the results of the evaluation, you must determine whether changes are needed in the positive support strategies used, and, if so, make appropriate changes. On an ongoing basis, you must maintain compliance as required in this subpart.

10. Citation: Minnesota Rules, part 9544.0080, subparts 1 and 2.

Violation: For two persons whose records were reviewed (P4 and P5), the license holder did not provide notice of the license holder’s policy on the emergency use of manual restraint as required.

The license holder did not provide P4 and P4’s legal representative and P5 notice, in writing, of the license holder’s policy on the emergency use of manual restraint at the time of service initiation. The license holder initiated services for P4 on May 16, 2024, and June 10, 2024. The license holder provided notice to P4’s legal representative on April 2, 2025.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide P5 with the above mentioned policy. On an ongoing basis, you must maintain compliance as required in these subparts.

11. Citation: Minnesota Statutes, section 245D.09, subdivision 4.

Violation: For four of five staff persons whose records were reviewed (SP2, SP3, SP4, and SP5), the license holder did not provide orientation training as required.

a. The license holder did not provide orientation training to SP2 on the following topics within 60 calendar days of hire:

· the job description and how to complete specific job functions;

· the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04;

· sections 245A.65, 245A.66, and 626.557 and chapter 260E governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment. This orientation must be provided within 72 hours of first providing direct contact services and annually thereafter according to section 245A.65, subdivision 3;

· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;

· basic first aid; and

· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.

b. The license holder did not provide and ensure completion of orientation sufficient to create staff competency for SP3, SP4, and SP5 in the following areas:

· how to complete specific job functions, including:

o responding to and reporting incidents as required under section 245D.06 subdivision 1; and

o following safety practices established by the license holder and as required in section 245D.06 subdivision 2;

· the license holder’s current policies and procedures required under this chapter, including their location and access, and staff responsibilities related to implementation of those policies and procedures;

· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices;

· the service recipient’s rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements in section 245D.04;

· sections 245A.65, 245A.66, and 626.557 and chapter 260E governing maltreatment reporting and service planning for children and vulnerable adults, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment. This orientation must be provided within 72 hours of first providing direct contact services and annually thereafter according to section 245A.65, subdivision 3;

· the principles of person-centered service planning and delivery as identified in section 245D.07, subdivision 1a, and how they apply to direct support service provided by the staff person;

· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint;

· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe;

· basic first aid; and

· strategies to minimize the risk of sexual violence, including concepts of healthy relationships, consent, and bodily autonomy of people with disabilities.

Additionally, the license holder did not ensure SP4 and SP5 received an orientation to the job description.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide SP2, SP3, SP4, and SP5, with an orientation to the topics identified above. Additionally, you must maintain documentation of this training in SP2’s, SP3’s, SP4’s, and SP5’s personnel records according to the requirements in section 245D.095, subdivision 5. On an ongoing basis, you must maintain compliance as required in this subdivision and provide annual training on the topics required in section 245D.09, subdivision 5.

12. Citation: Minnesota Statutes, section 245D.09, subdivision 4a.

Violation: For four staff persons whose records were reviewed (SP2, SP3, SP4, and SP5), the license holder did not provide orientation to individual service recipient needs as required.

 

a. The license holder did not ensure SP2, SP3, SP4, and SP5, reviewed and received instruction on the following before having unsupervised direct contact with a person served by the program:

· the person’s support plan or support plan addendum as it relates to the responsibilities assigned to the license holder; and

· when applicable, the person’s individual abuse prevention plan (IAPP) to achieve and demonstrate an understanding of the person as a unique individual and how to implement those plans.

b. The license holder did not ensure SP4 and SP5 reviewed and received instruction on medication assistance procedures established for the person when assigned to the license holder according to section 245D.05, subdivision 1, paragraph (b).

 

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· provide SP2, SP3, SP4, and SP5 with instruction on the support plan or support plan addendum and IAPP, if applicable, for each individual that SP2, SP3, SP4, and SP5, provides direct support to;

· provide SP4 and SP5 with instruction on medication assistance, for each individual that SP4 and SP5 provides direct support to;

· maintain documentation of this training in the SP3’s, SP4’s, and SP5’s personnel records, according to the requirements in section 245D.095, subdivision 5.

On an ongoing basis, you must maintain compliance as required in this subdivision.

13. Citation: Minnesota Statutes, section 245D.09, subdivision 5.

Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide annual training as required.

The license holder did not provide SP2 with annual training on the following topics in 2025:

· data privacy requirements according to sections 13.01 to 13.10 and 13.46, the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), and staff responsibilities related to complying with data privacy practices;

· the safe and correct use of manual restraint on an emergency basis according to the requirements in section 245D.061 or successor provisions, and what constitutes the use of restraints, time out, and seclusion, including chemical restraint; and

· staff responsibilities related to prohibited procedures under section 245D.06, subdivision 5, or successor provisions, why such procedures are not effective for reducing or eliminating symptoms or undesired behavior, and why such procedures are not safe.

Corrective Action Ordered: Within 30 days of receiving this order, you must provide training to SP2 on the above mentioned topics. On an ongoing basis, you must maintain compliance as required in this subdivision.

14. Citation: Minnesota Statutes, section 245D.095, subdivision 5, paragraphs (a) and (b).

Violation: For one staff person whose record was reviewed (SP2), the license holder did not maintain personnel records as required.

a. The license holder did not maintain a personnel record for SP2 that documented staff orientation and training that included the number of hours per subject area and the name of the trainer or instructor.

b. The license holder did not maintain documentation in SP2’s personnel record or elsewhere sufficient to determine the date of SP2’s first supervised direct contact with a person served by the program, and the date of first unsupervised direct contact with a person served by the program.

Corrective Action Ordered: Within 30 days of receiving this order, you must document the above mentioned information in SP2’s record. On an ongoing basis, you must maintain compliance as required in this subdivision.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
