CORRECTION ORDER

Dear Yasin Siyad:

On March 13, 2026, a licensing review of Oakley Care, located at 111 19th Avenue North, Hopkins, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued.

A. Reason for Correction Order

Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder.

The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services.

1. Citation: Minnesota Statutes, section 245D.06, subdivision 1 and section 245D.11, subdivision 2, clause (7).

Violation: For one person whose record was reviewed (P1), the license holder did not respond to and review incidents as required.

a. The license holder did not report incidents to P1’s legal representative and case manager within 24 hours of an incident that occurred on December 16, 2025, and January 25, 2026.

b. On December 16, 2025, and January 25, 2026, P1 was involved in incidents in which staff called 911. The license holder did not include whether the person’s support plan addendum or program policies and procedures were implemented as applicable in the incident reports. Additionally, the license holder did not conduct a review of these incident reports for identification of incident patterns and implementation of corrective action as necessary to reduce occurrences.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· notify P1’s legal representative and case manager of the above-mentioned incidents; and

· document the above-mentioned information on P1’s incident reports and conduct a review of the incident reports for identification of incident patterns and implementation of corrective action as necessary to reduce occurrences.

On an ongoing basis, you must maintain compliance with this subdivision as required.

2. Citation: Minnesota Statutes, section 245D.071, subdivision 4.

Violation: For one person whose record was reviewed (P1), the license holder did not implement the service outcomes and supports as required.

The license holder did not implement the supports for P1 including the use of equipment and materials required. The license holder identified that they would utilize a visual medication chart and a structured daily schedule displayed in P1’s space to promote consistency and structure. At the time of the review, the license holder did not have a visual medication chart or structured daily schedule for P1 to implement the service outcomes and supports as documented.

Corrective Action Ordered: Within 30 days of receiving this order, you must develop and maintain the above-identified equipment and materials for P1’s outcome. On an ongoing basis, you must maintain compliance as required in this subdivision.

3. Citation: Minnesota Rules, part 9544.0110.

Violation: For one person whose record was reviewed (P1), the license holder did not report incidents as required.

The license holder did not use the behavior intervention report form required by the commissioner to report the incidents to the commissioner. P1 was involved in behavioral incidents that occurred on November 20, 2025, and December 8, 2025, that resulted in a call to 911.

Corrective Action Ordered: Within 30 days of receiving this order, you must submit the above-mentioned incidents to the commissioner using the behavior intervention report form. On an ongoing basis, you must maintain compliance with this part as required.

4. Citation: Minnesota Statutes, section 245D.09, subdivision 4 and 4a.

Violation: For one of three staff persons whose records were reviewed (SP2), the license holder did not provide orientation as required.

The license holder hired SP2 on October 16, 2024. The license holder did not provide SP2 with the following training within 60 days of hire:

· the principles of person-centered service planning and delivery as identified in Minnesota Statutes, section 245D.07, subdivision 1a, and how they applied to direct support services provided by the staff; SP2 receiving this training on November 12, 2025; and

· the person’s support plan or support plan addendum as it relates to the responsibilities assigned to the license holder, to achieve an understanding of the person as a unique individual and how to implement those plans; SP2 received this training on March 8, 2026.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required in this subdivision.

5. Citation: Minnesota statutes, section 245D.09, subdivision 5.

Violation: For one staff person whose record was reviewed (SP2), the license holder did not provide annual training as required.

Minnesota Statutes, section 245A.02, subdivision 2b defines “annual” or “annually” to mean prior to or within the same month of the subsequent calendar year.

The license holder did not provide SP2 with annual training in 2025 on sections 245A.66, and chapter 260E, governing maltreatment reporting and service planning for children, and staff responsibilities related to protecting persons from maltreatment and reporting maltreatment.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance with this subdivision as required.

6. Citation: Minnesota Statutes, section 245D.10, subdivision 2.

Violation: The license holder did not develop a policy and procedures that promoted service recipient rights by providing a simple complaint process for persons served by the program and their authorized representatives to bring a grievance as required.

The license holder did not establish a grievance policy that allowed a person to bring a complaint to the highest level of authority in the program and that provides the name, address, and telephone of that person. The license holder maintained a grievance policy dated October 20, 2025, that identified SP3 as the highest level of authority in the program. At the time of the review, it was determined SP3 was not the highest level of authority in the program.

Corrective Action Ordered: Within 30 days of receiving this order, you must:

· develop a policy that identifies the highest level of authority in the program that provides the name, address, and telephone number of that person;

· provide an orientation of the grievance policy to all service recipients, their legal representatives, if applicable, and case managers and maintain documentation of the orientation in each person’s record; and

· provide staff persons providing direct support to persons at these locations with an orientation to the policy. You must document this orientation in each staff person’s personnel record according to the requirements in 245D.095.

On an ongoing basis, you must maintain compliance with this subdivision as required.

If you fail to correct the violations specified in the Correction Order within the prescribed time lines the Commissioner may issue an Order of Conditional License or may impose a fine and order other licensing sanctions pursuant to Minnesota Statutes, sections 245A.06 and 245A.07.

B. Right to Request Reconsideration

If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report. Your request for reconsideration must be sent to:

Please note that a request for reconsideration does not stay any provisions or requirements of the Correction Order. The Commissioner’s disposition of a request for reconsideration is final and not subject to appeal under Minnesota Statutes, chapter 14.
