April 21, 2026 Justin Swanson Residential Transitions Incorporated 2510 Lexington Avenue South Mendota Heights, MN 55120-1260 License Number: 1069786 (245D – Home and Community-Based Services) License Number: 1116303 (Community Residential Services) Investigation Report Number: 202600855 CORRECTION ORDER Dear Justin Swanson: On March 10, 2026, a licensing investigation of Residential Transitions Incorporated located at 1522 Waterloo Avenue, South Saint Paul, Minnesota, was conducted to determine compliance with state and federal laws and rules governing the provision of home and community-based services to persons with disabilities and age 65 and older under Minnesota Statutes, Chapter 245D. As a result of this licensing review a Correction Order is being issued. A. Reason for Correction Order Pursuant to Minnesota Statutes, section 245A.06, if the Commissioner of the Department of Human Services (DHS) finds that the license holder has failed to comply with an applicable law or rule and this failure does not imminently endanger the health, safety, or rights of the persons served by the program, the Commissioner may issue a Correction Order to the license holder. The following violation(s) of state or federal laws and rules were determined as a result of the licensing review. Corrective action for each violation is required by Minnesota Statutes, section 245A.06 and is hereby ordered by the Commissioner of Human Services. 1. Citation: Minnesota Statutes, section 245D.04, subdivision 3. Violation: For one person whose record was reviewed (P1), the license holder did not ensure the exercise and protection of the service recipient rights as required. The license holder did not ensure the exercise and protection of P1’s protection-related right to engage in chosen activities. The license holder established and enforced “CRS Transportation Guidelines” which restricted persons served access to transportation to engage in chosen activities. The license holder maintained documentation in P1’s support plan addendum that “staff will only transport P1 for community outings during daytime hours”; “staff are not permitted to transport P1 after dark”; and “any outings or transportation requests outside of this policy required prior program approval from team”. Corrective Action Ordered: Within 30 days of receiving this order you must: · discontinue use of program guidelines that restrict persons’ served ability to engage in chosen activities; · audit all service recipient records to ensure protection of person’s protection-related rights, including the right to engage in chosen activities; · as needed, make changes to the person’s support plan addendum to reflect the results of this audit and send updated support plan addendum to the person, the person’s legal representative, and the case manager; provide all staff with training on: o the service recipient rights and staff responsibilities related to ensuring the exercise and protection of those rights according to the requirements of this subdivision; o staff responsibilities related to protecting persons from maltreatment and reporting maltreatment according to section 245A.65, subdivision 3; o review and instruction on the person’s updated support plan or support plan addendum; and · maintain documentation of staff training according to Minnesota Statutes 245D.095. On an ongoing basis, you must maintain compliance as required in this subdivision. 2. Citation: Minnesota Statutes, section 245D.07, subdivision 1. Violation: For one person whose record was reviewed (P1), the license holder did not provide service planning and delivery as required. The license holder did not provide P1 with services in response to P1’s identified needs as specified in the support plan addendum. The license holder maintained documentation in P1’s support plan addendum that “P1 will receive 1:1 staffing” and provided P1 with shared staffing from 12am to 7a. Corrective Action Ordered: Immediately upon receiving this order you must provide P1 with 1:1 staffing as specified in P1’s support plan addendum. On an ongoing basis, you must maintain compliance as required in this subdivision. B. Right to Request Reconsideration If you believe any of the citations are in error, you have the right to request that the Commissioner of Human Services reconsider the parts of the Correction Order that you believe to be in error. The request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this report.
