Michelle Mulligan 215 13th Avenue NE Buffalo, MN 55313 License Number: 1109947 (Adult Foster Care) Dear Michelle Mulligan: The Minnesota Department of Human Services (DHS), Division of Licensing, received your request for reconsideration regarding citation 2 in the correction order issued to you by Wright County on August 8, 2025. After an independent review of the record, the Commissioner has determined there is sufficient evidence to support the citation and it is affirmed. You did not challenge the remaining citation and indicated in your reconsideration request that you accepted it. As a result, that citation is final and not within the scope of this review. Reconsideration Determination Citation 2 The citation was issued because you did not maintain a record of completed training. Specifically, the county licensor made numerous requests to collect the record of annual training requirements. Applicable Law Under Minnesota Rules, part 9555.6185, subpart 2, in addition to the orientation training, caregivers must complete the training designed to meet the needs of the residents in care in any of the subject areas and in the amount specified in subpart 4. The operator must ensure that a record of training completed is maintained. The rule requires that caregivers with zero to five years of licensure or experience as an adult foster home caregiver must complete 12 hours training in a year.
Your Response and Response from Wright County You submitted a letter in which you indicated you believe the citation was incorrect. You indicated you submitted all required documents and that all education was fully completed. You submitted supporting documentation. The county licensor submitted a letter in support of upholding the citation along with supporting documentation. Reconsideration Determination You were licensed in June 2022 and were therefore required to complete 12 hours of training in a year. In an email dated April 7, 2025, the county licensor indicated she was unable to verify training hours for the first year of the licensure period. The email requested that you send a training transcript or other documentation showing training topic, date of training, and hours of training for at least 12 hours completed from 6/1/2023 to 5/31/2024. The licensor sent another email on April 17, 2025, advising you of an upcoming leave and providing details about a contact person in her absence. The licensor then sent you an email on April 25, 2025, indicating that if the training documentation was not received by April 28, 2025, a correction order would likely be issued with an official deadline to provide the training. The licensor sent you another email on April 28, 2025, requesting that you provide documentation of the required training by June 1, 2025, and advising you that not providing the documentation would result in a correction order. You sent the licensor an email on July 10, 2025, with requested documentation. The licensor sent you an email on August 7, 2025, requesting additional information (transcript) be provided by August 10, 2025. The licensor then sent you an email on August 8, 2025, acknowledging receipt of the required information and advising that a citation would be issued because you did not have your record of training readily available. Documentation submitted by you and the county licensor showed that you were unable to provide the required training documentation at the time of the relicensing visit on April 3, 2025. The licensor then provided a deadline of June 1, 2025, to submit the documentation, and you did not submit documentation until July 10, 2025. The rule requires that you ensure that a record of training completed is maintained. As a result, there is sufficient evidence to support the citation, and it is affirmed. Disposition The Commissioner has reviewed the relevant laws and all the information you submitted in response to the Correction Order. The record supports the challenged citation, and it is affirmed. This is a final agency decision. The Commissioner appreciates your response and encourages you to continue to work cooperatively with your licensor regarding questions about corrective action ordered in the correction order.
