CORRECTION ORDER

An investigation of Thrive Behavioral Network, LLC was completed regarding report number 202511449, which alleged violation of Minnesota Statutes, section 626.557, and Minnesota Statutes, Chapter 245D. This maltreatment allegation concerned emotional abuse and neglect. The disposition of the investigation report is inconclusive. Three violations were noted.

VIOLATIONS AND CORRECTION ORDERS

The following violations of state and (or) federal laws and rules were observed. Corrective action for each violation is required by Minnesota Statutes, section 245A.06, and is hereby ordered by the Commissioner of Human Services. Failure to correct the violations within the prescribed amount of time may result in fines and/or action against your license, as provided for in Minnesota Statutes, sections 245A.06 and 245A.07.

1.  Citation: Minnesota Statutes section 245D.04, subdivision 3, paragraph (a), clause (6)

Violation: The license holder did not ensure a person's protection-related rights included the right to be treated with courtesy and respect.

Information was provided that on October 4, 2025, a staff person (S1) dripped water on a client’s (C1) face and banged pots and pans nearby to wake C1 up from sleeping.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required with this subdivision.

2.  Citation: Minnesota Statutes section 245D.06, subdivision 1

Violation: The license holder did not respond to incidents under section 245D.02, subdivision 11, that occur while providing services to protect the health and safety of and minimize risk of harm to the person.

Information was provided that on October 4, 2025, staff persons (S1 and S2) repeatedly attempted to wake up a client (C1), who was “unresponsive,” for 20 to 60 minutes before finally calling 9-1-1 to have C1’s wellbeing assessed by medical professionals. When paramedics arrived, C1 immediately woke up and told people to leave his/her bedroom.

Corrective Action Ordered: On an ongoing basis, you must maintain compliance as required with this subdivision.

3.  Citation: Minnesota Statutes 245D.095, subdivision 5

Violation: For one of five staff persons, whose records were reviewed (S2), the license holder did not maintain documentation of training.

The license holder did not maintain documentation of S2’s training on a client’s (C1) support plan or support plan addendum as it relates to the responsibilities assigned to the license holder, and when applicable, C1’s individual abuse prevention plan, to achieve and demonstrate an understanding of C1 as a unique individual, and how to implement those plans.

Corrective Action Ordered: Within 30 days of receipt of this order, you must ensure S2 receives the training listed above and that the training is documented. On an ongoing basis, you must maintain compliance as required with this subdivision.

If you believe any of the citations are in error, you may ask the Commissioner of Human Services to reconsider the parts of the correction order that you believe to be in error. If you choose to exercise this right, your request for reconsideration must be in writing and received by the Commissioner within 20 calendar days after receipt of this letter.
